K -9 TRAINING CONTRACT <br />PAGE 3 <br />sessions per year, and for the duration of this contract. <br />(b) To provide reimbursement monies to the Kent Police Department in <br />accordance with the Kent Police Department billing procedures, after the agreed Police <br />Dog Maintenance Training has begun. <br />3. Nothing in this agreement shall be considered to create the relationship of <br />employer and employee between the parties hereto. Neither Kent Police Department nor <br />any employee of the Kent Police Department shall be entitled to any benefits accorded <br />City employees by virtue of the services provided under this agreement. The City shall not <br />be responsible for withholding or otherwise deducting federal income tax or social security <br />or contributing to the State Industrial Insurance Program, or otherwise assuming the duties <br />of an employer with respect to the Kent Police Department, or any employee of the Kent <br />Police Department. <br />4. In the event of any claims, injuries, damages, losses or suits including <br />attorney fees, arising out of or in connection with the performance of this agreement, each <br />party shall defend, indemnify and hold the other party harmless for losses attributed to <br />each party's own comparative negligence. <br />5. Record Keeping and Reporting. The City shall maintain accounts and <br />records, including personnel, property, financial and programmatic records which <br />sufficiently and properly reflect all direct and indirect costs of any nature expended and <br />services obtained or given in the performance of this Agreement and other such records as <br />may be deemed necessary by the City to ensure the performance of this Agreement. <br />
