As we discussed on the telephone yesterday, I am resubmitting a clean copy
of the Bergstrom BLA application packet for City signature. My
understanding is that the issue of a future road connection to S. 150th Street
will be treated separately, at whatever time is appropriate, and will not enter
into this BLA action.

On March 5, 1992 you approved the above - referenced Boundary Line
Adjustment, subject to a condition which reads:
"As a condition of Brigadoon Subdivision, City Council
approved a temporary cul -de -sac at the end of South 150th
Place and when the property to the north became active, that
the necessary right -of -way easements for the final street
connection of 150th Place to South 150th Street would be
provided."
On behalf of my parents, Carl and Kathleen Bergstrom, applicants, this
letter is submitted to object to this condition being placed on L92 -0001 for
the reasons stated below, and to ask that the condition be removed:
1. There is no nexus between the proposal and the condition. The
potential need for future right -of -way through the property is neither
created, nor impacted, by the proposed Boundary Line Adjustment.
2. City authority to obtain right -of -way across the property is not
diminished by the omission of this condition. We all recognize the
City's power of eminent domain and authority to plan and legally
acquire land for traffic circulation needs. This power and authority
exists with or without this condition.
3. The wording of the condition is vague. The phrase "became active"
could be interpreted to include this Boundary Line Adjustment. The
purpose of this BLA is to allow the sale of Parcel B (the smaller
parcel), while retaining as much land as possible in Parcel A. A
party not versed in planning issues who wished to purchase Parcel
B could be led to believe that the configuration of the land he or she
was purchasing was somehow dependent upon future right -of -way
dedication (which the condition implies is the case - if a future City
Council, while considering a subdivision proposal for the
Bergstrom property, decides that a through street is not in the best
interests of the community for whatever reason, this BLA is null and
void, as would be the plat of Brigadoon Ridge). A cautious
purchaser would likely not acquire a parcel so burdened. The value
and marketability of Parcel B could therefore be reduced by a
condition which is not necessitated by this proposal.

4. As worded, this condition is not a condition at all; it is merely a
recitation of an historical fact concerning action taken by the 1990
City Council with respect to a neighboring plat. This fact is already
on record in the official Council minutes, and presumably appears
on the recorded Brigadoon Ridge plat mylars. It does not need to be
restated on this Boundary Line Adjustment.
5. The most appropriate time to determine the need for, and alignment
of, a through street to South 150th Street is when Parcel A is
subdivided.
If it is your intention to merely remind us that the Council placed this
condition on Brigadoon Ridge, a separate letter stating such would suffice.
However, not even that is necessary; we are fully aware of the condition.
At such time that we choose to subdivide Parcel A in its entirety, we can
discuss and resolve the needs of both the City and the owners, including
those related to traffic circulation. As far as the present proposal is
concerned, however, the shifting of a property line a distance of 49' is
unrelated to this issue, especially since the new location of the affected
property line will be located more than 350' from the area in which the City
Council anticipated that a potential connection would be routed. Because
the condition of approval is not necessitated by, and bears no relationship
to, the proposed action, we request that it be deleted.
If you have any questions concerning this issue, please feel free to call me.
If any clarification of the issues is necessary, or if you do not agree with our
request to delete this condition, please allow me to meet with you to discuss
this matter in person.
I have enclosed a clean copy of the application for your signature. If you
returned the original Affidavit of Ownership to my parents, and you need it
prior to signature of the enclosed documents, please call my father, Carl
Bergstrom, at 243 -4183 and he will submit it to you.

section 18.50 of TMC all side setbacks shall have a minimum of 10
percent of the lot width and is measured from the eave of the
structures.
If you wish to alter this application, please resubmit a new site
plan by March 5, 1992 or submit a letter indicating that you wish
to withdraw your current application.
Please excuse the delay in responding to your boundary line
adjustment application. I was out of the office for a week due to
