P6433610240age 3 of 5 <br />January 24, 2019 <br />BAR Minutes <br />CASE NUMBERS: <br />APPLICANT: <br />REQUEST: <br />LOCATION: <br />L18-0112 Variance <br />L18-0065 Design Review Major Modification <br />L08-079 Preliminary Subdivision Plat <br />Mike Overbeck <br />(1) Variance from side and rear yard setbacks, landscaping standards; and <br />design review for construction of a third story on the building located at <br />14424 34th Ave S., and (2) Design Review Major Modification and <br />Preliminary Subdivision Plat approval for phase 2 of the Osterly Park <br />Townhomes. The 14424 34th Ave S. building will share recreation spaces <br />and parking spaces within the Osterly Park Townhomes. Phase 2 of the <br />Osterly Park Townhomes includes construction of 15 townhomes, guest <br />parking, access, recreation space, and landscaping; <br />14426 34th Ave S.; 14424 34th Ave S.; and 14401-14420 34th Lane S.; <br />(Tax parcel numbers: 6433600090, 0040000083,6433600110, 6391110000) 6433610240 <br />Jaimie Reavis, Senior Planner, for DCD, gave the presentation. The preliminary subdivision plat and <br />the design review applications were heard by the BAR on October 11, 2018. The October 11, 2018 <br />hearing was continued because the BAR requested additional clarification and information be <br />submitted. On December 13, 2018 the hearing was, closed because the applicant added a variance <br />application for approval for Lot 24 building. Information was given on the status of the construction <br />and the phases of the project. <br />Staff asked the BAR the appearance of fairness questions. Commissioners Hansen, Strander and Stark <br />each disclosed they had exparte communication with the DCD staff about the project. No one <br />objected to the Commissioners hearing the project. <br />Staff provided background on the October 11, 2018 hearing. Staff said the applicant provided all <br />items requested by the BAR and have also formed a Home Owners Association (HOA), which was <br />formed with the owners of the Phase 1 property. <br />An overview was given of the project for the variance, preliminary subdivision plat, and design <br />review major modification. <br />VARIANCE: <br />The applicant requested a variance for setbacks and landscaping for the existing building located at <br />14424 34th Ave S. (Lot 24 of the proposed preliminary subdivision plat), which does not meet setback <br />requirements along the west and north property lines. Also, it was noted that there is not enough space <br />for required perimeter landscaping. Lot 24 will become part of the Osterly plat and will share <br />landscaping. Staff recommended approval with three conditions as listed in the January 14, 2019 staff <br />report. <br />DESIGN REVIEW MAJOR MODIFICATION: <br />An overview was given on the site plan, pedestrian and vehicular circulation, parking, and <br />landscaping and building design. The applicant requested landscaping modifications to allow a <br />perimeter sidewalk and to cluster required trees and shrubs. Staff recommended approval of the major <br />modification to the design of the Osterly Park Townhomes with six conditions as listed in the January <br />14, 2019 staff report. <br />Staff answered questions for the Commissioners. <br />5 <br />
