HomeMy WebLinkAboutPermit DR-10-85 - SOUTHCENTER DAYCARE - DESIGN REVIEW 345 ANDOVER PARK EAST Permit DR-10-85 - SOUTHCENTER DAYCARE - DESIGN REVIEW CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT DR- 10 -85: SOUTHCENTER DAY CARE AGENDA ITEM INTRODUCTION Southcenter Day Care has applied for a conditional use permit, in a C -M zone, at 345 Andover Park East. The proposed location has a nonconforming side yard landscape area and, therefore, per TMC 18.70.090, must conform to the standards or receive BAR approval of any modifications to the requirements of TMC 18.52.020. FINDINGS 1. Per TMC 18.70.090 (Nonconforming landscape areas), when a change of use is proposed for a structure, on a piece of property which does not comply with the requirements of the Zoning Code, a landscape plan which substantially con- forms to the requirements, shall be submitted to the BAR for approval. The Board may modify the standards when, in their judgment, the existing and pro- posed additional landscaping and screening materials together will adequately screen or buffer possible use incompatibilities, soften the barren appearance of parking areas, and /or adequately enhance the premises appropriate to the use district and location of the site. 2. Per TMC 18.52.020 (Landscape requirements by zone district), in a C -M zone, five feet in side yard landscaping is required. 3. The nonconforming area was formerly used for six parking spaces and is covered with asphalt paving. The proposed site plan for the day care center (Exhibit A) indicates the elimination of about four of the parking spaces due to the location of the outdoor playground. No landscaping of the asphalt area along this south property line has been proposed or is existing. CONCLUSIONS In reviewing any application, the following guidelines, per TMC 18.60.050, shall be used by the BAR in its decision making: 1. Relationship of Structure to Site 2. Relationship of Structure and Site to Adjoining Area Due to the noticeable curve in Andover Park East, directly in front of this site, the south property line, the lot's side yard, is highly visible while travelling north along Andover Park East. The required five feet of landscaping would provide desirable transition and screening between the parking area, play area and adjacent property, and would be consistent with the provision of lanscaping by the majority of all property owners in the zone. 3. Landscape and Site Treatment As mentioned above, the required landscaping would enhance the vista while tra- velling along Andover Park East and could provide shade in the outdoor play area for the children. The site plan does not show landscaping that would substantially conform with the requirements of the code. Nor would the existing landscaping along the adjoining property's side yard or the small band of landscaping along the wall of the subject building be adequate to buffer, soften or screen the difference in use being proposed for the pro- perty, from the surrounding commercial industrial properties. Landscaping would enhance the premises and is appropriate given the cor)for- mance of surrounding properties with the code and given the intensive use of the site both indoors and out by the general public and the children of the day care center. RECOMMENDATION Based upon the above, the staff recommends that the Board of Architectural Review deny the plan as submitted in Exhibit A.
