(8) Documentation is provided to demonstrate that the fill comes from <br />a clean source. <br />b. Clearing, grading and landfill activities, where allowed, shall include <br />erosion control mechanisms, and any reasonable restriction on equipment, methods or <br />timing necessary to minimize the introduction of suspended solids or leaching of <br />contaminants into the river, or the disturbance of wildlife or fish habitats in accordance <br />with the standards in TMC Chapter 16.54, "Grading." <br />2. Dredging. <br />a. Dredging activities must comply with all federal and state regulations. <br />Maintenance dredging of established navigation channels and basins must be restricted <br />to maintaining previously dredged and/or existing authorized location, depth, and width. <br />b. Where allowed, dredging operations must be designed and scheduled <br />so as to ensure no net loss to shoreline ecological functions or processes. In cases where <br />impacts to shoreline ecological functions from allowed dredging are unavoidable, those <br />impacts shall be mitigated according to the provisions of TMC Section 18.44.050.H <br />above; in that event, the "no net loss" standard is met. <br />K. Marinas, Boat Yards, Dry Docks, Boat Launches, Piers, Docks and Other <br />Over -water Structures. <br />General Requirements. <br />a. A dock may be allowed when the applicant has demonstrated a need for <br />moorage to the satisfaction of the Director of Community Development and that the <br />following alternatives have been investigated and are not available or feasible: <br />(1) commercial or marina moorage; <br />(2) floating moorage buoys; <br />(3) joint use moorage pier/dock. <br />The Director shall use the following criteria to determine if the applicant <br />has demonstrated a need for moorage: <br />(a) Applicant has provided adequate documentation from a <br />commercial marina within 5 river miles that moorage is not available. <br />(b) Floating moorage buoy is technically infeasible as determined <br />by a professional hydrologist. <br />(c) Applicant has provided adequate documentation from any <br />existing moorage pier/dock owner within 5 river miles that joint use is not possible. <br />b. Prior to issuance of a Shoreline Substantial Development Permit for <br />construction of piers, docks, wharves or other over -water structures, the applicant shall <br />present proof of application submittal to State or Federal agencies, as applicable. <br />W: Legislative Development\SMP-Zoning Code changes 2-25-20 <br />MD:bjs Review and analysis by Barbara Saxton Page 26 of 64 <br />
