replaced. Trees determined to be Defective by the City or a Qualified Tree Professional, <br />are not required to be replaced. <br />3. The property owner is required to ensure the viability and long-term health <br />of trees planted for replacement through proper care and maintenance for the life of the <br />site's improvement. Replaced trees that do not survive must be replanted in the next <br />appropriate season for planting. <br />4. If all required replacement trees cannot be accommodated reasonably on <br />the site, the applicant shall pay into the Tree Fund. The fee shall be based on the value <br />of the replacement trees and their delivery, labor for site preparation and plant installation, <br />soil amendment, mulch, and maintenance costs for three years. Tree replacement shall also meet the standards in TIVIC Section 18.54.160. <br />Section 10. Ordinance No. 1758 §1 (part), as codified at TIVIC Section 18.54.090, is <br />hereby amended to read as follows: <br />18.54.090 Tree Relocation <br />Tree relocation shall be carried out according to Best Management Practices, and <br />trees proposed for relocation shall have a reasonable chance of survival. <br />Section 11. Ordinance No. 1758 § 1 (part), as codified at TIVIC Section 18.54.100, is <br />hereby amended to read as follows: <br />18.64.100 Tree Fund <br />A. When trees are topped or removed without a permit, or if the number of <br />replacement trees required by Table B cannot be accommodated on -site, the Director <br />shall require payment into the Tree Fund.
