OF CERTAIN REAL PROPERTY ANNEXED TO THE CITY
AND COMMONLY KNOWN AS THE 51ST AVENUE SOUTH
ANNEXATION, DIRECTING AMENDMENTS TO THE OFFI-
CIAL ZONING MAP OF THE CITY AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 1314 of the City of Tukwila,
passed by the City Council on April 9, 1984, as amended by
Ordinance No. 1334 of the of the City, passed by the City Council
on November 5, 1984, annexed certain territory to the City
commonly known as the 51st Avenue South annexation, the legal
description of which property is hereinafter set forth, and
WHEREAS, since the effective date of the annexation the
City Planning Commission has held at least one public hearing to
determine the proper zoning classification for the annexed prop-
- erty, and
WHEREAS, based upon the input received at the public
hearing, the Planning Commission adopted Findings and Conclus ions
and determined that the annexed property should be zoned R -1 -7.2
in accordance with the official zoning code of the City and has
recommended to the City Council that the said property be so
WHEREAS, the City Council has determined that the pro-
posed zoning is consistent with the orderly development of the
City and with the goals and policies set forth in the City's
Comprehensive Plan and has adopted the Findings and Conclusions
made by the Planning Commission as the Council's own, now,
therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Zoning Established. The following
described property, which was annexed to the City under Ordinance
7.2:

with the zoning established by this ordinance.

full force and effect five (5) days after passage and publication
by posting as provided by law.

Mr. Beeler described the zoning and explained that truck terminals could
only be allowed with approval of a conditional use permit.
Chairman Knudson closed the public hearing.
Ms. Avery asked if there was anyone representing the applicant. The appli-
cant nor a representative were present.
Chairman Knudson asked if there had been any complaints on the other truck
terminals operating on the site. Mr. Beeler stated that complaints
directed towards Profit Freight and a previous operation had been received.
Ms. Poirer indicated she just had a complaint with Profit Freight.
The Commission discussed the environmental review procedure.
MR. SOWINSKI MOVED TO DENY THE REQUEST FOR THE TRUCK TERMINAL. MS. AVERY
SECONDED THE MOTION.
Mr. Larson recommended that the truck terminal use and M -1 zoning be
reviewed. Mr. Beeler explained the process for a Zoning Code revision and
said the "truck terminal" definition revision was on the Planning
Department's work program for 1985.
MOTION PASSED UNANIMOUSLY.
B. 85 -04 -R: 51st Annexation Rezone, requesting rezone of single
family zoned property (RS -7200) to City of Tukwila single family
zone of R- 1 -7.2, on the west side of 51st Ave. So. between So.
161st St. consisting of 3.4 acres. The subject properties bear
the addresses of 16049, 16059, 16209, 16211, 16219, 16;227, 16233,
16239, 16249 51st Avenue South; 4918 South 164th Street, and 4929,
2930 South 161st Street.
Chairman Knudson opened the public hearing.
Ms. Bradshaw summarized the staff report.
Mr. Sowinski stepped down for the duration of this agenda item.
Don McKay, 4812 So. 164th, inquired about any multi - family zoning in the
area of 164th and 49th. Ms. Bradshaw said the area would be zoned single
family.
Chairman Knudson closed the public hearing.

Minutes of the March 28, 1985, Tukwila Planning Commission meeting.
Chairman Knudson called the meeting to order at 8:07 p.m. Other
Commissioners present were Mr. Sowinski, Mr. Coplen, Ms. Avery, and Mr.
Larson. Representing staff were Rick Beeler, Moira Bradshaw and Becky
Kent, Planning Department.
APPROVAL OF MINUTES
MS. AVERY MOVED TO ACCEPT THE MINUTES OF THE JANUARY. 24, 1985, PLANNING
COMMISSION MEETING. MR. SOWINSKI SECONDED THE MOTION WHICH PASSED
UNANIMOUSLY.
PUBLIC HEARINGS
A. 85 -10 -CUP: Profit Freight, requesting approval of a truck termi-
nal at 4477 So. 134th P1.
Ms. Bradshaw summarized the staff report.
Chairman Knudson opened the public hearing.
Elisabeth Springer, 13325 42nd Ave. So., referred to a letter from Edith
Borden protesting the establishment of a truck terminal in this area
because it didn't agree with light industry, and felt the request should be
denied. Ms. Springer said she felt an environmental impact statement
should be required. She was concerned this would become a 24 -hour opera-
tion and was opposed to the truck terminal operation.
Joanne Poirer, 13405 42nd Ave. So., Seattle, WA 98168, listed the dates
and times she had observed the trucks operating on the site during off
hours of the day. She felt an Environmental Impact Statement should be
required, and if the truck terminal was allowed it would encourage other
truck terminals to locate in the complex.
Dana Cole, 15255 Sunwood Blvd., Tukwila, WA, 98188, asked what the zoning
was in the area and suggested the City may want to reevaluate the zoning.

The findings and conclusions of the staff report were accepted.
PLANNING COMMISSION ACTIONS
A. 83 -13 -SPE: Diaz School of Gymnastics, requesting approval of a
cooperative parking agreement.
Mr. Beeler summarized the staff report. He informed the Commission that
the cooperative parking agreement had been signed.
The Commission discussed the current and future parking needs and regula-
tions in that area.
MR. COPLEN MOVED TO APPROVE APPLICATION 83 -13 -SPE: DIAZ SCHOOL OF
GYMNASTICS. MR. LARSON SECONDED THE MOTION.
Mr. Coplen withdrew the motion as no action was required.
BOARD OF ARCHITECTURAL REVIEW
A. DR- O1 -84: Sunwood III, requesting approval of plans for 66
multiple family units.
Mr. Beeler recommended continuance of this item.
MR. SOWINSKI MOVED TO TABLE ANY FURTHER ACTION IN THIS ITEM UNTIL
SUFFICIENT INFORMATION IS AVAILABLE. MOTION DIED FOR LACK OF SECOND.
Jerry Kresovich, Hillis Cairncross Clark & Martin, representing the appli-
cant, said they would not object to a continuance to the next meeting if
there was an understanding that this manner be dealt with in an expeditious
manner.
Mr. Beeler said that the April 11, meeting date would be acceptable to
staff.
Ryan Thrower, President of Sunwood Homeowners Association, requesting the
meeting be held no sooner than one month.
Joanne Hernandez, 15224 Sunwood Blvd., Tukwila, WA 98188, requested a con-
tinuance to May.
MR. LARSON MOVED TO CONTINUE TO THE APRIL 25TH MEETING AND TAKE INTO
CONSIDERATION THAT THE COMMISSION GET ALL THE INFORMATION AND MAKE A
DECISION THAT NIGHT. MR. SOWINSKI SECONDED THE MOTION, WHICH PASSED
UNANIMOUSLY.
B. DR- 03 -85: Metro ETS, requesting approval of 96" buried forcemain
pipeline and bridges over the Duwamish River.

C. DR- 04 -85: NC Machinery, requesting approval of plans for a
2 -story office building located at 17025 West Valley Highway.
Mr. Beeler said the applicants of these proposals requested the Board of
Architectural hold a special meeting on April 11, 1985, to consider the
applications. The Planning Commission agreed to the special meeting date.
Mr. Beeler requested the Commission enter their findings and conclusions
into the record on the denial of application 85 -10 -CUP, Profit Freight.
Mr. Knudson opened the public hearing for 85 -10 -CUP, Profit Freight.
Mr. Sowinski said he felt the truck terminal use was too intense for the
area and would have an adverse effect on the single family neighborhood.
He was concerned with noise, traffic problems and safety.
Mr. Larson stated that it does not conform to.TMC 18.64.050.. The proposed
use will be materially detrimental to the public welfare and injurious to
the property or improvements in the vicinity.
Mr. Knudson closed the public hearing.
CITY COUNCIL ACTIONS
Mr. Beeler reported the status of the SEPA Ordinance revisions, CIP.for-
mulation, and Building Official position.

Introduction
The annexed area encompasses thirteen (13) parcels of property generally
fronting on 51st Avenue S. and bordered on the north by S. 160th Avenue and on the
south by S. 164th Street. The proposal is for a zoning change from the King County
zoning classification of RS -7200, Single Family Residential, to the Tukwila class -
ification of R- 1 -7.2, Single Family Residential.
The proposal is the result of the April 21, 1984 annexation of the subject
properties into Tukwila and the need to make them conform with the City's zoning
a ninance, TMC 18 (Tukwila Municipal Code).
Findings
A. Effects of the Proposal
1. Permitted Uses
A change in zoning from King County to Tukwila Single Family Residential
will change the treatment of as well as decrease the number of uses common-
ly associated with single family neighborhoods.
Tukwila's R -1 districts only permit single family units and public
parks and playgrounds, not including golf courses, amusement parks or
commercial recreation.

Conditional uses include the following:
Churches (not permitted in converted residential buildings
or structures in this district) and community center buildings
Public schools, preschool, elementary, junior high schools, and
private shcools with curricula equivalent to public, elementary or
junior high schools
- Public libraries
Public museums or art galleries
Fire and police stations
Public utility stations or substations
Transit shelter stations
Water towers (Ord. 1247 1(part), 1982).
The existing King County RS -7200 permits,.in addition to single family
units, townhouses and the following non-residential uses:
- Art galleries and museums, when located in a public park or on
a private school site
Churches, provided they meet certain conditions
- Golf courses, private or public, including clubhouses, accessory
driving range, pitch and putt courses, provided they meet
additional conditions.
Schools, elementary, junior high and high, and junior colleges,
public, private or parochial; provided they follow specific
conditions.

- Libraries, publicly operation
- Parks, publicly owned and operated
- Day nurseries, under certain conditions.

Whereas many of the uses listed for both municipalities are similar,
the City of Tukwila would require most of the non - residential uses to
apply for a Conditional Use Permit, which requires a public hearing and
Planning Commission approval.
Except for golf courses and townhouses, which would not be permitted
after a rezone of the area, the nonresidential uses listed above as
permitted in King County would be conditional uses in Tukwila. The
purpose of Tukwila's conditional use process is to establish review and
permit approval procedures for unusual or unique types of land uses
which, due to their nature, require special consideration of their impact
on the neighborhood and land uses in the vicinity.
2. Height, Setback and Yard Requirements
In addition to the changes in use, there would be slight changes in
height, setback and yard regulations. As the table below outlines,
Tukwila's R -1 -7.2 district is less restrictive in lot width by 10 feet
and more restrictive in front and rear yard setbacks, 10 and 5 feet
respectively.

3. Conformance
Exhibit A shows the subject properties and their dimensions. Each
lot meets the minimum lot area requirement of 7200 square feet. Based on
the requirements of the proposed Tukwila zoning classification, R- 1 -7.2,
and on the standards of the existing King County classification, the
existing density of the area could be increased by one additional lot.
Existing nonconformance in setbacks or yard requirements, (which
could only be determined through a survey of the properties), would be
grandfathered in; however, the property owner would be prevented from
any future expansion that would increase the degree of the subject non-
conformance.
B. Stability of the District
Existing Tukwila zoning on the west side of I -5 is exclusively R -1 -12.0
and R- 1 -9.6, single family residential. The R -1 -7.2 classification would be
a precedent for the area because it would essentially permit a smaller minimum

lot size of 7200 square feet. To extend the existing Tukwila R -1 -9.6 district
located in the northeast section at the S. 160th and 51st corner of the block,
would make three lots located in the southeast section at the corner of S. 164th
and 51st nonconforming as to lot size.
Because of the recent McMicken Heights annexation, effective February 28,
1985, and its proposed rezone in April 1985, the R -1 -7.2 classification will
become a necessary zoning district due to existing lot sizes.
The proposed R -1 -7.2 classification for the McMicken area will become a
large zoning district that will abut the subject properties in the 51st Avenue
annexation. It would seem appropriate therefore, to introduce the R- 1 -7.2"
district on the west side of 51st Avenue and rezone the subject properties
accordingly.
The lots to the north, south, east and west of the subject properties are
all zoned with a single family classification and if developed, contain single
family units. The majority of the lots are developed and together create a
stable single family neighborhood. The proposed zoning amendment would
maintain and reinforce the existing zoning, character and conditions of the
surrounding neighborhood.
Only one lot, on the 51st Avenue /164th Street corner is undeveloped.
No change in the property's potential would result because of the proposed
rezone.
Compatibility with Comprehensive Land Use Plan
The proposed rezone from King County RS -7200 to Tukwila R -1 -7.2 maintains
single family land use and is in accordance with Tukwila's Comprehensive Plan.

D. Environmental
A final Declaration of Nonsignificance was issued for the proposed zoning
amendment.
Conclusions
A. The annexation of the lots into Tukwila makes it necessary for the area to
conform with the City's zoning ordinance TMC 18. The proposed zoning is the
most equitable and compatible zoning classification for the existing uses,
to existing King County zoning and to surrounding uses and zoning.
B. No change to existing physical development will result due to the proposed
change.
C. The proposed zoning reclassification is in conformity with the City's
Comprehensive Land Use Policy Plan, the provisions of Title 18 of the Tukwila
Municipal Code and in general will serve the public interest. Specifically,
the proposed reclassification is consistent with the following goals and
policies of the Comprehensive Land Use Policy Plan:
1. General Goals: Goal 1 (p. 12).
2. Residence: Objective 1, Policy 3 (p.
D. The proposed zoning reclassification has been supported by site plans showing
the proposed rezoning and its relationship to surrounding areas. The proposed
zoning is consistent and compatible with surrounding zoning and development.
E. The proposed reclassification is compatible with the City's Comprehensive

Land Use Policy Plan. The applicant is therefore not required to demonstrate
need for the request pursuant to Section 18.84.030(3) of the Tukwila Municipal
Code.
Summary
The Planning Commission may wish to recommend approval of the zoning reclassi-
fication from King County RS -7200 to Tukwila R -1 -7.2 Single Family Residential for
the thirteen parcels known as the 51st Avenue annexation.

Approximately 3.48 acres were annexed into the City of Tukwila. The City must now
conduct a rezone of the subject property. City regulations require that all property
owners within a 300 foot radius be notified of such.a request. Attached is a map
outlining the area and a list of the plats, lots, and municipal addresses, when and if
available, of the subject properties. We are requesting the names and addresses of
each of the property owners.
In order to allow adequate time for notification of the property owners, we will need

WHEREAS, Ordinance No. 1314 was passed by the City Coun-
cil of the City of Tukwila, Washington, on April 9, 1984 annexing
certain territory to the City commonly known as the 51st Avenue
South Annexation, the legal description of which property was set
forth on Exhibit A to said ordinance, and
WHEREAS, the City has received a request from King
County to reformulate the the legal description of the property in
accordance with. conventions of the County governing the formula-
tion of legal descriptions, which change in legal description will
not affect the actual boundaries of the property annexed, now,
therefore
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO.
ORDAIN AS FOLLOWS:
Section 1. City of Tukwila Ordinance No. 1314, passed
by the City Council on April 9, 1984, is hereby amended by
deleting the legal description set forth on Exhibit A to said
Ordinance No. 1314 and substituting in its place the legal de-
scription of said property which is set forth on Exhibit A.to this
ordinance.
Section 2. This ordinance shall be in full force and
effect five (5) days after passage and publication as provided by
law.

WASHINGTON, at a regular meeting thereof this day of

WHEREAS, the City Council, at its regular public
meeting of April 2, 1984, held a public hearing for the pur-
pose of considering a petition for annexation of certain
property hereinafter described, and at the conclusion of said
hearing having determined that the property commonly known as
the 51st Avenue South Annexation more particularly described
in Exhibit A, attached hereto and incorporated in full by
this reference, which property is contiguous to the existing
corporate limits of the City, and is a logical extension of
the City limits, should be annexed to the City, subject to
approval by the King County Boundary Review Board, or waiver
of the Board's jurisdiction, now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
. DO ORDAIN AS FOLLOWS:
Section 1. The territory commonly known as the 51st
Avenue South Annexation, more particularly described on Ex-
hibit A, attached hereto and incorporated in full by this
reference, should be, and is made a part of the City of Tuk-
wila, subject to approval of said annexation by the King
County Boundary Review Board or waiver of jurisdiction of the
Board.
Section 2. Pursuant to the terms of the annexation
petition, all property within the territory annexed hereby
shall be assessed and taxed at the same rate and on the same
basis as property within the City, including assessments or
taxes in payment of any bonds issued or debts contracted
prior to or existing as of the date of annexation.
