DECLARAT I ON
WHEREAS, Bruce E. McCann and Shirley R. McCann (the "Owners"
herein) own certain real property in King County, Washington (the
"Property" herein), as described in Exhibit "A" attached hereto
and hereby made a part hereof; and
WHEREAS, the Owners wish to restrict the use of the Property•
to permit the construction of buildings of unlimited size on adjacent
property.
NOW, THEREFORE, the Owners declare that the Property shall
be held, sold and conveyed subject to the following restrictions
and conditions, which are for the purpose of protecting the value
and desirability of the Property, and which shall run with the Prop-
erty and be binding upon all parties having any right, title or
interest in the Property or any part thereof, their heirs, successors
and assigns, and which will be enforced by the City of Tukwila, or
its successors.
RESTRICTIONS AND CONDITIONS
No building shall be constructed, placed or installed on the
Property; provided, however, that said restrictions shall not pre-
vent the construction of roadways, parking lots, sidewalks, walk-
ways, gardens, landscaped areas, railroad tracks or underground
utilities of any sort upon, under or across the Property.

The Tukwila Planning Commission at its meeting of 8 August
1974, reviewed the site plan for your proposed #255 project.
With the understanding that private restrictive covenants
will be recorded in the near future, the Commission approved
the concept of the project with the following stipulations:
1.. Exterior architectural treatment of the building
must be approved by the Planning Commission.
Detailed landscape plans be approved by the
Planning. Commission prior to issuance of occupancy
permit.
3. That all relevant factors such as width'of curb
cuts, parking and truck maneuvering space be
approved by staff prior to issuance of building
permit.
