8.6.b Nothing in this Agreement is intended to create new Environmental <br />Liability nor release any third -party from Environmental Liability. Rather, the intent is to protect <br />the general funds of the Parties to this Agreement by ensuring that, consistent with best business <br />practices, an adequate portion of Disposal Rates being collected from the System Users are set <br />aside and accessible in a fair and equitable manner to pay the respective County and City's <br />Environmental Liabilities. <br />8.6.c The purpose of this Subsection is to establish a protocol for the setting <br />aside, and subsequent distribution of, Disposal Rates intended to pay for Environmental <br />Liabilities of the Parties, if and when such liabilities should arise, in order to safeguard the <br />Parties' general funds. To do so, the County shall: <br />8.6.c.i Use Disposal Rates to obtain and maintain, to the extent <br />commercially available under reasonable terms, insurance coverage for System - related <br />Environmental Liability that names the City as an Additional Insured. The County shall establish <br />the adequacy, amount and availability of such insurance in consultation with MSWAC. Any <br />insurance policy in effect on the termination date of this Agreement with a term that extends past <br />the termination date shall be maintained until the end of the policy term. <br />8.6.c.ii Use Disposal Rates to establish and maintain a reserve fund to <br />help pay the Parties' Environmental Liabilities not already covered by System rates or insurance <br />maintained under Subsection 8.6.c.i above ( "Environmental Reserve Fund "). The County shall <br />establish the adequacy of the Environmental Reserve Fund in consultation with MSWAC and <br />consistent with the financial policies described in Article VI. The County shall retain the <br />Environmental Reserve Fund for a minimum of 30 years following the closure of the Cedar Hills <br />Landfill (the "Retention Period ").
