SECOND AMENDMENT TO CONTRACT 18-001 <br />AIA DOCUMENT A133-2009 STANDARD FORM OF AGREEMENT BETWEEN <br />OWNER AND CONSTRUCTION MANAGER FOR <br />TUKWILA FIRE STATIONS 51, 52, AND 54 <br />, This Second Amendment (the "Second Amendment"), effective as of , 2018 (the <br />"Effective Date"), is entered into by and between CITY OF TUKWILA ("Owner"), and <br />LYDIG CONSTRUCTION ("Contractor"). This Second Amendment is an addition to and <br />modifies the AIA Document A133-2009 Standard Form of Agreement Between Owner and <br />Construction Manager for the Tukwila Fire Stations 51, 52, and 53, dated August 7, 2018, and <br />the AIA Document A201-2007 General Conditions of the Contract for Construction <br />(collectively, the "Agreement"). This Second Amendment incorporates the contractual <br />obligations outlined in the Agreement and prior amendment, and modifies them as stated below. <br />Unless defined differently herein, all capitalized terms in this Second Amendment have the same <br />meaning as in the Agreement. Now for and in consideration of the mutual promises contained <br />herein and other good and valuable consideration, the receipt of which is hereby acknowledged, <br />the parties agree as follows: <br />1. Addition of Fire Station 54 Demolition to the Project. The Project, as defined in AIA <br />Document A133 and in Section 1.1.4 of AIA Document A201, is revised to include the <br />demolition and removal of all existing structures on the Fire Station 54 site, including the <br />foundations of those structures. For the sake of clarity, this Second Amendment adds the <br />demolition and removal of Fire Station 54 structures to the Project notwithstanding the prior First <br />Amendment's removal of all Work related to Fire Station 54. This Second Amendment <br />supersedes Section 1 of the First Amendment, but only to the extent of the Work related to <br />demolition and removal of the existing structures on the Fire Station 54 site. <br />2. Cost for Fire Station 54 Demolition. Contractor's costs related to the demolition and <br />removal work described in the preceding paragraph shall not exceed Sixty -Seven Thousand Nine <br />Hundred Ninety -Eight Dollars ($67,998), plus WSST. This amount is included in the <br />Preconstruction Services Amount as stated in Section 2.1.4.1 of the AIA Document A133, which <br />the parties confirm remains Three Hundred Seventy -Two Thousand Dollars ($372,000) and is <br />not changed by the Second Amendment. <br />3.
