001 <br />City of Tukwila <br />Allan Ekberg, Mayor <br />INFORMATIONAL MEMORANDUM <br />TO: Community Services and Safety Committee <br />FROM: Chief of Police Eric Dreyer <br />CC: Mayor Allan Ekberg <br />DATE: July 18th, 2023 <br />SUBJECT: Amendment to contract with NOVOAGLOBAL, Inc. regarding automated <br />traffic cameras <br />ISSUE <br />The Police Department is seeking Council approval to authorize the Mayor to sign an amended <br />contract with NOVOAGLOBAL, Inc. to allow for the inclusion of additional automated traffic <br />cameras. <br />BACKGROUND <br />At the December 121h, 2022, Council of the Whole meeting, the Council authorized the addition <br />of automatic traffic safety cameras in public park speed zones. At that time, we understood the <br />contract with NOVOAGLOBAL to be inclusive of being able to add automated cameras without <br />modifying the contract. However, the contract was specific to school zone cameras. Therefore, <br />an amendment to the existing contract and authorization for the mayor to sign the amended <br />contract is required. <br />DISCUSSION <br />The contract amendments include changing the following specific language: <br />• "WHEREAS, the city desires to use Systems to monitor and enforce school zone speed <br />violations in accordance with applicable laws and ordinances" to "WHEREAS, the city <br />desires to use the Systems to monitor and enforce violations in accordance with <br />applicable laws and ordinances." <br />• Updating the term of the agreement to five years from signing with two subsequent auto <br />renewals. (refer to the agreement attached.) <br />• Clarifying language in Exhibit D of the initial agreement: "Pricing for NG Safety Systems <br />relating to fixed speed photo enforcement shall be as follows:" to "Pricing for NG Safety <br />Systems relating to photo enforcement shall be as follows:" (This does not change the <br />pricing.) <br />FINANCIAL IMPACT <br />The Mayor signing the amendment does not create a financial impact different than the cost to <br />run the program and the revenue generated that is already in place, with the exception that the <br />term of the agreement will continue the program beyond the original pilot program. The City <br />has the option at any time to provide a 30 -day notice to NOVOAGLOBAL to discontinue the <br />agreement. <br />RECOMMENDATION <br />Request that the Committee authorize the Mayor to sign the amendment to the agreement with <br />NOVOAGLOBAL, and forward to the Committee of the Whole on August 14th, and then to the <br />Regular Council meeting on August 21St, 2023. <br />{EEM2727195.DOCX;2/13175.000001/ <br />
