The Agreement does not contain all the required language regarding fair housing and <br />civil rights obligations and the First Amendment contained certain material omissions in <br />incorporating such required language. <br />H. Under Notice CPD -23-02, urban counties have the option of drafting a separate <br />amendment to their existing cooperation agreements with signatory jurisdictions that <br />include the required language rather than drafting a new cooperation agreement that <br />contains the provisions. <br />I. The purpose of this Second Amendment is to expressly state the required language <br />regarding fair housing and civil rights obligations and to memorialize the attendant <br />obligations as though set forth in the Agreement. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the terms, conditions and mutual covenants set forth <br />herein, the Parties agree to amend the Agreement as follows: <br />1. The foregoing recitals are true and correct in all respects and are incorporated hereby as if <br />fully set forth herein. <br />2. Section I of the Agreement is hereby amended and restated in its entirety as follows: <br />"The County and City agree to cooperate to undertake, or assist in undertaking, community <br />renewal and lower-income housing assistance activities, funded from annual CDBG, ESG <br />and HOME Program funds from federal fiscal years 2024, 2025 and 2026 appropriations, <br />from recaptured funds and from any program income generated from the expenditure of <br />such funds. These activities include the provision of decent housing, homeless assistance, <br />and a suitable living environment and economic development opportunities, principally for <br />persons with very low to moderate incomes. The County and City shall take all actions <br />necessary to assure compliance with the urban county's certification under section 104(b) <br />of Title I of the Housing and Community Development Act of 1974, and assure the grant <br />will be conducted and administered in conformity with Title VI of the Civil Rights Act of <br />1964, and the implementing regulations at 24 CFR part 1, and the Fair Housing Act, and <br />the implementing regulations at 24 CFR part 100, and will affirmatively further fair <br />housing. See 24 CFR § 91.225(a) and Affirmatively Furthering Fair Housing Definitions <br />and Certifications (86 FR 30779, June 10, 2021), at 24 CFR 5.151 and 5.152. The City <br />and County shall comply with section 109 of Title I of the Housing and Community <br />Development Act of 1974, and the implementing regulations at 24 CFR part 6, which <br />incorporates Section 504 of the Rehabilitation Act of 1973, and the implementing <br />regulations at 24 CFR part 8, Title II of the Americans with Disabilities Act, and the <br />implementing regulations at 28 CFR part 35, the Age Discrimination Act of 1975, and the <br />Amendment No. 2 to Interlocal Cooperation Agreement <br />Page 2 of 4 <br />
