Chairman Goe opened the public meeting at 8:03 p.m. Other Board members present were Rick Beeler, Moira Carr Bradshaw, and Becky Kent, Planning Department. MS. WHEELER MOVED TO ACCEPT THE MINUTES OF THE DECEMBER 13, 1984, BOARD OF ADJUSTMENT MEETING. MS. ALTMAYER SECONDED THE MOTION WHICH PASSED. r MS. PUBLIC HEARING A. 85 -07 -V: Litho Development, requesting a variance from landscaping requirements of TMC 18.52.020. Ms. Carr Bradshaw summarized the staff report. The Board asked staff about landscaping and parking on the site. Ms. Carr Bradshaw identified areas on an overhead. Chairman Goe opened the public hearing at 8:24 p.m. Lance Mueller, 130 Lakeside, Seattle, WA 98122, representing the appli- cant, described the reasons for the parking layout. Chairman Goe asked what type of business Litho Development was. Mr. Mueller described it as being retail with no manufacturing. Chairman Goe asked about truck maneuverability on the site, contents of the building and type of landscaping to be used on the west side of the pro- perty. SETBACK VARIANCE Board of Adjustment April 4, 1985 Mr. Mueller indicated access will be off Strander Boulevard, the contents of the building would include printing equipment and suggested an evergreen type hedge would be used. John Cody, Litho Development, described the use of the building as pri- marily retail with no manufacturing and felt there would not be a parking problem. Chairman Goe closed the public hearing at 8:42 p.m. Chairman Goe asked if fire access is adequate. Ms. Carr Bradshaw indicated about half the setback would be eliminated. Chairman Goe opened the public hearing at 9 :05 p.m. John R. Keyes, 15438 West Valley Highway, representing the owner, explained there was not sufficient support in the existing building to support a second floor, therefore, requiring columns. He said the pavement on S. 158th would remain and he described the planting plan for the site. The agenda was changed t delete the request for parking variance on this application as it does meet the parking requirements of TMC 18.56. Page 3 Board of Adjustment April 4, 1985 Ms. Altemayer inquired as to why the structural supports couldn /t be put on the inside of the building. Mr. Keyes indicated that it would not be feasible becauser the building would have to close down at time of. construction. Chairman Goe closed the public hearing at 9:30 p.m. The board discussed the depth of the greenbelt along West Valley Highway, the setbacks, and future expansion of SR 181 and how it will affect the subject property. C. 85 -12 -V: Northwest Volvo White Truck Center, requesting variance from TMC 19.32.140 Mr. Beeler summarized the Staff report. The Board discussed access and distance to the site, and visability. David Weldy, applicant, explained the limited visibility of the wall - mounted sign existing on the building, said the purpose of the larger freestanding sign is because of the obstructions from the road way. Ms. Altmayer asked what the objection to not building the sign within the code. Mr. Weldy explained that the manufacturer doesn't make the sign that meets the sign code. Chairman Goe closed public hearing at 11 :00 p.m. William Kline, Meyer Sign Co., 512 Minor Avenue, Seattle, WA explained that the sign manufacturer sets the size of the sign and this is the smallest sign they produce. Chairman Goe declared this item void as a result of Mr. Weldy withdrawing his variance request. CITY COUNCIL ACTIONS Mr. Beeler reported on.the status of the Metro Effluent Transfer System, the hiring of a permanent full time inspector, advertisement for an Associate Planner position, Tukwila Pond Site, Capital Improvement Program, Urban Form Study, and a possible Long Range Traffic Study. TUKWIL Beeler Secretary BLK F ADJUSTMENT CITY OF TUKWILA PLANNING DIVISION BOARD OF ADJUSTMENT' STAFF REPORT AGENDA ITEM IV)B Management Investors Introduction Management Investors, Inc. is requesting variances from TMC (Tukwila Municipal Code) 18.50.020 Setback Regulations and 18.52.020 Landscaping Requirements to permit the addition of a second story to their existing building. Findings 1. The applicant is proposing to add a second story to the Goodman Building which is located at the corner of West Valley Highway South and South 158th Street. The property is located in an M -1 Light Industrial District. The existing building has 4222 square feet of office space and is nonconforming in regards to setback and landscaping on both street frontages. The proposed second story addition of 4792 square feet will expand the footprint of the building by 1 foot on the east side and the south (S. 158th Street) and by 2 feet on the north side and the west (West Valley Highway). Sufficient parking exists for the proposed office expansion. The expansion complies with building height requirements of TMC 18.50.020. 2. Per TMC 18.50.070(4), "In the case of corner lots, a front yard of the required depth shall be provided (25 feet)...and a second front yard of half the depth required generally for front yards in the district shall be provided on the other frontage (12.5 feet)." (Parentheses added). Since the narrowest width of the lot is generally considered the front yard, a building setback of 25 feet is required along the West Valley Highway. The Second front yard setback of 12.5 feet would be along S. 158th Street. The applicant is proposing a 3 foot front yard setback along West Valley Highway and a 5 foot front yard setback along S. 158th Street. Therefore variances of 22 feet and 7.5 feet are required and requested respectively. 3. Per TMC 18.52.020 (Landscape Requirements), landscaping shall be a minimum of 15 feet along both streets. Unlike building setback requirements, TMC 18.50.020 does not provide for the one -half landscape setback along the "second front yard." Therefore, the applicant is requesting a 15 foot variance along West Valley Highway and S. 158th Street. Management Investors Page Two Conclusions Variance Criteria TMC 18.72.020 1) "The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located." 4. The existing building was constructed in 1968, and at that time, front and side yard setbacks were not required. Buildings were approved provided the distance from the center line of the street to the building was not less than thirty feet for normal service streets and 40 feet for designated arterial streets. 5. The applicant must bear the final responsibility of substantiating that conditions exist which comply with the Variance Criteria listed in TMC 18.72.020. Because of the few commercial structures in the area, a comparison with the proposal is difficult. A visual survey of the area, while not precise, revealed the following information. The northerly adjacent building does not appear to meet the requirements of the code in regards to current landscaping and building setbacks. The easterly adjacent structure, Boone Paints , appears to have met the front yard landscaping and building setback requirements, but not the second front yard & landscaping requirements. The southerly structure across S. 158th Street meets the setback requirements but not the landscaping requirements. In granting the requested variance, the Board would be allowing the applicant to increase the height of his structure while not significantly increasing the degree of nonconformance. In addition, a variance would not appear to be inconsis- tent with the setbacks of other properties in the area. 2) "The variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located." The proposed building expansion is restricted by the size of the lot (100 ft x 153 ft) and the existing nonconforming location of the building. Two adjacent buildings on the north and east property lines and the two abutting rights -of -way prevent expansion in conformance with existing setback requirements. Therefore, the only alternative is to add a second story. Granting the variances would provide the applicant with a privilege permitted in the vicinity and zone and is necessary due to the special circumstances regarding its size, location and surrounding uses. Master Land Use Application The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated." Due to the current lack of landscaping and the proposed small 1 and 2 foot expansions around the perimeter of the building, granting a variance would not appear to cause detriment to the public welfare or injure property or improvements in the area. 4) "The authorization of such variance will not adversely affect the implementation of the Comprehensive Land Use Policy Plan." In addition to the proposal, the planned expansion of West Valley Highway to seven lanes and the possible expansion of S. 158th Street, will decrease the amount of landscaping and building setback areas along these streets. The cumulative visual impact, therefore, will be a decline in the quality of the visual environment and diminishment of open space on the subject property. Thereques;ted variances however will not appreciably affect the Comprehensive Plan. 5) "The granting of such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity." The granting of the requested variances is necessary for the applicant to expand the existing building in a manner which is available to other property owners in the area.
