CASCADE WATER ALLIANCE <br />INTERLOCAL CONTRACT <br />Recitals <br />WHEREAS, the Cascade Water Alliance, an intergovernmental organization created <br />by Interlocal Contract effective April 1, 1999 (as amended July 2000 and November 2002) to <br />further the interests of its Members with respect to water supply and to work cooperatively <br />with other water supply entities in the region; and <br />WHEREAS, Members of the Cascade Water Alliance have determined to amend the <br />Cascade Water Alliance's Interlocal Contract to better facilitate the purpose of the Cascade <br />Water Alliance; <br />NOW, THEREFORE, it is agreed as follows: <br />ARTICLE 1. Agreement <br />The Cascade Interlocal Contract, effective April 1, 1999, and entered into under <br />authority of the Interlocal Cooperation Act, Chapter 39.34 RCW is amended and re- stated as <br />provided herein. <br />ARTICLE 2. Definitions <br />"Asset Transfer Agreement" means an agreement between Cascade and a Member <br />by which the Member transfers title to Water Supply Assets to Cascade, with or without <br />monetary consideration, to be operated and maintained as part of the Cascade Water System. <br />"Authorized Issuer" means either: (a) Cascade (or a successor entity); or (b) a <br />Member or other entity authorized to issue Bonds for the benefit of Cascade approved by <br />Resolution of the Board. <br />"Board" means the Board of Directors of Cascade. <br />Cascade Interlocal Contract I <br />Amended and Restated <br />October 26, 2011 <br />
