Project Description: Relocation of the Frederick Sr Nelson warehouse driveway along with reconfiguring and restripping existing parking lot and the installation of a traffic signal and other frontage improvements at the intersection of South 180th Street and Sperry Drive. Project also includes the modification to the Christensen Park with the provision of parking, handicapped access, emergency vehicle access, relocation of existing fitness station and removal and replacement of existing vegetation. 2. Existing Land Use: Warehouse for Frederick & Nelson and trail /park. 3. Surrounding Land Use: Warehouse /office to the north, west and south. The Green River and West Valley Freeway are on the east. 4. Terrain: Relatively flat except for bank (up to 25% slope) between the river and the trail. 5. Vegetation: Existing landscaping (evergreen trees, shrubs and sod)in parking area as well as between the existing access driveway to Frederick & Nelson warehouse and the fence along the west edge of the trail right -of -way. 6. Access: South 180th Street. There are two existing driveways affected on the north side of 180th: the westernmost driveway accesses directly onto the Frederick & Nelson site and the second one to the east (which is chained at the north edge of the driveway apron) provides maintenance and emergency service access to the park /trail. BACKGROUND 90- 1- DR / &- 3 -SMP: Christensen Park Page 2 A mutual agreement between the applicant and the property owners has led to this proposed coordination of design and cost sharing. The purpose of the the proposed traffic signalization and driveway relocation project is to improve both safety the traffic flow in this area of South 180th Street. The realignment of the existing driveway access allowed the applicant through an easement with the property owners to provide additional parking for the Interurban Trail. Frederick & Nelson will have the exclusive use of the parking area within the easement during the day (until 5:30 P.M.) except for joint use for four sale periods each year to be agreed upon by the applicant and Frederick & Nelson. The project is located in the Shoreline area and will require an approval of a Substantial Development Permit (SMP). ' STAFF REPORT to the B.A.R. The site should be planned to accomplish a desireable transition with streetscape and to provide for adequate landscaping and pedestrian movement. h Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas. c. The height and scale of each building should be considered in relation to the site. This criterion is not applicable since no structures are included in the proposed project. Harmony on texture, lines and masses is encouraged. h Appropriate landscape transition to adjoining properties should be provided. c. Public buildings and structures should be consistent with established neighborhood character.w d. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged. e. Compatibility of on -site vehicular circulation with should be encouraged. P2o Paso The alignment of the emistiwg driveway access will improve traffic flow along 4 1E— South 180th Street. The new alignment will provide safer ingress and egress to the site which needed for normal traffic conditions as well as for the large sales events which take place at the warehouse approximately four times a year. In addition, the removal of the existing driveway access to the park /trail removes the potential for further traffic congestion in that area along South 180th Street. The provision of public parking for trail users during the evenings is a benefit to the park /trail users. The inclusion of the handicap access at this location improves the availablility of the park /trail to the developmentally disabled. The regrading of the parking lot at the eastern portion of the site of the warehouse site allows surface water runoff to be directed away to the west to protect the park /trail and the river environment from any drainage impacts. The new street frontage improvements match existing improvements in the area and provide pedestrians with greater safety and convenience. (3) Landscaping and Site Treatment. a. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced. h Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance. c. Landscape treatment should enhance architectural features, strenthen vistas and important axis, and provide shade. d. In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken. e. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged. f. Screening of service yards, and other places which tend to be unsightly, should be accomplished by use of walls, fencing, planting or combination. g. In areas where general planting will not prosper, other materials,such as fences, walls and pavings of wood, brick, stone or gravel may be used. h. Exterior lighting, when used, should enhance building design and the adjoining landscape. Lighting standards and fixtures should be of a design and size compatible with the building and adjacent area. Lighting should ' STAFF REPORT to the B.A.R. 90- 1 -DR /9 - 3 -SMP: Christensen Park Page 5 be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. Although the realignment of the driveway access involves the overall loss of landscaping on the site,; the proposed landscaping plan with it retention of plant material in some areas and enhancement in other areas maintains the necessary functions which the existing landscaping performs. The revised landscaping along South 180th Street still helps to soften the appearance of the warehouse on the site and provides the necessary screening and buffering of the parking use from the park /trail. The dimensions of the existing landscaping island along the major access for visitors and employees to the warehouse will be reduced, the landscaping island as revised retains the remaining landscaping and is sufficient is scale to maintain the overall proportions of landscaping to building. (4) Building Design. a. Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to its surroundings. b. Buildings should be to appropriate scale and in harmony with permanent neighboring developments. c. Building components - such as windows, doors, eaves, and parapets should have good proportions and relationship to one another. Building components an ancilliary parts shall be consistent anitcipated life of the structure. d. Colors should be harmonious, with bright or brilliant colors used only for accent. e. Mechanical equipment or other utility hardware on roof, ground or buildings should be screened from view. f. Exterior lighting should be part of the architectural concept. Fixtures, standards, and all exposed accessories should be harmonious with building design. g. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and siting should be used to provide visual interest. This criterion is not applicable since no structures are included in the proposed project. (5) Miscellaneous Structures and Street Furniture. a. Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials shoud be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and proportions should be to scale, b. Lighting in connection with miscellaneous structures and street furniture should meet the guidelines applicable to the site, landscape and buildings. STAFF REPORT to the B.A.R. f .. 90- 1- DR /90- 3 -SMP: Christensen Park Page 6 The only street furniture proposed for the project is the use of permanent and removeable bollards used at the entrances to the emergency and maintenance vehicle access and the handicap access points respectively. The stains /colors used are standard for bollards at other park facilities. CONCLUSIONS A. The new alignment of the existing driveway access with Sperry Drive on the south side of South 180th Street and signalization of the intersection will enhance traffic flow and improve traffic and pedestrian safety. B. The reconfiguration and reconstruction of the existing parking lot do not result in a net loss of parking. The amount of parking provided and the dimensions of the parking spaces meet code requirements. The parking on the east side on the new driveway access (39 parking stalls) will be available to park /trail users after 5:30 P.M. onr G - j " S zf occ.c. 0S PA is TPJ ( st p-c �a R �- s a c. C There is some loss of interior landscaping within the parking lot. The e�as S ma'or veway access (used mostly for non -truck traffic) contains a landscaped 26 island feet by 5ffif feet) which separates incoming from outgoing traffic. This landscaped area will be reduced in size (17 feet byfeet). 65 C. Emergency vehicle access is presently from a driveway on the north side of South 180th Street (just approximately 150 feet to the east of the existing driveway to be realigned). The north end of this driveway is chained to prevent non - authorized vehicles from entering the park /trail at this point. Parking by trail users often takes place in this driveway which could prevent vehicle access in the event of an emergency. The new access does not allow the stacking of parked vehicles which might block access in the event of an emergency. Existing pedestrian access to the park /trail at this location will remain the same except that the existing driveway will be removed and replaced with paving OE feet wide) from the new sidewalk to existing trail connecetion. D. To accomodate the revision of the parking layout and provide new handicap and emergency vehicle access some of the existing landscaping must be removed. The requirement for side yard landscaping in a CM zone (Section 18.52.020 of the TMC) is a minimum of 5 feet. The proposed dimension of the revised landscaping (what will be retained and the new landscaping) ranges from 10 to 75 feet. Current scope of authority for Design Review. 2. Map identifying areas covered by Design Review. 3. Potential options for expanding Design Review authority. DISCUSSION Attachment "A" provides the current scope of authority for the Board of Architectural Review. Most office, commercial and industrial park develop- ment is required to go through the design review process. Property zoned M -1 (Light Industrial) and M- 2 /M -2L (Heavy Industrial) does not require design review, except along the shoreline and within 300 feet of a residen- tial zone. A large scale map will be provided at the Planning Commission meeting identifying areas not covered by design Review. The Planning Commission has the following options for broadening the scope of authority for Design Review: 1. Require all M -1 /M -2 development over 10,000 square feet to go through Design Review. 2. Require M -1 /M -2 development over 10,000 square feet along a major arterial (180th, SR 181 (West Valley Highway) and East Marginal Way South] to go through Design Review. Attachment "B" contains the process for the Planning Commission to amend the Zoning Code. The Planning Commission needs to decide what type of modification they wish to initiate and when they want to schedule the public hearing. It is the purpose of this chapter to provide for the review by public officials of land development and building design in order to promote the public health, safety and welfare. Specifically, the board of architectural review ( "BAR ") shall encourage well designed developments that are creative and harmonious with the natural and manmade environments. (Ord. 1247 S1(part), 1982). 18.60.020 Membership. The board of architectural review shall consist of the members of the planning commission. The officers of the planning commission shall also sit as officers of the board of architectural review. Applications for review by the board of architectural review must be submitted to the planning department at least two weeks prior to the meeting of the board of architectural review. All applications shall be accompanied by a filing fee as required in Chapter 18.88 and shall include but are not limited to site plans, exterior building elevations, the environmental checklist if applicable, and other materials as required by the planning department. In reviewing any applica- tion, the following guidelines shall be used by the BAR in its decision making: (1) Relationship of Structure to Site. (A) The site should be planned to accomplish a desirable transition with the streetscape and to provide for adequate landscaping, and pedestrian movement; (B) Parking and service areas should be located, designed, and screened to moderate the visual impact of large paved areas; (C) The height and scale of each building should be considered in relation to its site. (2) Relationship of Structure and Site to Adjoining Area. (A) Harmony in texture, lines, and masses is encour- aged; (B) Appropriate landscape transition to adjoining properties should be provided; (C) • Public buildings and structures should be con- sistent with the established neighborhood character; (D) Compatibility of vehicular pedestrian circula- tion patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged; (E) Compatibility of on -site vehicular circulation with street circulation should be encouraged; (3) Landscape and Site Treatment. 308 (Tukwila 6/89) J.8.72.030-18.80.020 18.72.080 Appeal. The commission, after due public notice and hearing, shall submit a report to the council containing its recommendation thereon. Project Description: Relocation of the Frederick & Nelson warehouse driveway along with reconfiguring and restripping existing parking lot and the installation of a traffic signal and other frontage improvements at the intersection of South 180th Street and Sperry Drive. Project also includes the modification to the Christensen Park with the provision of parking, handicapped access, emergency vehicle access, relocation of existing fitness station and removal and replacement of existing vegetation. 2. Existing Land Use: Warehouse for Frederick & Nelson and trail /park. 3. Surrounding Land Use: Warehouse /office to the north, west and south. The Green River and West Valley Freeway are on the east. 4. Terrain: Relatively flat except for bank (up to 25% slope) between the river and the trail. 5. Vegetation: Existing landscaping (evergreen trees, shrubs and sod)in parking area as well as between the existing access driveway to Frederick & Nelson warehouse and the fence along the west edge of the trail right -of -way. 6. Access: South 180th Street. There are two existing driveways affected on the north side of 180th: the westernmost driveway accesses directly onto the Frederick & Nelson site and the second one to the east (which is chained at the north edge of the driveway apron) provides maintenance and emergency service access to the park /trail. BACKGROUND A mutual agreement between the applicant and the property owners has led to this proposed coordination of design and cost sharing. The purpose of the the proposed traffic signalization and driveway relocation project is to improve both safety the traffic flow in this area of South 180th Street. The realignment of the existing driveway access allowed the applicant through an easement with the property owners to provide additional parking for the Interurban Trail. Frederick & Nelson will have the exclusive use of the parking area within the easement during the day (until 5 :30 P.M.) except for joint use for four sale periods each year to be agreed upon by the applicant and Frederick & Nelson. The project is located in the Shoreline area and will require an approval of a Substantial Development Permit (SMP). STAFF REPORT to the B.A.R. SHORELINE CONSIDERATIONS SUBSTANTIAL DEVELOPMENT PERMIT ( 90- 1 -DR /9v .; -SMP: Christensen Park Page 3 The proposed project is located within the Shoreline environment as noted in the City's Shoreline Master Plan. The project's design incorporates improvements which are also supported by the following Goals and Policies of Tukwila's Shoreline Master Plan: Overall Goals - Goals # 7 and 10 (p. 4.1) In addition, the proposed project supports the following goals and plocies of the City' Shoreline Program: Economic Policies - Policy # 5 (p. 4.2) Public Access Element - Goal # 3 (p. 4.3) Recreation Element - Policy # 1 (p. 4.5) Conservation Element- Policy # 3 (p. 4.7) And lastly, the project complies with all General Regulations, River Zone Regulations and Standards, and Low Impact Zone Regulations and Standards of the Shoreline Master Program. Approval of the Shoreline Substantial Development Permit (SDP) is an administrative process. However, a Design Review (DR) is required for the proposed project. DECISION CRITERIA The applicable Tukwila Municipal Code (TMC) Design Review criteria are listed below in bold, followed by pertinent findings of fact. 18.60.050 GENERAL REVIEW CRITERIA (1) Relationship of Structure to Site. a. The site should be planned to accomplish a desireable transition with streetscape and to provide for adequate landscaping and pedestrian movement. h Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas. c. The height and scale of each building should be considered in relation to the site. This criterion is not applicable since no structures are included in the proposed project. . Harmony on texture, lines and masses is encouraged. h Appropriate landscape transition to adjoining properties should be provided. c. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged. e. Compatibility of on -site vehicular circulation with should be encouraged. The alignment of the existing driveway access will improve traffic flow along South 180th Street. The new alignment will provide safer ingress and egress to the site which needed for normal traffic conditions as well as for the large sales events which take place at the warehouse approximately four times a year. In addition, the removal of the existing driveway access to the park /trail removes the potential for further traffic congestion in that area along South 180th Street. The provision of public parking for trail users during the evenings is a benefit to the park /trail users. The inclusion of the handicap access at this location improves the availablility of the park /trail to the developmentally disabled. The regrading of the parking lot at the eastern portion of the site of the warehouse site allows surface water runoff to be directed away to the west to protect the park /trail and the river environment from any drainage impacts. The new street frontage improvements match existing improvements in the area and provide pedestrians with greater safety and convenience. (3) Landscaping and Site Treatment. a. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced. h Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance. c. Landscape treatment should enhance architectural features, strenthen vistas and important axis, and provide shade. d. In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken. e. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged. L Screening of service yards, and other places which tend to be unsightly, should be accomplished by use of walls, fencing, planting or combination. g. In areas where general planting will not prosper, other materials,such as fences, walls and pavings of wood, brick, stone or gravel may be used. h. The stains /colors used are standard for bollards at other park facilities. CONCLUSIONS A. The new alignment of the existing driveway access with Sperry Drive on the south side of South 180th Street and signalization of the intersection will enhance traffic flow and improve traffic and pedestrian safety. B. The reconfiguration and reconstruction of the existing parking lot do not result in a net loss of parking. The amount of parking provided and the dimensions of the parking spaces meet code requirements. The parking on the east side on the new driveway access (39 parking stalls) will be available to park /trail users after 5:30 P.M. There is some loss of interior landscaping within the parking lot. The existing major driveway access (used mostly for non -truck traffic) contains a landscaped island (45 feet by 310 feet) which separates incoming from outgoing traffic. This landscaped area will be reduced in size (17 feet by 250 feet). C. Emergency vehicle access is presently from a driveway on the north side of South 180th Street (just approximately 150 feet to the east of the existing driveway to be realigned). The north end of this driveway is chained to prevent non - authorized vehicles from entering the park /trail at this point. Parking by trail users often takes place in this driveway which could prevent vehicle access in the event of an emergency. The new access does not allow the stacking of parked vehicles which might block access in the event of an emergency. Existing pedestrian access to the park /trail at this location will remain the same except that the existing driveway will be removed and replaced with paving (12 feet wide) from the new sidewalk to existing trail connecetion. D. To accomodate the revision of the parking layout and provide new handicap and emergency vehicle access some of the existing landscaping must be removed. The requirement for side yard landscaping in a CM zone (Section 18.52.020 of the TMC) is a minimum of 5 feet. The proposed dimension of the revised landscaping (what will be retained and the new landscaping) ranges from 10 to 75 feet. NOW, THEREFORE, in consideration of the mutual benefits and conditions hereinafter contained, the parties agree as follows: 1. Description of the Work. The work to be performed under this Agreement includes the closure of driveways on the north side of South 180th Street, the construction of a new access aligned with Sperry on the north side of the intersection, the construction of additional parking, the revision of existing parking, the installation of a traffic signal, signs, marking and lighting, the construction of a sidewalk on the north side of the intersection, utility and landscape work, and miscellaneous work related to the above items. The improvements shall be constructed and undertaken generally in accord with a conceptual plan dated December 28, 1988, and prepared by Entranco. The estimated cost for the above work is $225,000. Construction engineering (inspection) shall be deemed part of the construction cost. 2. Design and Approval of the Work. The City, at its sole expense, shall engineer and design the work; provided, however, that no job shall be let or work undertaken except INTERSECTION IMPROVEMENT AGREEMENT - Page 2 4 7 5 0 C 5 ' L E H/ G I1 H upon the prior written approval of all parties of the design for the work. 3. Construction Funding. A. The cost of the work shall be paid for by the parties as follows: (1) The City will pay Ninety Thousand Dollars ($90,000) for construction of the improvements as shown on the Entranco drawing dated December 28, 1988. (2) Twenty -Five Thousand Dollars ($25,000) of the balance of the construction costs shall be paid for by F &N. (3) One Hundred Ten Thousand Dollars ($110,000) of the balance of the construction costs shall be paid by the various owners of the property south of 180th on Sperry Drive in accord with the figures set opposite their respective names: AMOUNT PERCENT (a) Boeing $ 23,056.00 20.96% (b) 1st Interstate 74,470.00 67.70% (c) Armstrong 12,474.00 11.34% TOTAL $110,000.00 100.00% B. Payment by the parties shall be made into an escrow account pursuant to an escrow agreement, which shall instruct the escrow agent to disburse moneys for work performed in accordance with directions from the City. C. No contract shall be let for any of the work until the parties have deposited with the escrow agent the full amount of their financial obligations under this Agreement. D. In the event the bid(s) of the lowest responsible bidder(s) for the work is more than $225,000, but less than $245,000, each of the parties (excluding the City) agrees to pay the same percentage of said excess cost as the percentage it is paying of the initial $225,000. The parties shall make the deposits within 30 days of written notice. E. In the event the lowest responsible bid(s) exceeds $245,000, no contract shall be let for any work nor shall any improvements be undertaken, except upon the written agreement of all parties hereto, and if the parties do not so agree within 60 days of receipt of notice, then this agreement shall terminate and the escrow funds shall be refunded to the parties. F. If construction costs are less than $225,000 then, the remaining escrow account balance will be equally divided between the north and the south, with the south being shared in the same proportion as shown in item A(3). Grant of Easement and Utilization of Said Easement. A. F &N will grant the City an easement for access and parking in an area shown generally on the Entranco drawing for additional parking and access for Christensen Trail. The City shall indemnify F &N against claims, demands, and liabilities arising in connection with use of the parking lot and access road. B. F &N will receive credit in respect to the parking easement area for off - street parking in the event of future development of any property owned by it adjacent to the easement area in accord with a credit schedule to be agreed upon by the City and F &N before construction commences under this Agreement. C. F &N will have exclusive right of use of the parking area within the easement area during regular business hours. The City will have exclusive right of use of the easement area and parking facilities for Christensen Trail use purposes every evening after 5:30 P.M. and all day on weekends and holidays, provided, however, there will be a joint use of the area during four sale periods each year at times to be agreed upon by the City and F &N. 5. Construction Schedule. No work shall be performed under this Agreement which would serve to impede the flow of traffic between November 1 and January 10 unless mutually agreed to between F &N and the City. The preliminary design work to be conducted by the City shall include an investigation of an extension of Sperry Drive to Saxon Drive. Investigation shall also consider various matters related to F &N's truck - loading operations, F &N's traffic circulation, the east parking lot /F &N's driveway /Sperry Drive intersection, and right -of -way needs generally within the project area. 8. Landscaping. The City shall be responsible for resolving landscaping issues related to the project improvements. 9. No Waiver of Rights. Failure of any party to insist on the strict performance of any of the terms of this Agreement shall not be construed as a waiver or relinquishment of that party's rights thereafter to strictly enforce any such term, but the same shall continue in full force and effect. 10. Binding Agreement. This Agreement shall be binding upon the parties, their respective heirs, legal representatives, assignees, transferees, and successors. 11. Recording. This Agreement shall be recorded with the King County Auditor and the cost of said recording shall be paid by the non -City parties. 12. Litigation. In the event that any party shall commence litigation against the other in order to enforce any term or condition of this Agreement, the prevailing party in such litigation shall be entitled to recover its costs, including reasonable attorney fees. 13. Entire Agreement. This Agreement contains the entire understanding among the parties hereto, and except as expressly provided herein no other agreement, oral or otherwise, regarding the subject matter of this Agreement shall be deemed to exist or to bind any of the parties hereto or to have any other force or effect.
