WHEN RECORDED RETURN TO <br />Office of the city clerk <br />Renton i.1a icipal�3uilding <br />200 Miii fr✓enu South <br />Renton, WA 98055 <br />AGREEMENT FOR THE EMERGENCY SALE OF WATE1A, <br />BETWEEN <br />THE CITY OF RENTON AND THE CITY OF TUKWILA `'4,, `f'�, <br />This AGREEMENT made and entered into thi I day of 'Cif- 1995, by and <br />between the CITY OF RENTON, a municipal corporation of the State of Washington, hereinafter <br />called "RENTON" and the CITY OF TUKWILA, a municipal corporation of the State of <br />Washington, acting through its Water Department, hereinafter called "TUKWILA" <br />q5 /o <br />CAG -95 -0 <br />NOW THEREFORE, IT IS AGREED AS FOLLOWS <br />WHEREAS, RENTON and TUKWILA may expenence periodic water supply shortfall, <br />WHEREAS, RENTON and TUKWILA recognize the public benefits of cooperation and <br />collaborative problem solving; <br />WHEREAS, RENTON and TUKWILA are willing to sell water in an emergency at the <br />existing system interties, <br />WHEREAS, the parties desire to enter into an AGREEMENT providing for the emergency <br />sale of water <br />1) Term of AGREEMENT. The effective date of this AGREEMENT shall be <br />(2 ni 1995 The AGREEMENT shall be for a minimum of one (1) <br />year and shall continue in full force and effect in its present form or as amended until <br />terminated by either party in accordance with Section 13 of this AGREEMENT The rates <br />and quantities of water sold are set forth in Sections (2), and (6) <br />2) Rate. For 1995 the BUYER shall pay to the SELLER for all water delivered at the rate of <br />$1 35 per 100 cubic feet, which is the Seattle Water Depaitinent summer new water rate for <br />1995 The rate charged to the BUYER shall be adjusted each year on January 1st using the <br />method described as follows The rate charged by the SELLER shall be the larger of the <br />following: 1) the current Seattle Water Department summer new water rate (in dollars per 100 <br />cubic feet) or 2) [$1.24 per 100 cubic feet] times [the current City of Renton retail commodity <br />rate (in dollars per 100 cubic feet)] divided by [$1 68 per 100 cubic feet]. <br />3) Metering. RENTON and TUKWILA shall each provide, and own and maintain, an <br />appropriate metenng device to measure the water flowing through the intertie An interlocal <br />agreement may be prepared to allow one party to operate and maintain the intertie and <br />distribute the costs equally between the both parties As soon as either becomes aware of flow <br />of water through the intertie that party will notify the other If prior notification is feasible, <br />the party requesting the water shall provide a description and documentation of the emergency <br />condition to the other party Each party will monitor its meter(s) on a regular basis <br />4) Pnority and Continuity of Service. The determination of whether water is available for <br />emergency sale shall be at the sole discretion of the party delivering (selling) the water In the <br />event of a condition requiring restrictions on the delivery of water, the party delivering the <br />water shall have the nght to restrict or interrupt service The party providing water may <br />voluntarily interrupt or reduce deliveries of water if it determines that such interruption or <br />00'Oi GIS §OO S118O33..
