(i) Commercial General Liability insurance shall be at least as <br />broad as ISO occurrence form CG 00 01 and shall cover liability arising from premises, <br />operations, stop gap liability, independent contractors, products -completed operations, <br />personal injury and advertising injury, and contractual liability arising out of "insured <br />contract" as defined in the ISO CG 00 01. There shall be no exclusion for liability arising <br />from explosion, collapse or underground property damage. The City shall be named as <br />an additional insured under Franchisee's Commercial General Liability insurance policy <br />with respect this Franchise using ISO endorsement CG 20 12 05 09 or CG 20 26 07 <br />04, or substitute endorsement providing at least as broad coverage. <br />(ii) Business Automobile Liability insurance covering all owned, <br />non -owned, hired and leased vehicles. Coverage shall be at least as broad as <br />Insurance Services Office (ISO) form CA 00 01. <br />(iii) Contractors Pollution Liability insurance shall be in effect <br />throughout the entire Franchise covering losses caused by pollution conditions that <br />arise from the operations of Franchisee. Contractors Pollution Liability shall cover bodily <br />injury, property damage, cleanup costs and defense, including costs and expenses <br />incurred in the investigation, defense, or settlement of claims. <br />(iv) Workers' Compensation coverage as required by the <br />Industrial Insurance laws of the State of Washington. <br />(v) Excess or Umbrella Liability insurance shall be excess over <br />Franchisee's Commercial General Liability and Automobile Liability insurance. The City <br />shall be named as an additional insured on the Contractor's Excess or Umbrella Liability <br />insurance policy. <br />(c) Minimum Amounts of Insurance. Franchisee shall maintain the <br />following insurance limits: <br />(i) Commercial General Liability insurance shall be written with <br />limits no less than $5,000,000 each occurrence, $5,000,000 general aggregate. <br />(ii) Business Automobile Liability insurance with a minimum <br />combined single limit for bodily injury and property damage of $5,000,000 per accident. <br />Page 27 of 45 <br />{E F M 4895-9658-9257;1/13175.000042/} <br />31 <br />
