WASHINGTON ORDINANCE NO. 154-C CITY OF TUKWILA AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, ANNEXING CERTAIN REAL PROPERTY COMMONLY KNOWN AS THE 51ST AVENUE SOUTH BE- TWEEN SOUTH 164th AND SOUTH 166th ANNEXATION, CITY FILE NO. 85 -28 -A, PURSUANT TO THE DIRECT PETITION METHOD SET FORTH IN RCW CHAPTER 35A.14; REQUIRING SAID PROPERTY TO BE ASSESSED AND TAXED AT THE SAME RATE AND UPON THE SAME BASIS AS OTHER PROPERTY WITHIN THE CITY; REQUIRING SAID PROPERTY TO BE SUBJECT TO THE COMPREHENSIVE PLAN; DIRECTING THE CITY CLERK TO FILE A CERTIFIED COPY OF THIS ORDINANCE WITH THE COUNTY COUNCIL; AND FIXING THE EFFECTIVE DATE OF THE ANNEXATION. WHEREAS, a Notice of Intent to Annex, signed by owners of not less than ten percent in value, acording to assessed valuation for general taxation of the property for which annexation is sought, was received on May 16, 1985 and on June 3, 1985, the City Council of Tukwila met with the petitioners, which was within sixty (60) days of receipt of said Notice of Intent to Annex, and determined that the City would accept the proposed annexation as expanded by the City Council, require assumption of existing indebtedness, and authorized the circulation of a petition for annexation, and WHEREAS, said proposed annexation was reviewed in accordance with the State Environmental Policy Act and a Determination of Non - Significance was issued on June 30, 1985, pursuant to that Act, and WHEREAS, a legally sufficient petition pursuant to RCW 35A.14.120, signed by the owners of at least 75 percent of the assessed value of the land seeking annexation to the City was subsequently filed with the City on June 28, 1985, and WHEREAS, said proposed annexation was submitted to the King County Boundary Review Board pursuant to RCW Chapter 36.93, and said Board waived review of the proposed annexation at a public meeting on September 26, 1985, and follows: WHEREAS, said property to be annexed is contiguous to and is a logical extension of the City's corporate limits in light of circulation, topography, drainage and other City services, and said annexation is consistent with the provisions of the Tukwila Comprehensive Plan, and WHEREAS, the City Council held a public hearing on September 23, 1985, pursuant to notice published in a newspaper of general circulation in the City and posted notice in at least three public places within the territory proposed for annexation, and at the conclusion of said hearing determined that said property should be annexed to the city, now therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The real property commonly known as the 51st Avenue South between South 164th and South 166th Annexation, City file no. 85 -28 -A, more particularly described as This annexation lies in the southwest of the northeast * of Section 27, T23N,R4E, Beginning at the northeast corner of said Section 27; thence north 88 °42'41" west, 30 feet to the northerly extension of the westerly margin of 51st Ave. South; thence south O1 °03'56" west along said west margin 1351.6 feet more or less to its intersection with the southerly margin of South 164th Street and the TRUE POINT OF BEGINNING; thence north 88 °42'38" west 175.51 feet; thence south 0 °15'50" east, 580.80 feet; thence south 89 °59'10" east along the northerly margin of South 166th Street, 175.24 feet to the westerly margin of 51st Ave. South; thence northerly along said west margin to the TRUE POINT OF BEGINNING. should be and is hereby annexed to and made a part of Tukwila. Section 2. Pursuant to the terms of the annexation petition, all property within the territory annexed hereby shall be assessed and taxed at the same rate and on the same basis as other property within the City, including assessments for taxes in payment of any bond issued or debts contracted prior to or existing as of the date of annexation. Section 3. Said property, pursuant to the terms of the petition filed herein, shall be subject to the City's Comprehensive Plan. BY • Section 4. Chairman Knudson called the meeting to order at 8:00 p.m. Other Commissioners present were Mr. Kirsop, Mr. Orrico, Mr. Larson and Mr. Sowinski. Representing staff were Brad Collins, Moira Carr Bradshaw and Becky Kent, Planning Department. CITY COUNCIL ACTIONS Mr. Collins briefed the Planning Commission on the McMicken Heights compre- hensive plan amendment and rezone, and the Windmark Homes appeal. PUBLIC HEARING A. 85 -23 -R: 51st Annexation between S. 164th and S. 166th Streets, requesting rezone of King County zoning classification of RS -7200 (Low Density Residential) to City of Tukwila zoning classification of R -1 -7.2 (Single Family Residential) located in the first 175.24 feet lying west of 51st Ave. S. between S. 164th St. and S. 166th St. Mr. Sowinski excused himself from consideration of this item. Ms. Bradshaw summarized the staff report. Chairman Knudson opened the public hearing. Ben Angland, 16427 51st Avenue S., inquired about the setbacks of the sub- ject properties. Ms. Bradshaw explained the setback requirements. Chairman Knudson closed the public hearing. MR. KIRSOP MOVED TO ACCEPT THE FINDINGS AND CONCLUSIONS OF THE STAFF REPORT AND RECOMMEND TO THE CITY COUNCIL THAT THE AREA BE ZONED R- 1 -7.2. MR. LARSON SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. ORRICO MOVED THAT THE BOARD OF ARCHITECTURAL REVIEW APPROVE THE MINI - STORAGE FACILITY WAREHOUSE, APPLICATION DR- 12 -85, BASED UPON THE FINDINGS AND CONCLUSIONS OF THE STAFF REPORT, AND APPLY THE FIVE CONDITIONS LISTED IN THE REPORT. TO: The City,Council City of Tukwila Civic Center City of Tukwila PETITION FOR ANNEXATION TO THE CITY OF TUKWILA, WASHINGTON WE, the undersigned, being the owners of not less than seventy -five percent (75%), in value (according to the assessed valuation for general taxation), of the real pro- perty described on Exhibit "A" attached hereto, lying contiguous to the City of Tukwila, Washington, do hereby petition that such territory be annexed to and made a part of the City of Tukwila under the provisions of RCW 35A.14.120, et seq., and any amendments thereto, of the State of Washington. The territory proposed to be annexed is within King County, Washington, and is described on Exhibit "A," attached hereto. At a regular meeting of the Tukwila City Council, June 3, 1985, a formal motion was made by the Council to accept the proposed annexation and authorized the circulation of a petition for annexation. On June 26, 1985, the petition was received by the City and was sub- sequently certified to be in correct form with signatures of property owners of at least seventy -five (75) percent of the assessed value of the area. As required by the provisions of RCW 36.93, a Notice of Intention is hereby given by the City of Tukwila to annex, by the petition method, the terri- tory generally referred to as the 51st Avenue South Annexation Between South 164th and South 166th Streets. We have attached the required review information as stipulated in RCW 36.93.170. The subject annexation encompasses an area whose assessed value is less than $800,000 and less than ten (10) acres; therefore, the City requiests a written reply as soon as possible should the Board decline review of this matter. South Between South 164th and South 166th Streets by the petition method under the provisions of RCW 35.13.125, 35.12.130, 35.13.140, 35.13.150, 35.13.160, and 35.13.170. 51st Avenue South Annexation Between South 164th and South 166th Streets 9. A. 1. Population 15 (approximate) 2. Acreage 2.3 acres 3. Population density 6.52 /acre 4. Per capita assessed value $34,860 (Total assessed value $522,900) B. Eight single family residential units are developed in the area and no change in land use is anticipated. C. 1. The area is in the City of Tukwila Comprehensive Land Use Plan which was adopted in April 1982. 2. The City does not have a franchise for this area nor do we anticipate requesting a franchise amendment to cover the area in the near future. 3. The current Highline Community Plan designates the area as single family. Possible changes and the recently adopted King County Comprehensive Plan do not change or directly affect the proposed annexation area. 4. See C3. 5. Current King County zoning of the area is RS -7200 Single Family Residential. 6. The property is within a local sewer service area in the King County Sewerage General Plan, adopted 1 /15/79 by Ordinance #4035. D. The area measures 580.8 feet on 51st Avenue South and approxima- tely 175 feet on South 164th and 166th Street. The area is rela- tively level with a slight increase in slope west from 51st Avenue South. It lies within the Green River Drainage Basin. No other significant topographic features exist in the subject area. E. No significant growth is projected for this area. The City pro- jects a possible increase of two single family dwelling units for the area or a population increase of approximately 4 people during the next ten year period. The proposal lies within Census Tract #283 which had a 1980 popu- lation of 2903. The estimated 1981, 1982, and 1983 population of CT 283 was 2888, 2882, and 2869, respectively. Future projections are not available as this area has been combined with nine other census tracts to form the Riverton Forecast Area Zone (FAZ). -4- -5- 51st Avenue South Annexation Between South 164th and South 166th Streets F. The City of Tukwila does not plan to extend sewer or water service to the area. Police protection would be provided at the time of official annexation and would come from the Tukwila Police Department at 6200 Southecenter Boulevard. Fire District 24 will continue to provide protection through January 1986 at which time a decision will be made to either contract with Fire District 24 to continue to provide protection or to extend the City's fire protection service from 444 Andover Park East or from a new station located more advantageously to the area. Tukwila would also assume road and storm water maintenance. Maintenance service would be provided from the City Shops at 600 Minkler Boulevard. G. The current location of community facilities which service the area include: 1) the Tukwila City Hall and Police Station located approximately one mile to the northeast; 2) the fire station located approximately 2 miles to the east; 3) the Tukwila Library located approximately 1 mile to the northeast; 4) the Tukwila Community Center located approximately 1 mile to the north. Various parks, including the Foster Golf Links, are located 2 -3 miles away. In addition, a new eleven (11) acre park is being constructed two blocks from the annexation area at the junction of South 160th Street and 51st Avenue South. H. 1. Present "municipal" services available to this area: a) Val Vue Sewer District provides sewer service; b) Fire District #24 provides fire protection; c) Water District #75 provides water; and d) King County provides street main- tenance, emergency and administrative services. At present, King County provides police patrols for the west side of 51st Avenue South. Tukwila patrols the east side of the street. Storm sewer facilities consist of surface drainage and culverts in existing rights -of -way. Water is provided to the properties by Water District #75 through a 4" line on 51st Avenue South, and a 6" line on 164th Street. Sanitary sewer is provided by the Val Vue District in an 8" line in 51st Avenue South and South 164th Street. 2. King County ordinances such as the Comprehensive Land Use Plan, Zoning Code and Capital Improvement Program would be supplanted by the Tukwila Comprehensive Plan, Zoning Code, CIP and the City's Municipal Code. Other governmental codes such as SEPA would be duplicated by Tukwila. 3. Appeal was filed by World Wide Cargo Services, Inc. Attorney Haney explained that these hearings are quasi judi- cial proceedings because Council is determining the rights of specific parties. The two choices are: (1) Remand the matter to the Planning Commission or (2) Council may proceed to consider the matter as if they were the Planning Commis- sion and determine the matter. Eight single family residential units are developed in the area and no change in land use is anticipated. C. 1. The area is in the City of Tukwila Comprehensive Land Use Plan which was adopted in April 1982. 2. The City does not have a franchise for this area nor do we anticipate requesting a franchise amendment to cover the area in the near future. 3. The current Highline Community Plan designates the area as single family. Possible changes and the recently adopted King County Comprehensive Plan do not change or directly affect the proposed annexation area. 5. Current King County zoning of the area is RS -7200 Single Family Residential. 6. The property is within a local sewer service area in the King County Sewerage General Plan, adopted 1/15/79 by Ordinance #4035. D. The area measures 580.8 feet on 51st Avenue South and approxima- tely 175 feet on South 164th and 166th Street. The area i? rela- tively level with a slight increase in slope west from 51st Avenue South. It lies within the Green River Drainage Basin. No other significant topographic features exist in the subject area. E. No significant growth is projected for this area. The City pro- jects a possible increase of two single family dwelling units for the area or a population increase of approximately 4 people during the next ten year period. The proposal lies within Census Tract #283 which had a 1980 popu- lation of 2903. The estimated 1981, 1982, and 1983 population of CT 283 was 2888, 2882, and 2869, respectively. Future projections are not available as this area has been combined with nine other census tracts to form the Riverton Forecast Area Zone (FAZ). 51st Avenue South Annexation Between South 164th and South 166th Streets F. The City of Tukwila does not plan to extend sewer or water service to the area. Police protection would be provided at the time of official annexation and would come from the Tukwila Police Department at 6200 Southecenter Boulevard. Fire District 24 will continue to provide protection through January 1986 at which time a decision will be made to either contract with Fire District 24 to continue to provide protection or to extend the City's fire protection service from 444 Andover Park East or from a new station located more advantageously to the area. Tukwila would also assume road and storm water maintenance. Maintenance service would be provided from the City Shops at 600 Minkler Boulevard. G. The current location of community facilities which service the area include: 1) the Tukwila City Hall and Police Station located approximately one mile to the northeast; 2) the fire station located approximately 2 miles to the east; 3) the Tukwila Library located approximately 1 mile to the northeast; 4) the Tukwila Community Center located approximately 1 mile to the north. Various parks, including the Foster Golf Links, are located 2 -3 miles away. In addition, a new eleven (11) acre park is being constructed two blocks from the annexation area at the junction of South 160th Street and 51st Avenue South. H. 1. Present "municipal" services available to this area: a) Val Vue Sewer District provides sewer service; b) Fire District #24 provides fire protection; c) Water District #75 provides water; and d) King County provides street main- tenance, emergency and administrative services. At present, King County provides police patrols for the west side of 51st Avenue South. Tukwila patrols the east side of the street. Storm sewer; facilities consist of surface drainage and culverts if existing rights -of -way. Water is provided to the properties by Water District #75 through a 4" line on 51st Avenue South, and a 6" line on 164th Street. Sanitary sewer is provided by the Val Vue District in an 8" line in 51st Avenue South and South 164th Street. 2. King County ordinances such as the Comprehensive Land Use Plan, Zoning Code and Capital Improvement Program would be supplanted by the Tukwila Comprehensive Plan, Zoning Code, CIP and the City's Municipal Code. Other governmental codes such as SEPA would be duplicated by Tukwila. 3. Review Board for the following reasons: 36.93.180(1): Preservation of natural neighborhoods and communitie 36.93.180(7): Adjustment of impractical boundaries 36.93.180(8): Annexation of unincorporated areas which are urban in character The annexation of the subject area is the logical extension of the City's boundary to include the lots which front on the westerly rigit- of -way margin of 51st Avenue South. 51st Avenue South from South 130th Street to South 166th Street is within Tukwila's jurisdiction. To include property on both sides of the street would clarify service from police and other municipal agencies to the area. To extend the boun- dary would also enhance the sense of community for those who are currently in unincorporated King County and the neighborhood commonly referred to as Crestview.
