ADDENDUM #49 <br />GENERAL TERMS and CONDITIONS <br />For Sharing of Fiber Optic Installation Projects <br />WHEREAS, the City of Bellevue, the City of Kirkland, the City of Renton, the City of <br />Seattle, the City of Auburn, the City of Federal Way, the City of Puyallup, the Lake Washington <br />School District, the Renton School District, the Bellevue School District, the University of <br />Washington, Bellevue College, Valley Communications Center, and Evergreen Hospital, (the <br />"Participating Agencies have entered into the General Terms and Conditions for Sharing of <br />Fiber Optic Installation Projects, and; <br />WHEREAS, the City of Tukwila desires to participate in the planned and future Fiber <br />Optic Projects but cannot because it is not a Participating Agency subject to the General Terms <br />and Conditions for Sharing of Fiber Optic Installation Projects, and; <br />WHEREAS, the current Participating Agencies desire to amend the General Terms and <br />Conditions for Sharing of Fiber Optic Installation Projects to add the City of Tukwila as a <br />Participating Agency for participation in the planned and future Fiber Optic Projects; <br />NOW THEREFORE, the parties hereby agree as follows: <br />1) All terms in this Addendum shall have the same meaning as the defined terms in <br />the General Terms and Conditions for Sharing of Fiber Optic Installation Projects. <br />2) The City of Tukwila hereby acknowledges that it has read, understands and <br />accepts the General Terms and Conditions for Sharing of Fiber Optic Installation Projects, <br />hereby incorporated by reference as if fully set forth, and agrees to be bound by them. <br />3) As provided in Section IX, paragraph N, the current Participating Agencies <br />hereby amend the General Terms and Conditions for Sharing of Fiber Optic Installation Projects <br />to add the City of Tukwila as a Participating Agency, and the City of Tukwila, by executing this <br />agreement, consents to becoming a Participating Agency. <br />IN WITNESS WHEREOF, the parties hereto have executed this Addendum to the <br />General Terms and Conditions for Sharing of Fiber Optic Installation Projects on the respective <br />dates indicated below. <br />David Ramsay Date City Attorney <br />City Manager, City of Kirkland <br />Steve Sarkozy Date City Attorney <br />City Manager, City of Bellevue <br />1 <br />10 -044 <br />Council Approval by Res #1708 <br />Approved as to Form: <br />Approved as to Form: <br />F� COPY <br />
