6.1.1.1.1. The Parties agree that the Engineering Estimate for construction of the <br />WORK in the estimated amount will be adjusted based on the lowest <br />responsible responsive Bid Proposal. <br />6.1.1.2. TUKWILA will provide SEATAC with payments forty-five (45) days <br />following executed monthly pay estimates — Payment equal to schedule of work <br />completed within TUKWILA's ROW. <br />6.1.1.3. If a change order is required to complete the WORK, any additional costs <br />shall be borne by TUKWILA. <br />6.2. In the event Tukwila initiates a Change Order to expand the scope of work during <br />construction through SEATAC contract administration, TUKWILA shall fully reimburse <br />SEATAC for the change based on the payment made to the Contractor. <br />7. CLAIMS FOR ADDITIONAL PAYMENT BY CONTRACTOR <br />7.1. In the event SEATAC's contractor files any claims for additional payment associated with <br />the WORK, TUKWILA shall not be obligated to pay such claims or their cost of defense <br />due to SEATAC solely administering the Construction Contract. <br />7.2. Disputes and Claims shall conform to WSDOT Standard Specification 1.09.11. Any <br />settlement to be reviewed and agreed upon by both SEATAC and TUKWILA. <br />8. RIGHT OF ENTRY <br />8.1. SEATAC hereby grants to TUKWILA, its employees, authorized agents, contractors, and <br />subcontractors, a right of entry upon all SEATAC owned property necessary for <br />TUKWILA's design review and construction inspection of the WORK. <br />8.2. TUKWILA hereby grants to SEATAC and its authorized agents, contractors, <br />subcontractors, and employees, a right of entry upon all public right-of-way in which <br />SEATAC has an interest for the purpose of performing the WORK. <br />9. TERM <br />9.1. This Agreement is effective as of , 2021 and will terminate upon <br />TUKWILA's acceptance of the WORK or the expiration of any contractor warranties of <br />the WORK, whichever is later.
