City of Tukwila Jim Haggerton, Mayor INFORMATIONAL MEMORANDUM TO: Tukwila City Council FROM: Shelley Kerslake, City Attorney BY: Christy O'Flaherty, City Clerk DATE: April 14, 2014 SUBJECT: Amendment to Tukwila Municipal Code 2.08 regarding signing authority ISSUE The Tukwila Municipal Code should be amended to include language authorizing the City Administrator to sign documents in the absence of the Mayor. DISCUSSION RCW 35A.12.100 designates the duties and authority of the Mayor, which includes signing official City documents. In the absence of the Mayor, the City Administrator should be authorized to sign documents to ensure the continuity of City business. While the City has an Administrative Policy authorizing the City Administrator to sign documents in the Mayor's absence, a provision in the code is also advised. RECOMMENDATION The Council is being asked to consider this item on the Consent Agenda of the April 7, 2014 Regular Meeting. ATTACHMENTS -Draft Ordinance -Tukwila Municipal Code 2.08 H:\windataHlSigningAuthorityMemo.doc 1 2 AFT AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 2016, AS CODIFIED IN TUKWILA MUNICIPAL CODE CHAPTER 2.08, TO AUTHORIZE THE CITY ADMINISTRATOR TO SIGN CITY DOCUMENTS IN THE MAYOR'S ABSENCE; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Mayor is the Chief Executive and Administrative Officer of the City with the authority to designate assistants and department heads; and WHEREAS, to ensure the continuity of City business, the City Administrator should be authorized to sign official City documents in the Mayor's absence; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. TMC Chapter 2.08 Amended. Ordinance No. 2016, as codified in Tukwila Municipal Code Chapter 2.08, "Mayor," is hereby amended to add a new Section 2.08.040 as follows: 2.08.040 Authority. Pursuant to RCW 35A.12.100, the Mayor is the Chief Executive and Administrative Officer of the City. As such, the Mayor is responsible for signing official documents of the City. In the absence of the Mayor, the City Administrator is authorized to sign official City documents on behalf of the Mayor to ensure the continuity of City business. Section 2. Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules, or regulations; or ordinance numbering and section /subsection numbering. Section 4. Effective Date. (Ord. 2016 §1, 2003) 2.08.020 Salary Beginning January 1, 2003, the salary for the Tukwila Mayor shall be set at $78,000 per year. Beginning January 1, 2004, that salary will be increased to $80,000 per year. Beginning January 1, 2005, the salary will be adjusted annually at the same rate of inflation as determined by the current method prescribed for the non - represented employees. (Ord. 2016 §2 2003) 2.08.030 Benefits Subject to any applicable restrictions, the Mayor shall be eligible to receive the same or an equivalent benefit package as is given to department heads in the City of Tukwila and established from time to time by resolution. (Ord. 2016 §3, 2003) CHAPTER 2.12 DIRECTOR OF PUBLIC WORKS Sections: 2.12.010 Office Created 2.12.020 Duties 2.12.030 Compensation 2.12.010 Office Created There is created the office of Director of Public Works in and for the City, which office shall be filled by appointment of the Mayor subject to confirmation of the Council. (Ord 707 (part), 1972; Ord. 562 §1, 1969) 2.12.020 Duties Subject to the direction of the Mayor, the Director of Public Works shall perform the following duties: 1. He shall have charge of construction, mainten- ance, repair and cleaning of the streets, sidewalks, gutters, sewers and drains, and such other related activities. 2. He shall exercise general supervision over the municipal water and sewer systems. (Ord. 1494 §1, 1988; Ord, 707 (part), 1972; Ord. 562 §3, 1969) 2.12.030 Compensation The Director of Public Works shall receive such salary and in such amounts as the Council may, from time to time, establish by ordinance and as fixed by the City's annual budget. BACKGROUND The petty cash needs at Minkler Shops, George Long Shops, and the Community Center are different now than they were prior to the implementation of the P-card system for most of the City's purchasing. City Departments are working with Finance at this time to review spending limits for potential modification as well. The petty cash fund limits which have remained the same for years should also reflect the changes that fit departmental needs. DISCUSSION The preferred changes have been analyzed at the staff level as follows: • Parks & Rec Change Fund — Increase from $150.00 to $350.00 • Parks & Rec Petty Cash Fund — Decrease from $500.00 to $300.00 • PW Minkler Operations Petty Cash — Increase from $200.00 to $350.00 • PW George Long Shops Petty Cash — Eliminate the petty cash fund.. RECOMMENDATION The Committee is being asked to consider this item and forward the resolution to the May 5, 2014 Regular Meeting Consent Agenda. BACKGROUND As identified in the City of Strategic P|@n, providing programming out of TCC, and into the community is a priority. Over the years, Tukwila Parks & Recreation staff has made a great effort to move our City sponsored special events out into the community. The purchase of a special events equipment trailer is a cost-effective way to address the needs associated with the delivery of city-sponsored special events in the community. Having this resource will help us to streamline the process by packaging commonly used items into a portable equipment tnai|er, such as tables, ohaira, tenta, a-boards and oignage, safety supplies, concession supplies and general event supplies. It provides a pool of resources, eliminates duplication, addresses storage issues and reduces staff time by eliminating many of the obstacles associated with implementing events in the community. SERVICE IMPACT The program would provide for a trailer equipped with equipment and supplies commonly utilized for city-sponsored community events. This resource will primarily be used by Tukwila Parks and F<enneation, but could also be utilized by other City department for ribbon cutting and dedication events, or other city-sponsored events. FINANCIAL IMPACT This p ject was not included in the 2013-2014 Budget. As an alternative, we propose reallocating existing funds from the 2014 Volunteer & Special Events program budget for the purchase of the trailer. The estimated cost is $8.580 (actual cost for the volunteer trailer in 2013 was $7.800 + 1096 for any increase in costs). Adjustments would come from the following GL account line items: $4.000— Special Events Professional Services (0OO.O7,574.2O4.41.U1) $2.500— Special Events Operating Rentals Q Leases (OOO.O7.574204.45.O1) $2,000 — Special Events Other (000.07.574.204.49.00) RECOMMENDATION Tukwila Municipal Code 3.32.040 states "Any unbudgeted capital equipment or fixed asset item, including components or services of items, shall be approved by the Mayor and three affirmative votes of the respective Council committee assigned to the requesting department. 'Fixed asset' items are defined as costing at least $5,000 and having a useful life of at least two years." Staff recommends the Finance and Safety committee authorize the Mayor to approve the purchase of a special events equipment trailer not to exceed $8.500 using existing funds from the 2014 Special Events and Volunteer budget. 12 TO: City of Tukwila Jim Haggerton, Mayor INFORMATIONAL MEMORANDUM Mayor Haggerton Finance and Safety Committee FROM: Mike Villa, Chief of Police DATE: April 1, 2014 SUBJECT: Police Department 1st Quarter, 2014 Report BACKGROUND The Police Department would like to keep the Finance and Safety Committee better informed as to public safety and policing issues within the city. At a previous Finance and Safety meeting, I offered to provide the committee quarterly reports beginning in 2012. The committee was in unanimously favor of receiving quarterly reports. This report is for the first quarter of 2014. DISCUSSION During the presentation, I will discuss crime in Tukwila and strategies to reduce crime. RECOMMENDATION The report is for information and discussion only. The Finance and Safety Committee is not being asked to make any decisions.
