City of Tukwila <br />Public Works Department - Bob Giberson, Director <br />INFORMATIONAL MEMORANDUM <br />TO: Transportation and Infrastructure Committe <br />FROM: Bob Giberson, Public Works Director. <br />BY: Peter Lau, Senior Program Manager <br />CC: Mayor Ekberg <br />DATE: September 22, 2017 <br />SUBJECT: Tukwila Urban Center Pedestrian/Bicycle Bridge Project <br />Project Number 90510403, Contract No. 16-092 <br />Supplemental Agreement No. 3 with AKANA <br />Allan Ekberg, Mayor <br />ISSUE <br />Authorize the Mayor to execute Supplemental Agreement No. 3 to Consultant Contract No, 16-092 with AKANA in the amount <br />of $214,689.00. <br />BACKGROUND <br />AKANA's Contract No. 16-092, with Supplemental Agreements 1 and 2, provide construction management (CM) services for <br />the Tukwila Urban Center (TUC) Pedestrian/Bicycle Bridge Project, including Lidar scanning of the fabricated steel arch <br />bridge, recommendation of bridge structural acceptance, and material inspection and testing services at less cost than <br />WSDOT's Material Laboratory. <br />DISCUSSION <br />The TUC Pedestrian/Bicycle Bridge Project has been delayed from physical completion mainly due to the steel bridge <br />fabrication dispute between the construction contractor and its material fabricator. The construction contract expired on August <br />8, 2017, while the current estimated physical completion date is now November 22, 2017. The remaining funds from the <br />consultant contract with AKANA is also running out due to the delay. In order to have continuous CM support from AKANA <br />through the end of the construction project, Supplemental Agreement No. 3 is needed for their continuous construction <br />engineering, inspection and material testing services. At the same time, the City has put the construction contractor on notice <br />of $198,490,12 fora liquidated damage (LD) assessment. <br />FISCAL IMPACT <br />The 15% construction contingency was $942,835.59 and will cover AKANA's Supplemental Agreement No. 3.
