its needs during the following fifteen (15) years (whether or not those Water Supply Assets <br />are transferred to Cascade or retained as Independent Supply) commencing on the Member's <br />Cascade Supply Date. When a supply contract is negotiated with Seattle, any Member that is <br />a Seattle Contract Purveyor shall relinquish its rights under its Seattle Water Purveyor <br />Contract to Cascade and execute such documents as may be necessary to transfer those rights <br />to Cascade. Cascade shall accept those rights and a corresponding obligation to provide a <br />Fully Supply Commitment (net of Independent Supply). The approval of a contract with the <br />City of Seattle providing for the initial acquisition of rights to substantial Water Supply <br />Assets, and any material amendment to that contract, shall be effective upon a 65% Dual <br />Majority Vote. <br />Any Full Supply Commitment shall be subject to water shortages, to Cascade's ability <br />to implement the Water Supply Plan, and to the portion of the Member's needs that can be <br />served by the audited capacity of its Independent Supply. If the needed supply is not <br />available, the shortage shall be shared by all the Members in accordance with Cascade's <br />shortage management plan, except as otherwise provided in Section 5.5. Cascade is not <br />obligated to provide water supply to service area expansions in or outside the urban growth <br />boundary, unless Cascade agrees to such expanded service area. However, Cascade shall be <br />obligated to provide water supply to the entire service area of each Member (as that service <br />area is defined in terms under which the Member was admitted), whether or not some of that <br />service area is within the Member's current jurisdictional boundaries and/or within the current <br />urban growth boundary.
