ATTACHMENT B <br />FEDERAL TRANSIT ADMINISTRATION (FTA) THIRD PARTY CONTRACT <br />REQUIREMENTS <br />This Contract shall be partially funded by the Federal Transit Administration (FTA). The <br />following provisions include, in part, certain standard terms and conditions required by the U.S. <br />Department of Transportation. All Contractual provisions required by the U.S. Department of <br />Transportation, as set forth in FTA Circular 4220.1F, as revised, dated March 18, 2013, as are <br />the requirements of the Master Agreement between King County ("the County") and the U.S. <br />Department of Transportation, including all "flow down" provisions to third party Contractors <br />and Subcontractors are hereby incorporated by reference. Unless stated otherwise, all FTA <br />mandated terms shall be deemed to control in the event of a conflict with other provisions <br />contained in this Contract. The Contractor agrees not to perform any act, fail to perform any act, <br />or refuse to comply with any County requests that would cause the County to be in violation of <br />the FTA terms and conditions. <br />1-1 Disadvantaged Business Enterprise (DBE) Participation <br />A. Nondiscrimination 49 CFR part 26. The Contractor shall not discriminate on the <br />basis of race, color, national origin, or sex in the performance of this Contract. The <br />Contractor shall carry out applicable requirements of 49 CFR part 26 in the award <br />and administration of United States Department of Transportation assisted <br />contracts. Failure by the Contractor to carry out these requirements is a material <br />breach of this Contract, which may result in the termination of this Contract or such <br />other remedy, as the County deems appropriate. Each subcontract the contractor <br />signs with a subcontractor must include the assurance in this paragraph (see 49 CFR <br />26.13(b)). <br />B. DBE Program. The DBE requirements of 49 CFR Part 26 apply to this Contract. <br />King County has determined that no DBE goal will be established for this Contract. <br />However, the County requires that the Contractor report any actual DBE <br />participation on this Contract to enable the County to accurately monitor DBE <br />program compliance. <br />C. Efforts to Increase DBE Participation. Even though this Contract has no DBE goal, <br />the County still encourages Contractors to pursue opportunities for DBE <br />participation. To that end, Contractors are encouraged to: <br />Advertise opportunities for subcontractors and suppliers ("subcontractors") <br />in a manner reasonably designed to provide DBEs capable of performing <br />the work with timely notice of such opportunities. All advertisements <br />should include a provision encouraging participation by DBE firms and may <br />be done through general advertisements (e.g., newspapers, journals, etc.) or <br />by soliciting proposals directly from DBEs. <br />`rj <br />
