(2) Sex - In accordance with Title IX of the Education Amendments of 1972, as <br />amended, 20 U.S.C. Sections 1681 et seq. and implementing Federal regulations, <br />"Nondiscrimination on the Basis of Sex in Education Programs or Activities <br />Receiving Federal Financial Assistance," 49 CFR Part 25, and FTA Circular <br />4220.117 Chapter IV, Section 2(a)(5)(b), the Contractor agrees to refrain from <br />discrimination against present and prospective employees on the basis of their sex. <br />In addition, the Contractor agrees to comply with any implementing requirements <br />FTA may issue. <br />(3) Age - In accordance with The "Age Discrimination Act of 1974, as amended, <br />42 U.S.C. Sections 6101 et seq., and Department of Health and Human Services <br />implementing regulations, "Nondiscrimination on the Basis of Age in Programs or <br />Activities Receiving Federal Financial Assistance, 45 CFR Part 90, and section 4 <br />of the Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. §§ <br />623 and Federal transit law at 49 U.S.C. § 5332, the Contractor agrees to refrain <br />from discrimination against present and prospective employees for reason of age. <br />In addition, the Contractor agrees to comply with any implementing requirements <br />FTA may issue. <br />(4) Disabilities - In accordance with section 102 of the Americans with Disabilities <br />Act, as amended, 42 U.S.C. § 12101 et seq., the Contractor agrees that it will <br />comply with the requirements of U.S. Equal Employment Opportunity <br />Commission, "Regulations to Implement the Equal Employment Provisions of the <br />Americans with Disabilities Act," 29 C.F.R. Part 1630, pertaining to employment <br />of persons with disabilities. In addition, the Contractor agrees to comply with any <br />implementing requirements FTA may issue.' <br />(C) Information and Reports - The Contractor shall provide all information and reports <br />required by the regulations or directives issued pursuant thereto and shall permit access to <br />its books, records, accounts, other sources of information, and its facilities as may be <br />determined by the County or the Federal Transit Administration (FTA) to be pertinent to <br />ascertain compliance with such regulations, orders and instructions. The Contractor shall <br />maintain all required records for at least three (3) years after the County makes final <br />payment and all other pending matters are closed. Where any information is required and <br />it is in the exclusive possession of another who fails or refuses to furnish this information, <br />the Contractor shall so certify to the County or the Federal Transit Administration, as <br />appropriate, and shall set forth efforts made to obtain the information. <br />`A <br />
