INFORMATIONAL MEMO <br />Page 2 <br />Complaint Process Section E <br />Q: At which point in the complaint process should the entire City Council receive a copy of the <br />complaint and/or associated reports? <br />A: One Councilmember suggested that the full Council receive a copy of the Ethics Officer's <br />initial determination of sufficiency or insufficiency. This would mean all Councilmembers would <br />receive notice of all ethics complaints against any individual Councilmember. Another <br />Councilmember suggested that the full Council be notified only after a determination of <br />sufficiency is made and an investigation is moving forward. This means that complaints against <br />an individual Councilmember that are deemed insufficient by the Ethics Officer would not be <br />shared with all Councilmembers. This is a matter of Council preference. Staff is seeking Council <br />direction on which process is preferred. <br />RECOMMENDATION <br />Staff is seeking discussion and feedback on the proposed amendments to TMC 2.97, with possible <br />consensus to forward to the December 3, 2108 Regular Meeting for action. <br />ATTACHMENTS <br />Draft Ordinance <br />48 <br />
