Minutes of the August 2, 1984 meeting.
The meeting was called to order at 8:05 p.m. by Chairman Goe.
Other members of the Board present were Mrs. Regel and Mrs. Wheeler.
Representing staff was Rick Beeler, Planning Department.
APPROVAL OF MINUTES
The minutes of the April 5, and May 3, 1984 meetings were approved as read.
PUBLIC HEARINGS
84 -05 -V: Bon Marche (Allied Stores), variance of 3' from the side
yard landscaping requirement of TMC 18.52.020.
Mr. Beeler stated the applicant had requested withdrawal of the application
and would be submitting landscaping plans in conformance with the Zoning
Code.
84 -24 -V: H.M. Shepard, variances of 4' from the front yard building
setback and 5' from the rear yard building setback of TMC 18.50.020
and the non - tandem parking requirement of TMC 18.56.040(4)(A).
Mr. Beeler reviewed the staff report.
Chairman Goe opened the public hearing.
Mr. H.M. Shepard presented the application and similar circumstances of
adjacent and nearby properties. The ability to subdivide the property was
precluded by building setbacks of the Zoning Code.
Alternative site plan configurations regarding compliance with parking and
building setback requirements were discussed. Mr. Shepard requested post-
ponement of the Board's decision in order to discuss alternatives with
staff. Chairman Goe continued the item to September 6, 1984 at 8:00 p.m.
for consideration on the regular agenda.

tenant sign on an existing freestanding Pavilion Outlet Center
shopping center identification sign.

Mr. Beeler read the staff report.
Chairman Goe opened the public hearing.
Cindy Ness, Meyer Sign Co., reviewed the application and reasons for the
Pavilion Outlet Center giving special consideration to the Marshalls
department store, the new "anchor tenant" of the shopping center. She
expressed an alternative sign, "Marshall's Pavilion Outlet Center," could
replace the existing Pavilion Outlet Center freestanding identification
sign.
Discussion occurred of the advertising method and impact for the new
Marshalls store, the existing site plan and building layout of the Parkway
Plaza and Pavilion Outlet Center developments, and traffic along
Southcenter Parkway and So. 180th Streets.
Chairman closed the public hearing.
MRS. WHEELER MOVED THAT THE GRANTING OF THE VARIANCE WOULD BE A SPECIAL
PRIVILEGE AND WOULD BE INCONSISTENT WITH THE SIGN CODE AND WOULD GRANT A
SPECIAL PRIVILEGE SINCE THIS IS A MALL. MRS. REGEL SECONDED THE MOTION,
WHICH CARRIED UNANIMOUSLY.
MRS. REGEL MOVED THAT THE VARIANCE IS NECESSARY BECAUSE OF SPECIAL
CIRCUMSTANCES RELATING TO THE SIZE, SHAPE, TOPOGRAPHY, LOCATION OR
SURROUNDINGS OF THE SUBJECT PROPERTY TO PROVIDE IT WITH USE RIGHTS AND
PRIVILEGES PERMITTED TO OTHER PROPERTIES IN THE VICINITY AND IN THE ZONE IN
WHICH THE SUBJECT PROPERTY IS LOCATED. THE MOTION DIED FOR LACK OF A
SECOND.
MRS. WHEELER MOVED THAT THE VARIANCE IS UNNECESSARY BECAUSE OF SPECIAL
CIRCUMSTANCES, BECAUSE IT APPEARS TO BE A SPECIAL PRIVILEGE THAT OTHER
APPLICANTS DO NOT HAVE. SIZE, SHAPE, AND TOPOGRAPHY HAVE NOTHING TO DO
WITH THE VARIANCE. MRS. REGEL SECONDED THE MOTION WHICH CARRIED
UNANIMOUSLY.
MRS. WHEELER MOVED THAT GRANTING OF THE VARIANCES WOULD NOT BE DETRIMENTAL
TO THE PUBLIC WELFARE OR INJURIOUS TO PROPERTIES. MRS. REGEL SECONDED THE
MOTION WHICH CARRIED UNANIMOUSLY.
MRS. WHEELER MOVED THAT THE SPECIAL CONDITIONS AND CIRCUMSTANCES PROMPTING
THE VARIANCE DID NOT RESULT FROM THE ACTIONS OF THE APPLICANT. IT IS
PRE- EXISTING BEFORE THE APPLICANT CAME. MRS. REGEL SECONDED THE MOTION
WHICH CARRIED UNANIMOUSLY.
MRS. WHEELER MOVED THAT THE VARIANCE GRANTED REPRESENTS THE LEAST AMOUNT OF
DEVIATION FROM THE PRESCRIBED REGULATIONS. MRS. REGEL SECONDED THE MOTION
WHICH PASSED UNANIMOUSLY.
MRS. WHEELER MOVED THAT THE GRANTING OF THE VARIANCE SHALL RESULT IN
GREATER CONVENIENCE TO THE PUBLIC IN IDENTIFYING THE BUSINESS LOCATIONS FOR

SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY.
Chairman Goe declared the variance had not passed.
MRS. REGEL MOVED THAT THE VARIANCE BE DENIED BASED UPON THE CRITERIA
APPROVED. MRS. WHEELER SECONDED THE MOTION WHICH WAS APPROVED UNANIMOUSLY.
COUNCIL ACTIONS
Me. Beeler briefly reviewed the Council's consideration of revisions to the
City's environmental ordinance. He reviewed the status of the Urban Design
Study Phases I and II. The Pacific Northest Bell variance public hearing
concerns were summarized relative to requested input from adjacent resi-
dents.
OTHER BUSINESS
Chairman Goe requested that staff check the City Attorney on the variance
criteria relative to procedure if the first variance criteria is found in
the negative.

AGENDA ITEM
INTRODUCTION
Recently Marshalls department store located in the Pavilion Outlet Center at the
intersection of S. 180th St. and Southcenter Parkway. The store was granted sign
permits to place a building mounted identification signs at the northwest and
southwest corners of the Pavilion Outlet Center building. The store is now
requesting additional identification on the existing Pavilion Outlet Center iden-
tification sign located at the intersection, which requires a variance from the
sign code.
FINDINGS
1. In March 1984, Marshall's was granted two sign permits for 52i square foot
signs on the south and northwest faces of the Pavilion Outlet Center building
(Exhibit A). In order to increase identification in the Pavilion Outlet
Center, Marshall's is requesting a variance to permit identification on the
existing freestanding Pavilion Outlet Center identification sign at the inter-
section of Southcenter Parkway and S. 180th St.
2. TMC 19.32.150 prohibits individual freestanding identification signs for
buildings within the Pavilion Outlet Center. The existing freestanding
Pavilion Outlet Center identification sign is permitted.
3. Marshalls proposes to construct a 3i' x 15', double -faced and internally illu-
minated sign displaying "Marshalls" below the existing "Pavilion Outlet
Center" message on the existing freestanding identification sign (Exhibit B).
This 52.5 square foot sign requires a variance, for which an application was
filed with the City on June 12, 1984 (Exhibits C and D).
"The variance as approved shall not constitute a grant of special privi-
lege which is inconsistent with the intent of this Sign Code nor which
contravenes the limitation on use of properties specified by the zoning
classification in which this property is located."
TMC 19.04.020(A) states the purpose of the Sign Code to be order, safety and
"minimizing clutter and distraction." The combined intent of TMC 19.04.020(A)

and TMC 19.32.150 is to reduce the visual clutter of signs that potentially
could occur by identification of each tenant in a building on freestanding
signs along Southcenter Parkway. To identify shopping centers or buildings
containing tenants by a name for the center or the building appears to be the
overall intent of the Sign Code. No other planned shopping center mall has
tenants identified on the freestanding signs for the center. Granting of the
variance would set a precedent for other planned shopping center malls to seek
individual tenant identification on freestanding signs along Southcenter
Parkway.
2. Variance criteria TMC 19.12.060(B):
"That the variance is necessary because of special circumstances relating
to the size, shape, topography, location or surroundings of the subject
property to be provide it with use rights and privileges permitted to
other properties in the vicinity and in the zone in which the subject
property is located."
The building mounted identification signs for Anders Clothing Center,
Marshalls and Sam Heller Clothing Store are located on the northwestern corner
of the building, setback from the most westerly portion of the building.
Between this indentation and Southcenter Parkway is located the Bon Marche
Home Store. Motorists traveling south on Southcenter Parkway are unable to
see the Anders, Marshalls, and Sam Heller signs until they reach the north-
westerly entrance to the Pavilion Outlet Center parking lot, directly due west
of the three stores. The freestanding Pavilion Outlet Center sign is visible
to the motorists at least two or three blocks north on Southcenter Parkway.
Other independent businesses along Southcenter Parkway are setback approxima-
tely the same or more from Southcenter Parkway and have their direct visual
access blocked by other buildings. Therefore, it appears that the variance
may confer a special privilege on the applicant inconsistent with the "rights
and privileges" of other independent businesses along Southcenter Parkway.
3. Variance criteria TMC 19.12.060(C):
"That the granting of the variance will not be materially detrimental to
the public welfare or injurious to property or improvements in the vici-
nity and in the zone in which the subject property is located."
The design of the sign would not appear to cause any physical detriment or
injury to the Pavilion Outlet Center or other properties. Perhaps it could be
argued that some "material" injury to other tenants of the Pavilion Outlet
Center (Anders, Sam Heller, etc.) would occur in giving special preference to
Marshalls for identification on the existing Pavilion Outlet Center
freestanding sign. Reasonably, this precedent and privilege could be claimed
by the other tenants of the center. In turn, this could lead to clutter and
distraction which would be detrimental to public welfare.

4. Variance criteria TMC 19.12.060(D):

"That the special conditions and circumstances prompting the variance
request do not result from the actions of the applicant."
The design and site plan of the Pavilion Outlet Center was established a few
years before the Marshalls tenancy in the center. The specific retail space
in the center was agreed upon by Marshalls and the property owner. However,
these physical conditions of the property, particularly the obstruction of
direct view of the adjacent Bon Marche store on the same property were beyond
the actions of the applicant.
5. Variance criteria TMC 19.12.060(E):
"That the variance as granted represents the least amount deviation from
prescribed regulations necessary to accomplish the purpose for which the
variance is sought and which is consistent with the stated intent of this
code."
The proposed length of the Marshalls sign fits within the existing posts sup-
porting the Pavilion Outlet Center freestanding sign. The height of the
Marshalls sign exceeds the height of the smallest letters and is close to the
largest letters of the Pavilion Outlet Center message on this sign.
Therefore, the variance appears to not be the minimum needed.
6. Variance criteria TMC 19.12.060(F):
"That granting of the variance shall result in greater convenience to the
public in identifying the business location for which a Sign Code
variance is sought."
While the existing freestanding Pavilion Outlet Center sign is visible a few
blocks north of the center, the sign is located at the intersection of S.
180th St. and Southcenter Parkway. This presents some confusion to the
motorist in identifying the northwesterly access point to the Pavilion Outlet
Center. However, this was a conscious decision on the part of the property
owner in siting this sign.
Due to the obstruction of direct visual access by the Bon Marche Home Store,
greater convenience in terms of quicker motorist visual recognition of the
Marshall's store presence will occur if the proposed variance is granted.
However, this contravenes the intent of the Sign Code to reduce visual clutter
along Southcenter Parkway and rely on shopping center and /or building iden-
tification signs in lieu of prolific listing of individual tenants in the cen-
ters or buildings.
7. Variance Criteria TMC 19.12.060(G):
"That the granting of variance will not constitute a public nuisance or
adversely affect the public safety."

Based upon the above staff recommends the variance be denied.

It does not appear that the impact of the proposal will produce an adverse
impact on public health, safety and welfare. It is probable that the sign may
increase the public safety by providing increased recognition of the presence
of Marshalls in the Pavilion Outlet Center. However, the public's awareness
of the Marshalls department store can reasonably be increased by the media
advertisements specifying location at the Pavilion Outlet Center in the City
of Tukwila. This would appear to satisfy the primary locational requirements
for the Marshalls tenancy and other tenants of the Pavilion Outlet Center.

Dear Mr. Beeler and the distinguished members of the Tukwila Planning Commission:
It is with deep regret that I am unable to attend the July 5 hearing regarding
Marshalls addition to the Pavilion Outlet Center Pylon Sign.
I would like to begin by stating that Marshalls is a company devoted to the
growth and development of shopping centers similiar to the Pavilion Outlet
Center. Marshalls is a national retailer'with an unblemished reputation
for both customer and community relations. We are extremely sensitive to
the needs of the surroundings and in opening a new location , we attempt
to, enhance the visual, physical, and economic qualities of the centers in
which we are located.
As you well know, the Pavilion Outlet Centex has been very successful in .
improving both the physical and economic environment of the area. In order
for the store, and the center as a whole to prosper, we rely upon the visibility
that both the pylon and building signs afford us. Due to the lack of exposure
from the Southcenter Parkway, the pylon is essential to the recognition and
success of Marshalls and the Pavilion Outlet Center.
'I request that in the best interest of both the community and the economic •
growth of the Pavilion Outlet Center, that you seriously consider Marshalls'
addition to the pylon sign.
