10. Incorporate the use of best available science in the regulation and protection <br />of critical areas as required by the State Growth Management Act, according to WAC <br />365-195-900 through 365-195-925 and WAC 365-190-080. <br />Section 22. TMC Section 18.45.020 is hereby reenacted to read as follows: <br />18.45.020 Best Available Science <br />A. Policies, regulations and decisions concerning critical areas shall rely on best <br />available science to protect the functions of these areas and must give special <br />consideration to conservation or protection measures necessary to preserve or enhance <br />anadromous fish and their habitats. <br />B. Nonscientific information may supplement scientific information, but is not an <br />adequate substitution for valid and available scientific information. <br />C. Incomplete or unavailable scientific information leading to uncertainty for <br />permitting critical area impacts may require application of effective adaptive <br />management on a case by case basis. Adaptive management relies on scientific <br />methods to evaluate how well regulatory or non -regulatory actions protect critical areas <br />or replace their functions. <br />Section 23. TMC Section 18.45.030 is hereby reenacted to read as follows: <br />18.45.030 Critical Area Applicability, Maps, and Inventories <br />A. APPLICABILITY. The provisions of TMC Chapter 18.45 shall apply to all land <br />uses and all development activities in a critical area or a critical area buffer as defined in <br />the "Definitions" chapter of this title. The provisions of TMC Chapter 18.45 apply whether <br />or not a permit or authorization is required within the City of Tukwila. No person, company, <br />agency, or applicant shall alter a critical area or buffer except as consistent with the <br />purposes and requirements of TMC Chapter 18.45. The following are critical areas <br />regulated by TMC Chapter 18.45: <br />Coal Mine Hazard Areas; <br />2. Areas of potential geologic instability: Class 2, 3, 4 areas (as defined in the <br />Definitions chapter of this title and TMC Section 18.45.120.A); <br />3. Wetlands; <br />4. Watercourses; <br />5. Fish and Wildlife Habitat Conservation Areas; and <br />6.
