g. impose, alter, regulate, control and collect rates, charges, and assessments; <br />h. purchase and sell water and services within and outside the geographical boundaries of its <br />Members; <br />i. borrow money (through its Members or other entities at their individual discretion or as <br />authorized by the Act and this Agreement now or as hereafter amended), or enter into other <br />financing arrangements; <br />lend money or provide services or facilities to any Member, other governmental water utilities, or <br />governmental service providers; <br />J• <br />k. invest its funds; <br />1. establish policies, guidelines, rules or regulations by either ByLaws or resolution to carry out its <br />powers and responsibilities; <br />m. purchase insurance, including participation in pooled insurance and self - insurance programs, and <br />indemnify its Members, its Board of Directors and Alternate Board Members, officers and <br />employees in accordance with law; <br />n. exercise all other powers within the authority of and that may be exercised individually by all of <br />its Members with respect to water supply, conservation, reuse, treatment and transmission, or any <br />of the other purposes set forth in Section 3.3; <br />o. exercise, without limitation, all other corporate powers that Cascade may exercise under the law <br />relating to its formation and that are not inconsistent with this Agreement or the Act or other <br />applicable law; <br />p. for the purposes of contracting and public works, exercise all powers of a code city (population <br />over 20,000) under RCW 35A.40.200 - 35A.40.210, now or as hereafter amended; <br />for disposal of surplus property, exercise all powers granted under RCW 35A.11.010, now or as <br />hereafter amended, to code cities; <br />r. in the event Cascade charges connection charges or Rates and Charges for services supplied or <br />available to its customers' property on a retail basis, exercise all powers granted under RCW <br />57.08.081, now or as hereafter amended, for the establishment of liens; and <br />s. for purposes of a Cascade code of ethics, exercise all powers of a municipal corporation and <br />observe the requirements under Chapter 42.23 RCW, now or as hereafter amended. <br />q. <br />ARTICLE 4. Organization Structure; Board. <br />Section 4.1 Composition, ByLaws and Meetings. Cascade is governed by a Board of <br />Directors consisting of one individual representative appointed by Resolution by each of the Member's <br />legislative authority. Members may similarly appoint Alternate Board Members.
