Section 22.5. The provisions of this Section 22 shall survive the expiration, <br />revocation, abandonment, or termination of this Franchise and for so long as Franchisee <br />has Facilities in Rights -of -Way. <br />Section 23. Forfeiture and Revocation. <br />Section 23.1. If Franchisee willfully violates or fails to comply with any of the <br />provisions of this Franchise, or through willful misconduct or gross negligence fails to <br />heed or comply with any notice given Franchisee by the City under the provisions of this <br />Franchise, then Franchisee shall, at the election of the Tukwila City Council, forfeit all <br />rights conferred hereunder and this Franchise may be revoked or annulled by the Council <br />after a hearing held upon notice to Franchisee. <br />Section 23.2. Such hearing shall be open to the public and Franchisee and other <br />interested parties may offer written and/or oral evidence explaining or mitigating such <br />alleged noncompliance. This hearing does not give the right to either the City or <br />Franchisee to conduct discovery, subpoena witnesses, or take depositions. Within thirty <br />(30) days after the hearing, the Tukwila City Council, on the basis of the record and TMC <br />11.32.120(2), will make the determination as to whether there is cause for revocation, <br />whether the Franchise will be terminated, or whether lesser sanctions should otherwise <br />be imposed. The Tukwila City Council may in its sole discretion fix an additional time <br />period to cure violations. If the deficiency has not been cured at the expiration of any <br />additional time period or if the Tukwila City Council does not grant any additional period, <br />the Tukwila City Council may by resolution declare the Franchise to be revoked and <br />forfeited or impose lesser sanctions. If Franchisee appeals revocation and termination, <br />such revocation may be held in abeyance pending judicial review by a court of competent <br />jurisdiction, provided Franchisee is otherwise in compliance with the Franchise. <br />Section 24. Remedies to Enforce Compliance. <br />Section 24.1. The City may elect, without any prejudice to any of its other legal <br />rights and remedies, to obtain an order from the superior court having jurisdiction <br />compelling Franchisee to comply with the provisions of the Franchise and to recover <br />damages and costs incurred by the City by reason of Franchisee's failure to comply.
