5. Where off -site mitigation location is proposed it shall comply with the <br />following criteria: <br />a. Mitigation sites located within the Tukwila City limits are preferred. <br />b. Mitigation bank or in -lieu fee option is not feasible. <br />c. The proposed mitigation will not alter or increase buffers on adjacent <br />properties without their permission. <br />6. The Director may approve permittee-responsible offsite mitigation sites <br />outside the city upon finding that: <br />a. Adequate measures have been taken to ensure the non -development <br />and long-term viability of the mitigation site; and <br />b. Adequate coordination with the other affected local jurisdiction has <br />occurred. <br />c. The applicant has selected a site in a location where the targeted <br />functions can reasonably be performed and sustained and has pursued sites in the <br />following order of preference: <br />(1) Sites within the immediate drainage sub -basin; <br />(2) Sites within the next higher drainage sub -basin; and <br />(3) Sites within Green/Duwamish River basin. <br />7. Wetland creation for restoration projects may only be approved if the <br />applicant can show: (1) that the adjoining property owners are amenable to having <br />wetland buffers extend onto or across their property; or (2) that the on -site wetland buffers <br />are sufficient to protect the functions and values of the wetland and the project as a whole <br />results in net environmental benefit. <br />E. MITIGATION TIMING. Mitigation projects shall be completed prior to activities <br />that will permanently disturb wetlands and either prior to or immediately after activities <br />that will temporarily disturb wetlands. Construction of mitigation projects shall be timed <br />to reduce impacts to existing wildlife, flora and water quality, and shall be completed prior <br />to use or occupancy of the activity or development. The Director may allow activities that <br />permanently disturb wetlands prior to implementation of the mitigation plan under the <br />following circumstances: <br />1. To allow planting or re -vegetation to occur during optimal weather <br />conditions; <br />2. To avoid disturbance during critical wildlife periods; or <br />3.
