Dear Moira,
Attached are the signed letter of assurance dated May 25, 1989,
our landscaper's plan dated "Received May 26 ", and the City's
approved plan for landscaping of the Duwamish River Trail.
The plant material for the trail, denoted on the Landscape plan as
Phase 2, is purchased and will remain in the nursery until
notification from your office to proceed.
You'll also note that landscaping has been added to the north side
of the debris box enclosure and the diamond -shape planter islands
in the front have been elongated per your requests.
We appreciate your cooperation and agree that phasing the
riverbank landscaping makes sense for everyone. We're looking
forward to the enhancement the river trail will provide to the
Gateway Business Park.

Per my conversation with Moira Bradshaw at the City of Tukwila on 5/2/89, the
following concerns have been expressed by the City.
1. Landscape screening along the perimeter of the site adjacent to the
Duwamish River is required to provide a buffer between parking and
the trail easement per the original landscape plans.
2. A landscape screen adjacent to the north side of the trash enclosure
is required per the original plans.
3. Providing continuous planting islands between trees at the south side
of Building 7 would establish healthier trees. Please see enclosed
sketch.
4. Construction of the City's trail along the Duwamish will begin in
May. A letter of credit for trees proposed to be planted within the
trail easement would allow the City to establish the trail and
coordinate the landscaping at that time.
5. Mechanical screens are required per the design review approval.

To reiterate our telephone conversation on 5/4/89 with regards to the
mechanical unit on Building 7 at Gateway Corporate Center, it is our opinion
that providing mechanical screens would call more attention to the units.
We have painted the mechanical units to match the building color. This option
offers less bulk and less contrast at the roof than a mechanical screen.
We would appreciate it if you could take the opportunity to visit the site at
17720 Gateway Drive, and offer your input on this matter.

We are submitting under separate cover the revised site plan of Gateway Phase
III for staff's review and approval. The revised site plan addresses
modifications per the following conditions of approval from the Planning
Commission Public Meeting on August 27, 1987.
1. 30' easement landward from the 100 year flood elevation of 13.2' is shown
on the revised plan. The location of the easement made it necessary to
relocate the buildings landward from the river.
2. Additional landscape fingerlings have been added on the west and northeast
edges of the parking areas.
3. Additional plantings required shall be shown in the revised Landscape Plan
to be submitted for approval and permit.
In addition to the above revisions, the following revisions were also made to
the site plan.

2. Decrease in total parking from 901 stalls to 884 stalls, providing 4.15
stalls per 1,000 S.F. (Code requires 2.5/1000 S.F. minimum).
3. Revised parking layout to redirect traffic flow and to accommodate the
elimination of one curb cut along Gateway Drive and Building 7 revision.
4. Relocate and enhance loading areas with additional landscape areas.
5. Additional landscape areas are introduced in the interior parking areas.
It should be noted that with the above revisions, the removal of existing trees
remain at the previous number of two, and any shifting of building footprints
are away from the river.
Per our telephone conversation on September 17, 1987, your preliminary contact
with the Department of Ecology indicated a complete resubmittal for the
shoreline permit may not be required. The final determination from the D.O.E.
regarding the revised site plan will come after they have reviewed the plans to
be transmitted by the City.
Please keep us updated on the progress of the review for the revised site plan.

This permit is granted pursuant to the Shoreline Management Act of 1971 and
nothing in this permit shall excuse the applicant from compliance with any other
federal, state or local statutes, ordinances or regulations applicable to this
project, but not inconsistent with the Shoreline Management Act (Chapter 90.58
RCW).
This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the per -

1. Revise Landscape Plan to include the following items subject to final
approval of the Planning Director:
A. Missing landscape island on southwest side.
B. Additional landscape fingerlings on west and northeast edges of parking
areas.
C. Addition of shrubs and deciduous trees along edge of parking adjacent
to river environment to achieve opaque screening.
D. Shrubs around two dumpster enclosures adjacent to river environment.
E. Ten evergreen trees adjacent to northeast elevations of Buildings 7 and
8, and double and vary shrubs shown.
2. Revise site plan to include following items to be approved by Planning
Director:
A. Realign sidewalk between Buildings 7 and 9.
B. Eliminate or consolidate third curb cut. If internal pedestrian and
vehicular circulation of site is affected by change, Planning Director
shall have authority to approve these modifications.
C. Show 30 -foot easement landward from 100 -year flood elevation.
3. Provide color samples for BAR approval.
4. Redesign facades of structure to incorporate mechanical equipment into over-
all design of building.

Notice is hereby given that Kaiser Gateway Associates who is the owner of the
below - described property has filed an application for a substantial develop-
ment permit for the development of four two -story tilt -up concrete office and
research and development buildings with approximately 204,358 square feet
located at 12700 - 12788 Gateway Drive within the SE quarter of Sections 10
and 15 of Township 23 N., Range 4 W.M., in Tukwila, King County, Washington.
Said development is proposed to be within the Green River and /or its associated

submitted their comments and recommendations which are indicated below

A 30' river protection easement granted to Ring County Public Works
is required. The 30' easement shall be measured landward framtthe
top of river bank.
Any work or improvements .to the river bank shall require approval
of King County Public Works- Surface Water Management Division.
These improvements would require a fisheries permit.
Storm water from this site should provide for oil -water separation
prior to discharge into the Duwamish River. The outlet invest
elevations of the storm water outfalls should be above the 100 -year
flood plain elevations.
Please sign both copies on the reverse side as permittee, retain the
original, and return the copy to this department. The permit does not
became effective until said copy is received.

That portion of the C.C. Lewis Donation Claim No. 37 in the northeast quarter of Section 15, and the
Southeast quarter of Section 10, Township 23 North, Range 4 East, Willamette Meridian, in the City of
Tukwila, County of King, State of Washington, and being more particularly described as follows:
' Commencing at a point on the northeasterly margin of the City of Seattle's transmission line right -of -way, at
a point bearing N22 °20'26 "W 1,722.57 feet from the quarter corner between Sections 14 and 15; thence
N48 °13'44 "W along said northeasterly margin 400.00 feet; thence leaving said northeasterly margin
N41 °46'16 "E 824.09 feet to the TRUE POINT OF BEGINNING of the easement to be described herein; thence
from said TRUE POINT OF BEGINNING, from a tangent that bears N18 °52'55 "E along the arc of a curve to
the left having a radius of 190.50 feet and a central angle of 22°33'46 ", an arc length of 75.02 feet; thence
non - tangent to the preceding curve 548 °13'44 "E 21.86 feet; thence N41 °46'16 "E 295.07 feet; thence
N21 °23'49 "E 51.68 feet to a point on the mean high water line of the Duwamish River; thence along said mean
