P <br />�9 <br />i <br />nATF <br />INTERLOCAL AGREEMENT REGARDING WC-144 <br />THIS AGREEMENT is entered into between the City of Tukwila, <br />hereinafter referred to as "Tukwila and the City of Renton, <br />hereinafter referred to as "Renton <br />WHEREAS, the Cities of Renton and Tukwila are authorized by <br />Chapter 39.34 RCW to enter into agreements for the purpose of <br />interlocal cooperation, and <br />WHEREAS, the Tukwila City Council has passed Resolution No. <br />1008 which indicates Tukwila's willingness to accept <br />annexation to Tukwila of certain property currently located within <br />Renton and more particularly described on Exhibit A attached <br />hereto and incorporated herein by this reference as if fully set <br />forth to Tukwila, and calls for certain property currently <br />located within Tukwila and described on Exhibit B attached <br />hereto and incorporated herein by this reference as if fully set <br />forth to be annexed to Renton, and <br />WHEREAS, the Renton City Council has passed Resolution No. <br />which calls for certain property currently located <br />within Renton and more particularly described on Exhibit A to be <br />annexed to Tukwila and indicates Renton's willingness to accept <br />annexation of certain property currently located within Tukwila <br />and more particularly described on Exhibit B to Renton, and <br />WHEREAS, both Resolutions recognize that there are issues of <br />concern to both Renton and Tukwila that must be mutually resolved <br />and Renton and Tukwila desire to enter into an interlocal <br />agreement to resolve these issues, now, therefore <br />FOR AND IN CONSIDERATION OF the mutual benefits and <br />conditions hereinafter contained, the parties hereto agree as <br />follows: <br />1. Scope and Effect of Agreement. It is the intent of the <br />parties to resolve issues of mutual concern with respect to <br />pending reciprocal annexations. This Agreement shall become <br />effective and shall bind the parties upon completion of the latter <br />of the annexation of the property described on Exhibit B to Renton <br />and annexation of the property described on Exhibit A to the City <br />of Tukwila. In the event that, for any reason, one or both of the <br />above referenced annexations are not completed, then this <br />Agreement shall be null and void. <br />2. Strander Boulevard /S. W. 27th Street Improvements. <br />Local costs of the future crossing of the railroad tracks by <br />Strander Boulevard /S. W. 27th Street should be shared equitably <br />between the two parties. In pursuit of this Agreement, both <br />Cities agree to designate the aforementioned improvement of <br />Strander Boulevard /S. W. 27th Street as a high priority item on <br />each City's Transportation Improvement Plan, and each provide <br />one -half of the local funds needed to match an 80% federal funding <br />for this road improvement project. <br />Because the timing of this street extension is uncertain, <br />Renton and Tukwila agree to monitor development and, as <br />development warrants, to acknowledge that the route is needed and <br />that both jurisdictions will cooperate to insure that an <br />appropriate connection is designed and constructed. Because the <br />crossing will be located entirely within Tukwila upon completion <br />of the annexation, the final decision as to the time for <br />improvement shall be left to the discretion of Tukwila. If <br />federal funding is unavailable, then Renton and Tukwila will <br />negotiate an equitable funding option as necessary, such that each <br />cities' share of the local costs of the improvement shall be 50 <br />3. S. W. 43rd Street /S. 180th Street Improvements. If a <br />proposed grade separated crossing of S.
