As stated in those minutes, I officially requested that a copy of my letter to the Planning Commission be included within the minutes. That letter was not attached, and I was wondering if the letter has been included in the official minutes of the meeting. Additionally, I have a concern regarding Condition No. 9 on page 3 of the minutes. I do not know whether the recorded minutes are kept as a separate record or whether these written minutes are the only record. I think that Condition No. 9 was to the effect that the completion of the operational hook -up of the sanitary sewer installed in the street would be planned, budgeted and completed in a timely fashion. Would you please check on what the exact wording was, Becky? This is an important point and I certainly would like it to be clarified if it is not as stated. VanDusen, Mayor March 28, 1986 The Planning Commission, and the Planning Commission acting as the Board of Architectural Review (BAR), at its March 27, 1986 meeting, approved your request.for a Conditional Use Permit (CUP) BAR approval of design for a water reservoir and pump station at 14953 57th Avenue South, subject to the following conditions: 1. Setback the pump station the required 30 feet or obtain a variance from the Board of Adjustment. 2. Construct sufficient interim improvements to allow two way movement along 57th Avenue South for construction equipment and passenger vehicles prior to reservoir construction. 3. Improve the unimproved portion of 57th Avenue South. Improvements shall include curb, gutter, sidewalk, sanitary and storm sewers, and undergrounding of overhead utility lines. 4. Revise Landscape Plan to show an increased tree caliper of 2 ", and a variety of evergreen trees a minimum of 8 feet in height and minimum widths to provide an opaque landscape screen primarily around the southern and eastern perimeter of the site. 5. 57th Avenue South will include both storm and sanitary sewer. 6. The street and utility improvements are to be constructed simulta- neously with the reservoir improvements. It is understood that contractor scheduling must be done to avoid interference between the two contractors, and to the extent possible in light of such sche- duling, the improvements shall be done simultaneously. In any event the street and utility improvement shall be completed immediately upon completion of the reservoir project. ►M C6 Phil Fraser March 28, 1986 Page 2 7. The Public Works Department and its consulting engineers shall consult with adjacent property owners for their input and recommendations during the design of the street and utility improvements. 8. Submit the revised landscape plan to property owners adjacent to the project prior to finalization for their input and recommendations. 9. Sanitary sewer plans and budgeting will be completed in a timely fashion. Per TMC 18.90.030, any person aggrieved by the decision of the Planning Commission, may appeal that decision to the City Council. The appeal shall be made in writing to the City Clerk within ten days of the Planning Commission decision as stated above and shall state the reasons for the appeal. The City Council shall affirm, deny or modify the decision of the Planning Commission within ninety days of the filing of the appeal. The CUP shall automatically expire one year after the date it was granted, March 26, 1986, unless a building permit conforming to plans for which the CUP was granted is obtained within that period of time. A CUP shall auto- matically expire unless substantial construction of the proposed develop- ment is completed within two years from the date the CUP was granted by the Planning Commission. The Planning Commission may authorize a longer period for a CUP, if appropriate for the project. The Planning Commission may grant a single renewal of the CUP if the party seeking the renewal can demonstrate extraordinary circumstances or conditions not known or fore- seeable, at the time the original application for a CUP was granted, which would not warrant such a renewal. No hearing is required for a renewal of a CUP. The Planning Commission may revoke or modify your CUP for any one or more of the following grounds: 1. That the approval was obtained by deception, fraud, or other inten- tional and misleading representations; 2. That the use for which such approval was granted has been abandoned; 3. That the use for which such approval was granted has at any time ceased for a period of one year or more; 4. That the permit granted is being exercised contrary to the terms or conditions of such approval or in violation of any statute, resolution, code, law or regulations; or 5. That the use for which the approval was granted was so exercised as to be detrimental to the public health or safety. Chairman Knudson called the meeting to order at 7:07 p.m. Other com- missioners present were Mr. Sowinski, Mr. McKenna, and Mr. Kirsop. Representing staff were Moira Bradshaw, Rick Beeler, Kathy Stetson and Becky Kent, Planning Department and Jim Haney, City Attorney. The approval of minutes was deferred to the end of the meeting. BOARD OF ARCHITECTURAL REVIEW A. 86 -8 -DR: Office Center Tecton, requesting Board of Architectural Review (BAR) and approval of a two story office building over one level of parking on the northwest parcel of the 65th Street and Southcenter Boulevard intersection. Ms. Bradshaw entered application 86 -8 -DR into the record and summarized the staff report with the addition of Recommendation 4. Revised Landscape Plan showing minimum area requirement and commented that Recommendation 1. include the recommendation for relocation of the loading space. Mr. Larson arrived at the meeting. Rick Jones, Urban Design Group, 210 -18 Gostick Place, North Vancouver, BC, Canada V7M -3G3 requested reconsideration of Recommendation 3. to not allow roof top mechanical equipment. Ms. Bradshaw entered the staff report for 86- 10- DR/86 -9 -CUP into the record and summarized the staff report and clarified that recommendation 3 referred to both sanitary and storm sewer. Byron Sneva, City of Tukwila, Public Works Director, and Ross Earnst, City Engineer, presented graphics and described the reservoir proposal and upgrade of 57th Avenue South. Cris Crumbaugh, 15215 52nd Avenue South, Tukwila, WA attorney representing John and Louise Strander, 15000 57th Avenue South, summarized a letter sub- mitted by the Stranders (Exhibit G), and requested it be included as part of the minutes. He requested additional conditions, as described in the letter be included. Bill Sweeney, 14949 57th Avenue South, was concerned with the exterior finish of the reservoir and asked if it was designed to be earthquake- proof. Mr. Sneva said that the reservoir was designed to earthquake specifications and the exterior finish had not been decided. MR. Jim Haney, City Attorney, and Rick Beeler, Planning Department, arrived at the meeting. BOA ''0 OF ARCHITECTURAL REVIEW A. 86 -7 -DR: Valley View Estates, Puget Western requesting. BAR appro- val of a 108 unit multi - family residential complex on a 7.08 acre parcel located in the southwest quadrant of the 1 -5 /I -405 inter- section, bordered by 53rd Avenue South and Slade Way on the west, Slade Way on the south and I -5 right -of -way on the east. Mr. Haney asked if any of the Board members felt they had a conflict of int-rest for appearance of fairness. Mr. McKenna stated that he voiced an opinion regarding multi- family deve- lop ent in the subject neighborhood at a public meeting that took place in 1977 -79, but felt he could act on the application. Mr. Sowinski stated that he lived within two blocks of the project site. Mr. Kirsop stated that he was a former employee of the insurance brokers fo Puget Power. Mr. Larson stated that he had recently performed some construction work for Jo n MacFarland located at 4375 S. 158th Street. Mr Kirsop stated that his wife signed a petition in opposition to the project. Mr Knudson stated that he had heard opinions for and against the project, bu felt it would not impede his decision - making on the proposal. Mr Kirsop, Mr. McKenna and Mr. Sowinski stated they had received flyers in op osition to the project, but had not been contacted directly by anyone. Mr Kirsop stated he previously attended court defending the City's posi- tisn in a lawsuit involving this project. Di k Goe, 5112 S. 163rd Place, Tukwila, WA, read into the record a flyer da ed March 27, 1986, written by himself, in opposition to the project. This flyer was identified as one of the flyers that several board members received and was entered as Exhibit 1. AGENDA ITEM CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 86- 10- DR/86 -9 -CUP: North Hill Reservoir INTRODUCTION The City of Tukwila is reapplying for a conditional use permit to construct a reservoir at approximately 14953 57th Avenue South to be called the North Hill Reservoir. The Planning Commission approved a conditional use permit on June, 1984 for the proposed use. On June 28, 1985, because a building permit or an extension of the conditional use permit were not applied for, the permit expired. The proposed two (2) million gallon reservoir is an integral part of the City's long range plans for increasing water service in the North Hill area. The prop- erty is bordered on the north, east, and west by single family residences and on the south by multiple family. FINDINGS 1. The subject property is zoned R -1 -12, Single Family Residential, which requires a Conditional Use Permit per TMC 18.64.020(14). The Planning Commission shall be guided by criteria per TMC 18.64.050, in granting a permit. 2. In addition to Planning Commission approval for a Conditional Use Permit, the project shall be reviewed by the Board of Architectural Review (BAR) per TMC 18.60.030(2)(E). The BAR shall use the review guidelines per TMC 18.60.050 in its decision - making. 3. The City of Tukwila has construction drawings ready to submit to the Building Department for a permit and to call for bids for the project. The projected construction schedule is June 1986 to October 1987. The new reservoir will increase the water capacity in the North Hill area and alleviate the potential water supply and existing pressure problems currently experienced by resi- dents. A new twelve (12) inch water main will be constructed in the area and connected to the reservoir. 4. The previous approval, referred to as Alternative Three, was for a reinforced concrete square tank measuring 120' x 112' proposed to be sunk near the existing grade of the easterly portions of the site. This alternative included two (2) tennis courts atop the reservoir tank which required addi- tional parking for the project. A three foot berm was also shown along the east property line. (Exhibit F) 86- 10- DR/86 -9 -CUP: North H''l Reservoir March 27, 1986 Page 2 • 5. The property slopes east to west with an elevation of 265' at the easterly property line and 216' at the westerly property line. Substantial vegetation exists on the property, the majority of which will be removed. The original owner of the property, residing at 14951 57th Avenue South, will continue to live on the adjacent property some 147' north of the proposal's northerly property line. Along the southerly portion of the property is located the recently developed Cottages Apartments (J.B. Wright Corp.). Easterly of the subject property and across 57th Avenue South is located an existing residence at 14952 57th Avenue South. At this residence the street terminates and con- nects with the City trail extending southerly to 152nd Avenue South. West of the subject property is a large parcel occupied by the residence of 14949 57th Avenue South. Access to the proposal will occur via one curb cut at the northeasterly corner of the property. 6. The project will consist of a 118 foot diameter round concrete reservoir that will measure 8 to 10 feet above ground but will have an actual full depth of 29 feet. The pumpstation measures 32' x 46' with a total depth of 29' and varying heights above ground. A 40' x 50' parking area outside the pump - station, located in the northeast corner of the site. (Exhibit A) 7. The site measures 176'x 248' and will be screened with a 6 foot high chain link fence with redwood slats and a gate located in the northeast portion of the site for maintenance access. (Exhibit D) 8. The Comprehensive Land Use Policy Plan indicates the subject property to be in an environmentally sensitive area, particularly owing to the slope of the property, existing vegetation and view from the valley floor. CONCLUSIONS 1. TMC 18.64.050(1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvement in the vicinity or in the district in which the subject property is situated. A soils test on the site revealed that impervious bedrock exists at 38" and 42 ", which would indicate that the site is stable and developable. The devel- opment is intended to be a benefit to the residences located in the North Hill area. The reservoir is needed to assure adequate water pressure and supply for the area. Because the use will be generating marginal traffic, the major impact of the project will be its overall aesthetic and view impacts. The cross sections, elevations, and landscape plan show that the project will be recessed into the hillside and that the majority of the project will be hidden from view. The fence which surrounds the project is six (6) feet high with opaque redwood slats. The landscaping is primarily a variety of deciduous species. The deciduous trees would not be effective screening materials during dormant periods. Therefore, a greater concentration of evergreens should be used 86- 10- DR/86 -9 -CUP: North H}.-" Reservoir March 27, 1986 Page 3 around the entire site. Along the east side of the property, where the pro- ject directly abuts a single family residence, the evergreens should be mini- mum of eight (8) feet in height and spaced to create a natural opaque screen. (Exhibits B, C, D, E) 2. TMC 18.64.050(2) The proposed use shall meet or exceed the performance stan- dards that are required in the district it will occupy. The R -1 district requires a front yard setback of thirty (30) feet, the site plan shows the pumpstation setback fourteen and a half feet. (Exhibit A) The applicant must be granted a variance of fifteen and a half feet from the Board of Adjustment or document that the thirty (30) foot yard requirement is not in keeping with the prevailing yard pattern. Per TMC 18.50,070, the Planning Department may waive the normal requirement and substitute a special require- ment not to exceed average of the prevailing yard patterns on adjacent lots. In lieu of a variance or a prevailing yard pattern less than the requirement, the applicant will be required to setback the required distance. The project meets the other setback and height requirements. Per TMC 18.56.050, the Planning Commission shall determine any parking requirements. The staff feels that, except for a daily maintenance trip, public vehicle travel and use of the facility will not be occurring; there- fore, the parking area shown on the site plan is sufficient to meet any parking demands. 3. TMC 18.64.050(3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed project will be unique in design to the surrounding area, but is a required use to provide adequate water service to the residential uses. The site is located at the termination of a steep privately paved and main- tained driveway which provides access to one residential property. At the top of the drive is City of Tukwila Trail #7 that leads down to 152nd Street. The City's current sidewalk Ordinance No. 1233 excludes sidewalk construction for improvements on property zoned single family. Pedestrian circulation, however, would be improved with the installation of a sidewalk, thereby extending the trail system and creating a missing link. The 57th Avenue public right -of -way is forty (40) feet in width in front of the site. The street will have to be improved by the City to access the reservoir. Current pavement width is approximately twelve (12) feet. Due to the existing road conditions, construction vehicles would not be able to access the site and access to the home would be blocked. Therefore, interim street improvements will have to be made. The City will also be responsible for final street improvements concurrent with the completion of the reservoir 86- 10- DR/86 -9 -CUP: North H }r' Reservoir March 27, 1986 l Page 4 including undergrounding of overhead lines, storm sewers, curb and gutter, and a sidewalk. 4. The proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The following goals and policies from the Plan relate to the proposal: Policy 1. Policy 3. Discourage disturbance of vegetation when not in conjunction with the actual development of the property. Policy 1. Maintain the wooded character of the steep slopes and upland plateau, and encourage the use of vegetation in slope stabilization. (pg. 24, Natural Environment) Strive to retain viable areas of wooded hillsides, agricultural lands, wetlands, streams and the Green River for wildlife habitat. Objective 3. Recognize the advantages and opportunities afforded by the topography and plan its use accordingly. (pg. 25, Natural Environmental) Policy 1. Discourage development on slopes in excess of 20 percent. Policy 2. Preserve the views of hillside residents. Policy 3. Preserve and promote the quality of natural landform. Policy 4. Discourage filling, grading, or excavations of land when not in conjunction with actual development of the land. (pg. 26, Natural Environment) Objective 6. Recognize the characteristics of local geology and consider them in the land use planning process. Policy 1. Discourage development in areas where slopes are known to be unstable. In areas where the stability of slopes is questionable, allow development only after a qualified pro- fessional can demonstrate that slopes will be stable even after site modification. Recognize the environmental basemap of the Tukwila Planning areas which depicts the distribution and extent of natural amenities based on the previously mentioned objectives and use this map as a general planning guide. (pg. 30, Natural Environment) Policy 1. Strive to preserve steep hillsides and wooded areas in a scenic condition. Encourage replanting and revegetation of denuded areas not in the process of development. Policy 6. Discourage single - purpose road construction and improvement projects but coordinate street improvement with those of sidewalks, underground utilities, landscaping, and other as need warrants. (pg. 73) Policy 7 Good design principles should be followed in the construction of new streets. (pg. 7) Objective 6. Create a functional, safe, and convenient sidewalk or pathway system. (pg. 79) Policy 1. Create a sidewalk or pathway system where every link is a part of an integrated network. (pg. 79) Objective 1. Provide an efficient and adequate water supply to the residents and business of the City. (pg. 81) Objective 2. Provide water utility systems which promote planned land use development patterns. (pg. 82) Policy 2. Provide reservoir capacity within the City water system. (pg. 82) The cross sections and elevations show that views as well as the quality of the hillside landform are to be preserved. The proposed reservoir is needed 86- 10- DR/86 -9 -CUP: North Hr Reservoir March 27, 1986 Page 6 to provide the North Hill residential areas with minimum water flows and suf- ficient pressure. Although the hillside is currently densely wooded and a vast amount of vegetation will be removed, the landscape plan shows replanting will occur around the perimeter of the reservoir and pumpstation. The pro- posed caliper of the trees are 1 1/2" to 1 3/4 ". Staff recommends that the minimum caliper be 2" to provide sufficiently mature trees to screen the site. 5. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The possible adverse impacts relate to views and the street improvement. Staff recommends that evergreens a minimum of eight (8) feet in height be used around the entire perimeter of the site, that interim road widening be constructed prior to site improvement and 57th Avenue be improved concurrent with completion of project per City standards with curb and gutter, undergrounding of utilities, a sidewalk, and storm sewer lines. BAR REVIEW GUIDELINES 1. TMC 18.60.050(1) Relationship of Structure to Site. The two structures, round reservoir tank and pumpstation, will be recessed into the hillside. The pump station does not currently meet City setback standards and must either be setback the required thirty feet or be granted a variance from the Board of Adjustment. . 2. TMC 18.60.050(2) Relationship of structure and site to adjoining area. The project exposes its maximum building surface on the west and north eleva- tion. The west and north sides slope steeply downward and will primarily be viewed from surrounding roadways such as I -5 and 152nd Avenue South. The east and south elevations expose a maximum of eight feet of structural surface. The opaque fence and evergreen landscaping will provide appropriate tran- sitions to adjacent properties. Public vehicular access to the site is currently restricted. The public right -of -way is privately improved as a driveway to a single family residence. The conditions as stipulated in Conclusion 5 would be required to provide suf- ficient traffic circulation. 3. TMC 18.60.050(3) Landscape and Site Treatment. The use of the topography to recess the facility into the hill, contributes to the utility of the development and reduces adverse view impacts. The landscape plan, however, needs to be revised to substitute evergreen trees a minimum eight feet in height and a minimum width and distance from each other to provide a natural screen of the project. TMC 18.60.050(4) Building Design. The structures will be constructed of concrete. As was mentioned previously, the structures in the development will not be viewable because they will be recessed into the hillside and /or screened by fencing and landscaping. RECOMMENDATION The staff recommends that the Planning Commission and the BAR approve the requested conditional use permit and grant design review approval of the plans subject to the following conditions. 1. Setback the pumpstation the required 30 feet or obtain a variance from the Board of Adjustment. 2. Construct sufficient interim improvements to allow two way movement along 57th Avenue South for construction equipment and passenger vehicles prior to reser- voir construction. 3. Improve the unimproved portion of 57th Avenue South. Improvements shall include curb, gutter, sewer, undergrounding of overhead utility lines and a sidewalk. 4. Revise landscape plan to show an increased tree caliper of 2 ", and a variety of evergreen trees a minimum 8' in height and minimum widths to provide opaque landscape screen primarily around the southern and eastern perimeter of site. It certainly is not the Strander's practice to retain an attorney in dealing with their own town, however, unfortunately they left for Asia yesterday as part of the Tukwila Sister City Program and have asked me to speak for them here tonight. The Strander's want to make it perfectly clear that they support this much needed city project. At the same time they ask you to recognize the fact that this is a large scale public works project located in a residential district, and special care must be taken to preserve the character of the area and to see that the project is done in accordance with sound planning, environ- mental, and esthetic principles. The Strander's have been in contact with the city adminis- tration regarding the project, support the four recommendations contained in the staff report of March 27th 1986, and ask that each recommendation be specifically included as a condition to this conditional use permit. Since that staff report has been provided to the Strander's they have once again been in contact with the administration and discussed several other matters which they believe need to be incorporated as conditions to the permit. These items are as follows: 1. Clarify staff recommendation Number 3 regarding im- provement of 57th Avenue So. to make it clear that the improvements include both storm and sanitary sewer.
