My letter is not one of challenge, but one of conformance. In June of this year, Heath Signs installed the 6' "Logo & Eagle" sign on the recessed east fascia of Eagle Hardware, 101 Andover Park East. My client is not happy with the installation as only 60% of the sign is totally visible from street level. In addition to the visibility, I have found that the sign was not placed in accordance with your approval. The Planning Commission approved one sign for the east fascia at 312 square feet. The Eagle sign is set back seven feet and on a separate fascia. In agreement with Eagle Hardware, I propose to move the sign forward seven feet and line up the signs correctly. This will increase visibility and further conform to the decision made 5/24/91. Please notify me with a phone call or letter so I can expedite this correction. Thank you. P.S. VanDusen, Mayor NOTICE OF DECISION CONDITIONS DATE: May 24, 1991 FILE: 91 -8 -SPE; Eagle Hardware The Planning Commission approved the 91 -8 -SPE application on May 23, 1991, with the following conditions. 1. They agreed with staff's (2) recommendations. A. The north elevation wall sign of 281 square feet be approved as requested and consist of one sign only. B. The east elevation wall sign for "Eagle Hardware and Garden" of 312 square feet be approved and consist of one sign only. Mr. Flesher closed the public hearing at 9:10 P.M. Planning Commission Page 5 May 23, 1991 submitted. Staff handed out fliers which the sign company provided which gives and indication of what the logo will look like. Lloyd Ball, Boeing: Mr. Ball stated that the conversion of the sign at the 9401 building is part of an overall project going on throughout the U.S. and Canada. They are converting all the signs in conjunction with Boeing's 75th anniversary. Laurie Fabrick, Trade Marx Sign: Trade Marx was contracted by Boeing to change all the Boeing signs in approximately March. MR. MALINA MOVED TO APPROVE 91 -07 -SPE BOEING MILITARY AIRCRAFT CENTER AS SUBMITTED. MR. GOMEZ SECONDED THE MOTION; MOTION V ASSED UNANIMOUSLY. 91 -08 -SPE: Eagle Hardware Darren Wilson presented the staff report. Staff reported that the proposal was to increase two wall signs on the north and east elevations of the building. Staff clarified that the staff report indicates that the north elevation sign is facing Andover Park East when actually it faces Tukwila Pkwy. Also, the proposed signs on the east elevation faces Andover Park E. rather than Tukwila Pkwy., as indicated in the staff report. On the north elevation a sign of 135.2 sq. ft. would be permitted outright. They are proposing 254 sq. ft., when actually they need 281 sq. ft. The maximum that would be allowed with the Planning Commission's approval would be a sign of 337 sq. ft. Staff would recommend a sign of 281 sq. ft. for the north elevation. With regard to the east elevation, the applicant has proposed one sign split into three sections. The Sign Code only allows one wall sign per wall face. The applicant is allowed, outright, 150 sq. ft. and the applicant has proposed 362.4 sq. ft., and they actually need 321 sq. ft. With the special permission criteria, the Planning Commission, they would be allowed 375 sq. ft. Staff is recommending approval of a sign of 312 sq. ft. with only one wall sign, versus the three. Bob Cleveland, Vice President of Eagle Hardware: Mr. Cleveland indicated the importance of the sign "More of Everything" to be included with the words "Eagle Hardware and Garden" on one wall face. He handed out pictures of the store in Spokane. He stated the words "More of Everything" was synonymous with the Eagle Hardware store, just like the "golden arches" were synonymous with McDonalds. He stated that all the advertisements for the store contained the words "More of Everything ". Planning Commission Page 6 May 23, 1991 Mr. Malina asked why he decided not to put signage on the south side of the building. Mr. Cleveland noted that it wasn't as important to have them there if they were able to put there signage on the front face of the building. Frank Boyle, Heath Sign Co., Kirkland, WA: He stated that he would answer any questions of the Planning Commission. Mr. Malina read a letter from Heath Sign Co. authored by Pam Combs and asked Mr. Boyle if he was familiar with the letter. Mr. Malina asked if Ms. Combs was fully aware of what section 19.32.150 of the Sign Code, since this section states that only one sign is permitted per wall sign and her letter indicates that their proposal keeps with the intent of this section of the Code. Mr. Boyle stated that Ms. Combs was assuming that the "More of Everything" wording was part of the name of Eagle Hardware and Garden. Mr. Cleveland agreed with this assumption. Mr. Flesher closed the public hearing at 9:40 P.M. Mr. Haggerton asked if they had ever made an exception to having more than one sign on a wall face. Staff indicated that to their knowledge, they had not. Mr. Haggerton noted that the Sign Code should not be deviated from. He said that he could not understand why staff would recommend approval of the east elevation sign, which has three signs. Staff clarified that they were basing their recommendation on a 312 sq. ft. sign, with only one sign which would read, "Eagle Hardware and Garden ". MR. HAGGERTON MOVED TO APPROVE PROJECT 91- 08 -SPE BASED ON THE APPLICANT'S REQUEST FOR ITEM NUMBER ONE THAT THE NORTH ELEVATION WALL SIGN SHALL NOT EXCEED 281 SQ. FT. AND CONSIST OF ONE SIGN ONLY AND ON ITEM NUMBER TWO, THE EAST ELEVATION WALL SIGN WHICH STATES "EAGLE HARDWARE AND GARDEN ", SHALL CONSIST OF NO MORE THAN 312 SQ. FT. AND SHALL CONSIST OF ONE SIGN ONLY. MR. MALINA SECONDED THE MOTION; MOTION PASSED UNANIMOUSLY. Mr. Cleveland asked if he could re -apply for other signs. Mr. Burke asked if they could begin work on what the Planning Commission had approved. Mr. Flesher stated that they could go ahead and begin the work that the Planning Commission approved tonight. During the Director's report, Vernon Umetsu handed out articles regarding growth in and around the Tukwila area, as well as the changing design of suburban streetscapes. Page 2 FINDINGS The applicant is requesting a waiver for the size requirements for two permanent wall signs. The applicable sign code regulations are listed below in bold, followed by pertinent findings. Section 19.32.140 "Upon application to and approval by the Planning Commission, the permitted sign areas provided in Table 1 may be increased no more than fifty percent for each doubling of the required minimum setback distance for the wall upon which a particular sign is to be placed, but in no case shall sign area exceed that permitted in Section 1932.150. In the applicant's letter (attachment A) he requested special permission to put up two wall signs. But the actual request involves on wall sign on the north elevation and three separate wall signs on the east elevation. The zoning for the property is C -M which requires a front yard setback of 50 feet. Since the building is set back further than required the applicant is requesting special permission under section 19.32. 140(A) for a larger wall sign. See attachment B for sign design details.
