WHEREAS, on April 3, 1984, a petition calling for an election to vote upon the annexation of certain unincorporated territory contiguous to the City of Tukwila was filed with the office of the King County Prosecuting Attorney, and WHEREAS, pursuant to RCW 35A.14.020, the prosecuting attorney certified the petition as being sufficient on April 23, 1984, and transmitted the same to the• City Council of the City Tukwila on that date, and WHEREAS, the City Clerk the City of Tukwila has determined that the signatures on the petition are sufficient and has filed a certificate of sufficiency of the petition with the City Council, and WHEREAS, less than 60 days have passed since the filing of the certificate of sufficiency, and WHEREAS, the City's SEPA Responsible Official has determined that there will be no significant adverse environ- mental impacts as a result of the proposed annexation, and WHEREAS, the City Council has, in Resolution No. 907, previously expressed its support for the proposed annexation and has determined to approve such annexation pursuant to RCti 35A.14.020, now, therefore, THE CITY. COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. Aoaroval of Annexation. The City Council hereby approves the proposed election method annexation to the City of Tukwila of the property located within the McMicken Heights area generally bounded as follows: ceC n.n.nc at the intersection C_` the Tukwila City limits and the south cht -c_`- 'tea'_' marcin of State Hichway 518; thence westerly aicnc said south richt -of -way i;larci n of State Highway 518 to the east riaht -of -way marcin of 42nd Ave South; thence south along said east richt-of -way margin of 42nd Avenue South to the south richt -of -way margin of South 164th Street; thence east .alone said south richt -of -way marcin of South 164th Street to the Tukwila City limits; thence northerly along said Tukwila City limits to the south right -of -way margin of State Highway 518 and to the becinninc. ' and requests that an election be held within the proposed annexation area on the question of whether or not said area should be annexed to the City of Tukwila. Section 2. Assessment and Taxation in Annexation Area. Pursuant to RCW 3.A.14.020, the City Council hereby requires that there also be submitted to the electorate of the. territory.to be annexed a proposition that all property within the area to be annexed shall, upon annexation, be assessed and taxed at the same rate and on the same basis as property within the City of Tukwila is assessed and taxed to pay for all or any portion of the outstanding indebtedness of the City, including assessments for taxes in payment of any bonds issued or debts contracted prior to or existing as of the date of annexation. Section 3. Notification of Petitioners. The City Clerk is hereby directed to mail one copy of this resolution to each of the •petitioners signing the petition for election filed with the City. - 1 -iD - frAA,1 . 0 • Section 4. WHEREAS, the City Council has been advised that the owners of certain property within the McMicken Heights area, more particularly described hereinafter, have filed a peti- tion for annexation of said property to the City of Tukwila pursuant'to the election method, and WHEREAS, the City Council feels it is appropriate to express its support for the proposed annexation and its intention to accept the annexation, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON HEREBY RESOLVES AS FOLLOWS: The City Council hereby expresses its support for the proposed annexation of the property located within the McMic- ken Heights' area generally bounded as follows: Beginning at the intersection of the Tukwika City limits and the south right -of -way margin of State Highway 518; thence westerly along said south right -of -way margin of State Highway 518 to the east right -of -way margin of 42nd Ave South; thence south along'said east right -of -way margin of 42nd Avenue South to the south right -of -way margin of South 164th Street; thence east along said south right-of-way margin of South 164th Street to the Tukwila City limits; thence northerly along said Tukwila City limits to the south right -of -way mar- gin of State Highway 518 and to the beginning. Due to the state law requirements this annexation will not be on the September primary election ballot. Therefore, we would appreciate every assistance you can provide to place the annexation on the November general election ballot. King County staff has been very helpful in advising us of state law requirements and processing deadlines. The Boundary Review Board will decide on September 14, 1984 whether or not to take jurisdiction, although the deadline occurs for filing a King County Council Resolution placing the annexation on the November ballot. Therefore, to permit the affected people to vote on the annexation will require special consideration by the Council. The annexation petitioners are very interested in seeing this annexation go to vote in the eventuality that the Highline Incorporation does not pass at the September election. • We respectfully request your introduction of a resolution to the Council to place this annexation of the November ballot subject to: 1. Boundary Review Board notification of approval or not taking jurisdic- tion by October 5, 1984. 2. City of Tukwila paying all costs for hand- striking the ballots should qualification for the ballot not occur. Acknowledging the uniqueness of this request, our intent is merely to allow the few hundred people effected by this annexation to vote on the issue while voting this November. A special election, while possible, is less desirable in that these people can vote quickly following the settlement of the Highline incorporation issue. The current population of this 185 acre parcel is approximately 450 voters. There is a population density of 4.1 voters per acre and an average assessed valuation of $60,000 per residential property. B. The area is mainly single family residences with a few retail and ser- vice°establishments at the southern edge of 164th and Military Road. As yet, there are no significant anticipated changes in land use. C. 1. The area lies within Tukwila's comprehensive planning area. Tukwila's Comprehensive Plan was adopted by ordinance on March 16, 1982. 2. Tukwila has no franchise in the area. It does not anticipate requesting a franchise amendment to cover the area in the near future. 3. The current Highline Community Plan designates the area primarily as single family (King County zoning = RS 7200) and neighborhood. business (King County zoning = BN). Some multi - family (King County zoning = RM 900) had been tentatively indicated, but as of 5/11/81, the King County Council was unable to agree upon the extent and location multi - family zoning in the overall McMicken area. It remains (7/84) under consideration . 4. See C.3. 5. See C.5. 6. The property is within a local sewer service area in the King County Sewerage General Plan, adopted 1/15/79 by Ordinance #4035. D. The topography slopes somewhat downward from north to south. It lies within the lower Green River Drainage Basin. E., The projected population growth of the area is likely to be small as the area is primarily designated for low- density single family and is developed accordingly. Pending resolution of multi - family issues by the King County Council, some of the area may be designated multi- family.. • The proposal lies within Census Tract #282 which had a 1980 population of 2571. The estimated 1981 and 1982 population of CT 282 was 2691 and 2670 respectively. Future projections are not available as this area has been combined with nine other census tracts to form the Riverton Forecast Area Zone (FAZ). The City of Tukwila had a 1980 population of 3505 with the 1990 projec- tion of 4001 (PSCOG 3/84; FAZ 3900). Total Tukwila employment was 20,930 in 1980 with a 1990 projection of 29,508 (PSCOG 3/84; FAZ 3900). F. Upon annexation, the City of Tukwila would be responsible for the area's police and fire protection. Police protection would come from the Tukwila Police Department at 6200 Southcenter Boulevard. Fire pro- tection would be based in the Tukwila Fire Department at 444 Andover Park. East. Tukwila would also take oven road and storm sewer main- tenance. Maintenance service would be provided from the City Shops at 600 Minkler Boulevard. No problems are anticipated in serving the area. G. The current location of community facilities serving the area include: 1) the Tukwila City Hall and Police Station located approximately one mile to the northeast; 2) the fire station located approximately 2 -2i miles to the east; 3) the Tukwila Library located approximately 11 miles to the northeast; 4) the Tukwila Community Center located approximately 1 mile to the north. Metro Rates The City -Metro charges as required by the Agreement for Sewage Disposal between the Municipality of Metropolitan Seattle and the City of Tukwila is set at the sum of $7.00 per residential customer and $7.00. per residential customer equivalents (900 cubic feet equal one residential equivalent) for multiple dwelling and commericial /industrial accounts (1984 rates for METRO). Standby Charges The rate for fire protection lines (building sprinkler systems) shall be deemed service charges and shall be, for any one month or fractional part thereof, as follows: Size Service Charge 2" $ 6.00 3" 9.00 etc.... Provisions for providing sanitary sewer lines would need to be negotiated. 4. No other municipal entity is capable of providing subject service to the area. 5. At such time as major roadway improvements become necessary, electrical utility wiring will be undergrounded in conformance with the rest of Tukwila. Eventually, sewage service will need to be upgraded to include pipes and lines to the northern portion of the area. 6. Costs of service provision may decrease due to Tukwila's strong sales tax base. Level of service may increase slightly due to the proximity of service facilities. 7. The proposal will reduce the population of King County by approxi- mately 450 voters. This reduction, however, is problematic as the , annexation area under consideration is in the proposed Highline Incorporation area.
