Section 11.4. Stop Work Order. On notice from the City that any work is being <br />performed contrary to the provisions of this Franchise, or in an unsafe or dangerous <br />manner as determined by the City, or in violation of the terms of any applicable permit, <br />laws, regulations, ordinances, or standards, the work may immediately be stopped by the <br />City. The stop work order shall: <br />(a) Be in writing; <br />(b) Be given to the person doing the work or posted on the work site; <br />(c) Be sent to Franchisee by overnight delivery; <br />(d) Indicate the nature of the alleged violation or unsafe condition; and <br />(e) Establish conditions, consistent with the applicable laws, regulations, <br />ordinances or generally applicable standards under which work may be resumed. <br />Section 12. Work of Contractors and Subcontractors. <br />Section 12.1. Franchisee's contractors and subcontractors shall be licensed and <br />bonded in accordance with State law and the City's ordinances, regulations, and <br />requirements. Work by contractors and subcontractors are subject to the same <br />restrictions, limitations, and conditions as if the work were performed by Franchisee. <br />Franchisee shall be responsible for all work performed by its contractors and <br />subcontractors and others performing work on its behalf as if the work were performed by <br />Franchisee and shall ensure that all such work is performed in compliance with this <br />Franchise and applicable law. <br />Section 13. Maps and Records. <br />Section 13.1. The Franchisee agrees and covenants that it shall, within 10 days of <br />substantial completion of any construction project involving a Public Right -of -Way, <br />provide to the City, at no cost to the City, accurate copies of as -built plans and maps <br />stamped and signed by a professional land surveyor or engineer in a form and content <br />acceptable to the Public Works Director or designee. <br />Section 13.2. Within thirty (30) days of a written request from the Public Works <br />Director, the Franchisee shall furnish the City with information sufficient to demonstrate: <br />Page 18 of 45 <br />{E F M 4895-9658-9257;1/13175.000042/} <br />22 <br />
