hereinafter called the f:RANIOR and King County, Washington, herafter called the GRANTEE::
WITNESSETH:
That tIHERFAS the CRANrOR herein is the owner of that certain parcel of land
described as follow, to -wit:
That portion of Lots 14 -17 of Essico Add. to Riverton Add. in Sec 15,
Twp 23 N, R 4 EWM as recorded in: Plats, Vol. 33, Page •49. Records of
King County, Washington.
and,
WHEREAS it has been.found necessary in the construction and improvement of
E. Marginal Way So. (S118th St. to S 133rd Pl.)
to make slopes on the said property of the GRANTOR for cute and fills, as follows:
A strip of land lying Wly & adjacent to the Wly R/W line of E. Marginal
Way So., as surveyed by King County Survey#15- 23 -4 -33. Said strip being
described as follows: Beginning at the South Boundary of above said Lot 14
& having a width of 4 ft. thence Nly & parallel to said R/W to a point of
tangency at Sta.22 +75, thence Wly on,an arc of a circle with a 10' radius
& said strip increasing in width to 6ft. at a point of tangency S. of the
S. R/W line of S. 128th St. thence Wly at 6 ft. in width for 12 ft.
adjacent to said South R/W line of So. 128th St.
1K)W, THEREFORE, in consideration of the premises, the said GRANTOR hereby agrees
3,'. that the said slopes may be made on his property as hereinbefore set forth, in con-
formity with standard plans and specifications for highway purposes and to the same
extent and purposes as if the rights herein granted had been acquired by condemnation
proceedings under Eminent Domain statues of the State of Washington.
IT IS MUTUALLY AGREED AND UNDERSTOOD by the parties hereto that this Easement has
been given to and accepted by said County subject to and upon the following car '.time,
to-wit:
--� If any part of said right of way shall be abandoned or shall cease to be used or
maintained as a public highway by said County, or the route thereof changed, then as
to such part all rights under this easement shall thereafter be null and void, and
such portions of such right of way shall automatically revert to the GRA'IOR,
successors, or assigns, without any notice being required.
IN WITNESS WHEREOF, the said GRANTOR has hereunto signed his naps this
