20030213002124.002 <br /> EXH I BIT C <br /> raos <br /> City of Tulcvvila <br /> Washington <br /> Ordinance No. 44'4'7 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> TUKWILA,WASHINGTON,ESTABLISHING SEWER CONNECTION <br /> REQUIREMENTS FOR THE DUWAMISH AREA; DEFINING <br /> SERVICE AREA BOUNDARIES;PROVIDING FOR SEVERAPRITY; <br /> AND ESTABLISHING AN EFFECTIVE DATE. <br /> WHEREAS, a sewer plan identifying seven residential and two commercial <br /> areas has been prepared with a pnoribzed construction schedule;and <br /> WHEREAS,the City of Tukwila has gninted the Val Vue Sewer Distract the right <br /> to install and operate the sanitary sewer system for the Duwamish neighborhood;and <br /> WHEREAS, sewer lines meet Washington State Department of Ecology <br /> standards;and <br /> WHEREAS,a Sewer Connection Charge will be paid at the time of connecting or <br /> before final building permit approval to the Val Vue Sewer District for new facilities; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, <br /> WASHINGTON,HEREBY ORDAINS AS FOLLOWS. <br /> Section 1. Duwamiab Sewer Connection Charges. <br /> Duwaaush area homes—as spelled out by Section 2 of this ordinance,existing on <br /> November S0, 2002—will be required to connect to the sewer and pay the <br /> associated connection charges if any portion of any building is situated within <br /> 250 feet of a sanitary sewer lire or lateral,and if <br /> a) septic or health problems are identified by icing County Health Department <br /> that require repair of the septic tank system,or <br /> b) the home changes ownership,,or <br /> c) remodeling occurs,adding a bathroom or bedroom <br /> Section 2. Service Area Boundaries. The Duwamish service area is bordered <br /> by the Duwamrsh River on the north and the east,East Marginal Way South on the <br /> west;and Interurban Avenue South on the south,as shown on the map attached to this <br /> ordinance(Exhibit A). <br /> Section 4. Severability. If any section,subsection,paragraph,sentence,clause <br /> or phrase of this ordinance or its application to any person or situation should be held <br /> to be invalid or unconstitutional for any reason by a court of competent Jurisdiction, <br /> such invalidity or unconstitutionality shall not affect the validity or constitutionality of <br /> the remaining portions of this ordinance or its application to any other person or <br /> situation. <br /> Section S. Effective Date.
