We have received a letter from Mr John Merrick in which he
has put together a marketing package on our properties as a
single entity for commercial development. He has done this
without our knowledge or consent.
We have contacted Mr Merrick and have advised him that our
properties are not for sale and he does not have the right or
authority to send out a letter as he has done. We strongly
suggested to him that he contact any and all persons with whom
he has made contact and immediately rescind any suggestion
about these properties being for sale.
When we opposed the rezone of Mr Schnieder's property
we did so in good faith wanting to maintain our single family
homes in this area and we greatly appreciated the Council's
finding to retain the R 1.72 zoning.
The reason for this letter is to reaffirm our position
on wanting to live here and maintain the present zoning.

east of the intersection of 65th Avenue South and Southcenter

Mr. Lee Phillips, 6550 Southcenter Boulevard, said he lives
adjacent to the subject property and is opposed to the pro-
posed zoning request. This residential area has been zoned
R -1 since the first zoning ordinance established in Tukwila.
This area is a buffer zone between the office building and
the single- family homes. Two previous owners have attempted
to spot rezone this property to multi - family housing. Each
time Council rejected their request. This is the second time
Mr. Schneider has applied for a rezone to build a commercial
office building. The Council rejected his first request,
therefore protecting the single - family homes.
Mr. Schneider's request is a spot rezone. Mr. Phillips urged
the Council to. protect their single- family homes and property
values. It would have a terrible environmental impact upon
the people that live in this area to have an office building
built in the. middle of this R -1 property. The Phillips fam-
ily has lived in Tukwila since 1945 and has been active in
the community. They like it here and want to keep living
here. He is opposed to a spot rezone. Mr. Phillips said he
attended the Planning Commission meeting and was very dis-
turbed that the members did not know where the property was
located. The Planning staff said this is not a spot rezone
but when you allow some other form of zoning in the midd a of
R -1 Residential, it is a spot rezone. He urged the Council
to again reject this rezone and keep this property R -1 resi-
dential. Mr. Phillips explained that his home is east of
this property and the Henke and Merrick homes are directly
north.
Mr. Malcom McCloud, attorney, said he is representing John
Merrick. He expressed his opinion that the staff's presenta-
tion is very inadequate. You cannot tell the location of the
property by the way the staff presented it. They did the
same thing when they presented it to the Planning Commission.
The property under discussion is surrounded by R -1 property.
It is inexcusable for a staff member to present a rezone
without identifying the area. He pointed out the R -1 prop-
erty on the map and noted that it is not identified as such.
This was the same map presented to the Planning Commission
so they didn't know the location of the R -1 when they ruled
on it. There is a street between the subject property and
the office building that serves as a buffer zone. There are
four homes in the R -1, and now they want to build a business
building in the middle. This is an important issue for the
Council to consider, and it is not fair to the Council to
have such a sloppy presentation. This is clearly a spot
rezone. An office building is going to increase traffic
and noise, and there will be a lot of dirt generated from
the parking lot. These people have been there since 1945 -
Merrick, Henke, Phillips, Simonds. They have their money
invested in these homes. An office building will devalue
their property. They shouldn't be disturbed in the enjoyment
of their homes. The Council should honor the rulings of
their predecessors and preserve this property as residential
property.
Mrs. Madge Phillips, 6550 Southcenter Boulevard, asked the
Council to deny this request to rezone the Schneider prop-
erty. This property has changed hands several times and each
time the new owner has applied for a rezone. Each previous
Council has found that such a change would be spot zoning.
Our home is still in the R -1 area. We have a beautiful view
of the mountain, handy access to Southcenter, the freeway,
the park, the airport; it is a lovely place to live.

Mr. Gerald Schneider, 6510 Southcenter Boulevard, said he is
the applicant and he purchased this property ten years ago.
At that time they were not in the office building business.
Referring to the subject property, he said that this is not
the most desirable place for single - family residents. Tuk-
wila has changed a lot since 1945. At this time, the best
use for this property is for an office building. If the R -1
property was rezoned to P- 0,.the value would increase. It is
a perfect place for an office, close to freeways and all the
major intersections.
Mayor Pro -Tem Harris read, for the record, a letter from
Mr. and Mrs. Henke. They are requesting that the City Coun-
cil uphold the standards set by their predecessors and not
permit spot zoning in Tukwila.
Rick Beeler, Planning Director, reviewed the Staff Report.
The Planning Commission, at their meeting of January 28,
1988 recommended approval of the rezone request based on the
staff's Findings and Conclusions, with the added stipulation
that any project i. at is proposed on this property be brought
before the Board of Architectural Review.
Mr. Beeler explained that the Comprehensive Plan, the recon-
struction of Southcenter Boulevard, and tree recent rezoning
of the Kato property indicate that this property should be
rezoned to Professional Office.
Mr. Phillips commented that at the time this proposal went
to the Planning Commission there were no structural building
plans presented.
Mr. McCloud again pointed out how badly the Planning staff
has described this. The map does not show that the surround-
ing property is designated R -1 and ha been for 44 years.
This is gross negligence.
There being no further comments for or against this proposal,
the Public Hearing was closed.
Councilmember Bauch explained that this is a misrepresenta-
tion of the policy of the City Council. When you have a
residential area, you do everything possible to preserve it.
If the Merricks, Henkes, Phillips and Simonds families came
to the Council and said the noise and congestion is too great
and it is not a viable place to live any more, then the Coun-
cil would probably unanimously change the zoning. But these
families still want to live there and we should make it pos-
sible for them to do so.
MOVED BY BAUCH, SECONDED BY MORIWAKI, THAT THE COUNCIL NOT
APPROVE THE RECOMMENDATION OF THE PLANNING COMMISSION AND
DENY THE REZONE. *
Councilmember Hernandez commented that she is in favor of
preserving the residential areas of the City. It is hard to
see that this is spot zoning when it is already zoned P -0
next door. When these people decide they want to rezone
their property, they will probably find they have quite a
good investment in their properties. It is hard to visualize
how anybody would want to build a single - family home on this
property. This is a hard decision.

Rebecca Fox, Planner, reviewed the staff report recommending
approval.
Gerald Schneider, 6510 Southcenter Blvd., concurred with the
staff report and staff's comments.
Carl Bloss, 6510 Southcenter Blvd, clarified that Attachment A of
the staff report is not the design that will be used. He
submitted the legal description of the proposal which was entered
into the record.
Lee Phillips, 6550 Southcenter Blvd., spoke for Mr. Hamke and
others in the neighborhood opposed to the proposal. He felt it
would decrease property values, and constituted a spot rezone.

87 -3 -UCU - SEATTLE RENDERING WORKS Request for an Unclassified
Use Permit to install an incinerator and waste -heat boiler to
reduce odor emissions from the site.
Jack Pace, Senior Planner, reviewed the staff report recommending
approval.
Rick Tomkins, 304 Main Avenue So., Renton, represented the
applicant and further clarified the proposal and adding that the
installation of the machinery will represent a substantial
improvement over what now exists.
Bill Hammond, Seattle Rendering Works, 5795 S. 130th Place,
responded to a question raised by Mr. Knudson by listing the
other sites using this same machinery - proposed to be installed
here.
Discussion ensued on the proposal.
MR. KNUDSON MOVED AND MR. LARSON SECONDED A MOTION TO APPROVE THE
REQUEST FOR AN UNCLASSIFIED USE PERMIT TO INSTALL AN INCINERATOR
AND WASTE -HEAT BOILER, BASED ON THE STAFF'S FINDINGS AND RECOM-
MENDATIONS. THE MOTION WAS UNANIMOUSLY APPROVED.

VICINITY /SITE INFORMATION
FINDINGS
1. Property Area: The rezone area is approximately 28,000 square feet (.62
acres).
2. Existing Development: The rezone property has been vacant for several
years.
3. Surrounding Land Use: An office building is located to the west, with four
single- family dwelling units on the north and east. The property abuts
Southcenter Boulevard on the south.
4. Terrain: The rezone property is hilly with slopes of approximately 50 %.
5. Access: The property will be accessed via Macadam Road. The Tukwila Public
Works Department has not requested further road improvements to date.
Access easements have been secured for upcoming improvements to Southcenter
Boulevard.
BACKGROUND
In February 1979, the applicant requested a rezone of the subject property
from R -1 -7.2 (Single Family Residential) to C -1 (Community Retail Business).
Then, as now, the Comprehensive Land Use designation was "Office ". Adjacent
property owners opposed the rezone based on potential adverse impacts to the
neighboring single - family properties. These concerns included: 1) view block-
age; 2) removal of vegetation from the site; 3) parking impacts; and 4) spot
zoning. The Planning Commission recommended denial of the proposed rezone based
on "potential adverse effects to the surrounding single - family properties."
The current proposal calls for a rezone from R -1 -7.2 to P -0 (Professional
Office). This is consistent with the Comprehensive Land Use Plan map which
shows the area as "Office" (Attachment B).
At the close of the public hearing, the Planning Commission will deliberate
and make its The recommendation will be forwarded to the City
Council for their decision.
DECISION CRITERIA
The applicable Rezone decision criteria are shown below in bold, followed by
pertinent findings of fact.
1. The use or change in zoning requested shall be in conformity with the
adopted comprehensive land use policy plan, the provisions of this title,
and the public interest.

The proposed P -0 zoning is consistent with the adopted Comprehensive Plan
Map's "Office" designation. The 1977 Comprehensive Plan also showed the
rezone area as well as the adjacent area to be "Office ". This designation
reflects that office use is a desirable transitional use for this area.
The imminent Southcenter Boulevard improvements makes the rezone timely.
The requested P -0 zone would be an extension of P -0 zoning which already
runs along Southcenter up to 57th Avenue. Extending the P -0 zone provides
the opportunity for consistent development per the adopted Comprehensive
Land Use Plan.
2. The use or change in zoning requested in the zoning map or this title for
the establishment of commercial, industrial, or residential use shall be
supported by an architectural site plan showing the proposed development and
its relationship to surrounding areas as set forth in the application form.
The site plan (Attachment A) is schematic. Future development is shown as
a two -story building of approximately 14,000 square feet. The foot print
shown in the general site plan is approximately 40' X 180'. Specific
building details will be determined in the building permit process. The
applicant has stated that the finished office building will meet the P -0
zone's 35 -foot height limit. Front yard setback will be a minimum of 25
feet, with side and rear yard setbacks no less than 10 feet as the Zoning
Code requires. Parking and landscaping requirements will also be met.
The schematic site plan shows that by building the structure into the toe of
the slope, the site's sloping topography would be used to lessen the height
impacts of the building on the nearby residences.
Design review is required for all buildings over 10,000 square feet. When
the developer submits specific information, the public will be able to
comment on design - related issues including bulk, views, parking, landscap-
ing, building materials, etc., at that time.
3. When the request is not in agreement with the Comprehensive Land Use Policy
Plan, the applicant shall provide evidence to the City Council's satisfac-
tion that there is an additional need for the requested land classification.
The requested land classification is consistent with the Comprehensive Land
Use Plan designation.
CONCLUSIONS
1. The proposed rezone is in the public interest since the new zoning would be
consistent with the Comprehensive Plan.
2. Improvements to Southcenter Boulevard and development along the roadway
support a rezone to allow office use.

3. The proposed office use is consistent with other primarily office /commercial
uses along Southcenter Boulevard.
4. A proposed use over 10,000 square feet will trigger design review. At that
time citizens will be able to review the specific project.
5. The proposal meets the basic criteria for rezones.
RECOMMENDATIONS
Planning staff recommends rezoning from R -1 -7.2 to P -0 as requested.

Mr. Kessey stated the trees along Southcenter Boulevard may have to be removed but
the site will be landscaped. Said the development is valuable for City tax rolls

Mr. M. E. Simonds, 15460 - 65th Avenue South, voiced concern over the present con-
dition of the unvacated roadway which will serve the proposed office building.
Chairman Kirsop closed the public hearing at 10 :17 P.M.
Planning Commission discussed condition of access road to site and previous street
vacation actions.

Mr. Satterstrom read the staff report and explained this was not a public hearing
before the Planning Commission.
Mr. Segale, applicant, stated he felt the property should be zoned M -1 due to the
surrounding zoning. Mentioned the property will likely be used for an expansion
of present operations.
MOTION BY MR. SOWINSKI AND SECONDED BY MR. WELSH TO RECOMMEND THE CITY COUNCIL
CLASSIFY THE SEGALE PROPERTY AS M -1 (LIGHT INDUSTRY) UPON ANNEXATION TO THE CITY
OF TUKWILA.
MOTION CARRIED.
Mr. Satterstrom requested the Planning Commission hold a work meeting on the
zoning ordinance on 1 March 1979. Commissioners agreed.
Staff also announced that Mr. Richard Bowen had resigned from the Planning Com-
mission. Commissioners expressed their regrets at his departure.
Chairman Kirsop adjourned the meeting at 10:55 P.M.

M -L -P zones, the Comprehensive Land Use and the annexation policies of the City
were the reasons for the recommendation of C -M zoning.
Mr. Segale stated the area was isolated from any potential residential land. Also
stated C -M zoning did not allow outdoor storage and the 35 foot height limit was
too restrictive.

(adjacent property owner), Mr. Al Henke, Mr. Lee Phillips, Mr. John
Merrick and 92 signets on the petition against rezone of the
Schneider property adjacent to the requested vacation. Council Presi-
dent Bohrer read the lt±t r whic statt 'the vacation will result in
a bottle -neck of traffic and reduce the avenues of foot and vehicle
traffic to the people up the hill and to the entry to Tukwila Park.
It will render the hilltop and the park inaccessible and will destroy
historic traffic flow with no benefit to anyone except Mr. Schneider.
His letter continued that none of the surrounding property owners
received any notice of the hearing on this vacation last week, so his
clients request an advance notice of applications for vacation or
hearings on same, so they can express their opposition. They also
requested additional public hearing on this vacation, with notice
to this office of any future proceedings on the matter.

REZONE CRITERIA:
The burden of proof in demonstrating that the change is appropriate lies solely
upon the proponent. Generally, the more dramatic the change, the greater will
be the burden of showing that the proposed change is in conformance with the
Comprehensive Plan as implemented by the Zoning Ordinance. The proponent must
show in a clear and precise manner why the rezoning application should be
granted. The Planning Commission and City Council will review your proposal
using the following criteria. You may attach additional sheets and submit other
documentation to support your rezone application.
9. The use or change in zoning requested shall be in conformity with the
adopted comprehensive land use policy plan, the provisions of this title,
and the public interest;

February 22, 1979 recommends C -1, which is a down- zoning that we support,
since it allows the office structure we propose

supported by an architectural site plan showing the proposed development and
its relationship to surrounding areas as set forth in the application form;

Plan, the applicant shall provide evidence to the City Council's satisfac-
tion that there is an additional need for the requested land classification.
To respond to this criteria, obtain a Comprehensive -Plan Amendment Applica-
tion and submit in conjunction with Rezone Application.

12. Significant changes have occurred in the character, conditions or surround-
ing neighborhood that justify or otherwise substantiate the proposed rezone.
RESPONSE: The land use along Southcenter Blvd. has developed as commercial &
office building and is recommended by the Comprehensive Zoning Plan & 1979
staff planning report. A business corridor, both East & West of the site has
been established, along with road improvements to support it. This is the only
site along that corridor which has been denied commercial use.
13. The proposed rezone is in the best interest of the public health, safety,
and welfare as compared to the hardship, such as diminution of property
value, imposed on the individual property owner.
RESPONSE: The property was purchased with the belief that the Comprehensive Plan
Map indicated the best use of the site as it would benefit the City, public
and private interest.
14. The unimproved subject property is unsuitable for the purpose for which it
has been zoned considered in the context of the length of time the property
has remained unimproved and land development in the surrounding area.
RESPONSE: Traffic noise and activities around the site make it unsuitable for
sin:le -famil housin•. Retention of the .resent zonin• does not make sense
in view of the present business & traffic developments along Southcenter
Boulevard.
