Dear Mr. Kellogg:
By way of introduction, I am with the Tukwila Planning Department and am
working on restoring the adjacent property to conformance with zoning
requirements. Perhaps you have seen the progress made to date or heard
reports from your tenant, Blue Heron Fishery. A great improvement has been
made in the condition of the site.
Your property is subject to the same zoning requirements which were first
imposed in 1972 in Ordinance No. 743, adopting your existing zoning, and
the building permit for your building. The requirements pertain to
landscaping, outdoor storage and parking. During my review of your neigh-
bor's property, I became aware of your property also not meeting those
requirements. My estimate is that corrections can be quickly and easily be
made.
Please call me at 433 -1847 within two weeks to discuss the situation and
restoration of the site.

Dear Sir:
A complaint was recently filed with the City regarding the small area of
oil drums stored outside your building and near the paved access road.
While this is a very minor matter, I am still required to bring it to your
attention for quick resolution.
Section 18.40.020(16), Tukwila Municipal Code and Sections 9 and 14,
Ordinance No. 743 (which rezoned your property to its current zoning)
require this outdoor storage to be screened by a fence or landscaping. The -
obvious alternative is to remove the oil drums.
By June 30, 1986, please submit to the Planning Department a plan for the
outdoor storage or remove the drums from the site. Failure to do so could
constitute a violation of the Zoning Code and imposition of a penalty.
Because of the minor nature of the matter, I am confident that resolution
can be achieved by the above date.

The Starrow Enterprises part of this property is nearly cleaned up per
Ordinance No. 743. Your efforts have made a commendable improvement in the
appearance of the building. This is appreciated by the community.
We are also making similar requests for clean up of the Blue Heron Fishery
and Structural Instrumentation parts of the property. The Fishery is
required to restore landscaping and remove or house their outdoor storage.
Structural Instrumentation is only required to remove or house their small
outside area of oil drum storage.
My purpose in writing you is to make you aware that these requests are
being made.

The purpose of this letter is to follow up on Mr. Rick
Beeler's letter to Michael Smith dated May 9, 1986. As Mr. Beeler
indicates in his letter, I have been monitoring the landscaping
and screening violations on the above referenced site for a
considerable period of time. While there has been considerable
progress made on the site of late, there continue to be
significant violations of the Tukwila Zoning Code and Ordinance
No. 743 which rezoned the property from R -1 to M -1.
Section 5 of Ordinance No. 743 and Section 18.52.030(3) of
the Tukwila Municipal Code require side yard landscaping on your
site. While it is my understanding that you have installed some
landscaping on the site, there is still no landscaping along the
side of the building. In addition, Sections 5, 9 and 14 of
Ordinance 743 and Section 18.52.040(2) of the Tukwila Municipal
Code require that all outdoor storage areas on your site be
appropriately screened. It is my understanding that to date you
have not constructed that screening.
Please be advised that the City does not wish to have to take
legal action to force compliance with its ordinances. The City
appreciates the recent progress which has been made on the site.
The City remains concerned, however, about the time that it is
taking to clear up the last of the violations. Obviously, the
City cannot wait forever. To that end, unless you install the
required side yard landscaping and screen all outside storage and
dumpsters in accord with the provisions of the Tukwila Municipal
Code and Ordinance No. 743 within thirty days from the date of
this letter, I will be forced to advise the City to pursue all
legal remedies it has. I trust you will take the reasonable

Dear Mr. Smith:
On May 8, 1986, I inspected the site and confirmed installation of
landscaping per your plan of November 11, 1985. This landscaping made.a
significant positive impact on the site.
Still to be resolved is landscaping along the side of the building and
around the outdoor storage. The rezone application you are developing for
the adjacent property has not been submitted, therefore, the side yard
landscaping remains an issue. Because materials and a dumpster are still
stored outside of the building, their screening is required.
A copy of this letter is being sent to the City Attorney who continues to
review this matter. He may also contact you about the landscaping.
Your efforts in correcting an unsightly and nonconforming situation have
helped and are appreciated. Hopefully, the rest of the landscaping can be
installed quickly.

This letter is formal notice that the matter of the . site development
compliance, pursuant to earlier conversations, is being referred to the City
Attorney for action per the Tukwila Zoning Code. Michael L. Smith assured
me that the required work would be accomplished by the end of January,
1986. As of February 28, 1986, this work has not been accomplished. In
fact, additional debris continues to be deposited along the southerly side
of the building and a large trash container is now located on the easterly
side of the building.
More than a reasonable time period has been allowed for resolution of this
matter since the first notice to Floyd Darrow on November 5, 1984.
Therefore, this matter is now in the City Attorney's hands for final
resolution.

We have reviewed your concerns with regard to the subject site. We, too,
are concerned about the appearance of the site and intend to improve it.
Based upon our observations and several discussions with you we propose
the following remedial action:
1. Cleanup of debris in the front and side yards of the site;
2. we understand you are primarily concerned about the front and
side yard landscaping. Attached is a plan to replace the
original plant materials in those locations that have since been
lost;
3. The side yard adjacent to the existing residence will be
cleaned of debris. Mr. Halvorson presently owns this adjacent
property and intends to rezone it to an Industrial
classification consistent with the comprehensive plan. This
would ultimately negate the need for screening along this side
yard area. Therefore, we hope that you will concur that
landscaping this area is not necessary at this time.
We will be contacting you prior to and after completion of this work, so
that City approval can be achieved.

After receiving a phone call from you last week, after not hearing
from you for so long, asking when the landscaping would be installed,
I was a little taken aback.
I had believed that we were in compliance with the ordinance, and
had been awaiting word from you as to the zoning of the adjoining
property, which'as you know, is also owned by Mr. Halvorson.
In view of the fact that Mr. McLees has demolished the building
directly behind our building, and thus caused a serious drainage
problem, I had also asked you what we would need to do in order to
be allowed to use asphalt on a portion of the section directly
behind the building, and had also been awaiting word from you.
In view of the fact that we must address the issue of drainage prior
to the winter rainy season, and also because of your request for
compliance with the existing landscape design, or submittal of a
revised design, we have engaged Mr. Michael L. Smith of Pacific Land
Resources, to handle the matter of drawing up a revised plan, to
include some drainage solution as well. I know that you are acquainted
with Mike, and he will no doubt be in contact with you soon.

I have discussed your concerns as respects the landscaping and
"debris" problems with Mr. Darrow, the tenant in the above named
building.
I was astounded to learn that, contrary to what we might have believed,
the "debris" which had been scattered on the side of the building was
not carelessly thrown there, but was put there to create an emergency
drainage field. They had a very serious problem with water runoff
from the property directly behind the building, and were faced with
6 inches of water in the building, and diversion of this water from
the runoff down the hill. This situation was caused, I learned, by
the fact that Mr. McLees had bought the property directly behind our
property, and proceeded to buldoze the structure as well as the
terrain's vegetation, without a permit to do so.
Needless to say, this has caused a great deal of damage and trouble
to our maintenance of this property. We feel that there should be
equal application of the law as respects the maintenance of properties
within the boundaries of the City of Tukwila. If we are required
to comply with all regulations and ordinances, it seems that Mr. McLees
should also. Both Mr. Lindell and Mr. Darrow have spent a great
deal of time this past winter, working on attempting to divert some
of this water runoff which was flooding our building, and for which
flooding Mr. McLees's actions are responsible.
Of course, it is our intention to remove the debris which is located
on the side of the building, as well as a number of items which you
mentioned to me at the front of the building. Mr. Darrow has agreed
to work with us on this project. Since he has been out of town for
a great deal of time recently, this has necessarily been postponed
some. I assure you that we, along with Mr. Darrow, have every

Dear Mr. Darrow:
My previous letter of November 19, 1984, outlined the requirements for
bringing your development into conformance with applicable City ordinances •
and regulations. Specifically, Ordinance No. 743 and the Zoning Code re-
quire substantial improvement of your development to coincide with the
approved site plan.
Since potential violation of the Zoning Code exists, thereby possibly
accruing civil penalties, please call me at 433 -1847 to resolve the matter.
If progress is not made on resolution by December 21, 1984, this matter
will be turned over to the City Attorney. Hopefully, this can be avoided.
Should you not own the property you occupy, please give your landlord
copies of this and my previous letter.

We have lived in Tukwila 7 years and have mentioned these problens to both the prnperty
owners and to city hall, but to no avail.
All you have to do is drive by the building mentioned and it is obveious where acime of
,the problens are originating. The dumpster area is a real eye sore besides the fact
there is loose fiberglass there that gets into the air. A large auanity of fiberglass h

Dear. Citizens:
On November 1, 1984, your complaints were handed to me to research. I have
established the above file for convenience in future correspondence and
fact finding. Several departments, including the City Attorney, have been
appraised of your concerns and will participate in final resolution.
I contacted the Puget Sound Air Pollution Control Agency to assist in the
odor problem. Their regulations and those of the City can be applied to
the situation. It appears the Agency is equipped to accurately measure the
odors, which we are not able to do. Therefore I suggest calling the agency
at 344 -7330 when you observe the odors. As soon as possible the Agency
will radio - dispatch an inspector to assess the situation and possibly issue
a violation citation. Thereafter the agency will coordinate with us on
resolution of the problem.
I will be visiting the property during the week of November 5, 1984, for
first -hand observations.
Your input and complaints are being treated confidentially as much as
possible.

will radio - dispatch an inspector to assess the situation and possibly issue
a violation citation. Thereafter the agency will coordinate with us on
resolution of the problem.

Dear Mr. Darrow:
Several citizens have complained about odors emitted from your manufac-
turing operations and about the condition of development on the site rela-
tive to conditions imposed when the property was rezoned. Therefore we are
following City policy by reviewing the rezone record and the City's
nuisance ordinance.
Please call me at 433 -1847 to discuss the basis of the complaints and their
ramifications for your operation. At this time we are merely fact finding.
Inspection service by the Puget Sound Air Pollution Control Agency is
available to anyone experiencing odors from your building. This can occur
in response to any complaint given to the Agency. The complainants were
notified of this agency's jurisdiction.

the above named building is in the City of Tukwila, and is

You indicate in that letter that the landscaping /screeing
requirements of "TMC 18.52" apply relative to restoring the'
property in compliance with the zoning code. During our con-
versation by phone of the same date your letter was written,
I indicated to you that I needed a publication on this particular
law, and hoped that you would send a copy of such, or indicate
to us where we might locate same. I would greatly appreciate
your doing this, in order that we may be aware of that which

The review of our records indicate that the single family residence south
of this building lies in the City of Tukwila and is zoned single family
(R- 1 -20). Therefore, the landscaping /screening requirements of TMC
18.52 apply relative to restoring the property to compliance with the
zoning code. In this instance, TMC 18.52.030 (3) requires a solid planting
screen 10 feet wide of a height of 5 to 8 feet or construction of a fence
per review and approval of the Planning Department. This requirement is in
addition to the other landscaping requirements of TMC 18.52.
As I mentioned in our meeting of May 29, 1985, the City is seeking quick
resolution of the landscaping and screening requirements of the property as
well as overall cleanup of the site. Therefore, it is requested that a
landscaping plan for the site be submitted per the requirements of TMC
18.52 by July 1, 1985. As soon as possible following the receipt, we will
review the plan and render a decision on its adequacy. This time period
should not be construed to hinder or obviate the clean up of the site in
preparation for implementation of the landscaping plan. The City will
expect the landscaping plan to be implemented by July 31, 1985.

On May 14, 1985, I mailed the attached letter to Mr. Elling Halvorson
regarding this matter. Hopefully he is able to offer a quick solution to
clearing up this property. I thought you should be aware of the City's
pursuit of the matter.
Complaints continue to be received regarding discharge of fiberglass odor
and /or dust into the air. Therefore, danger to the public health and
welfare appears to exist and could very likely cause action to demonstrate
compliance with air quality standards.
Please be apprised that the City will be requiring cleaning up the site and
restoration to the originally approved development plans or new approved
plans within a short time frame from my meeting with Mr. Halvorson.

Dear Mr. Darrow:
On November 16, 1984, I visited your business to inspect the condition of
the overall site pursuant to the complaints we have received. Unfortunately
I missed you.
A comparison of the site plan approved with the building permit for your
building, the conditions of rezoning the property to the current M -1 zone and
the current zoning code indicates substantial discrepancies and noncompliance
exist. These requirements included a lot of landscaping, fencing, screening
and control of outdoor storage. Many of these requirements have not been met.
Therefore, it is requested that the site be brought into conformance with
the originally approved site plan, Ordinance No. 743 and the Zoning Code. An
alternative is submittal of a revised site plan for our review and approval
per Ordinance No. 743 and the Zoning Code. Since the, issue appears to not be
a matter of public health or safety, please submit a schedule for bringing the
site into conformance and /or a revised site plan for our review and approval
by December 3, 1984.
For your convenience I have attached a copy of Ordinance No. 743 and the
original site plan with earmarked pertinent issues. I have also included for
informational and awareness purposes the enforcement and penalty section of
the Zoning Code.

AN ORDINANCE RE- CLASSIFYING CERTAIN PROPERTY
FROM R -1 ZONING TO M -1 ZONING WITHIN THE
CITY OF TUI:WILA.
WHEREAS, The owners of the following described rropert_
have petitioned the Planning Commission requesting re- classification
of said property from R -1 zoning to M -1 zoning in conformity with
the comprehensive plan, and
WHEREAS, Public hearings on said petition were held
before the Planning Commission of the City of Tukwila, and the City
Council having received a favorable recommendation from the Planning
Commission with respect to the aforementioned petition; and
WHEREAS, The City Council finds the requested classi-
fication to be in furtherance of the public health, safety and
general welfare,
NOW, THEREFORE, The City Council of the City of
Tukwila, Washington, do ordain as follows:
That the following described real property is hereby
classified as M -1 in accordance with Ordinance No. 251 of the
City of Tukwila, as amended, and the City Council hereby adopts
the attached map showing said classification for the real property
described as set forth in Exhbit A attached hereto, subject to
the following conditions:

4. Necessary public rights-of-way shall be
dedicated to the public either as a portion of
a plat or upon acceptance of street dedication
by the City Council.
5. To protect the abutting contiguous uses,
a protective strip of land bordering the external
boundaries and along any frontage on public rights -
of -way and devoted to the planting, cultivation,
growing, and maintenance of sight - obscuring trees,
shrubs and plant life shall be established and
maintained. The maintenance guarantee of such
protective strips and the planned landscaping of
the site may be bonded to the city in a reasonable
amount if required by the City Council. In lieu
of such protective strip, under appropriate circum-
stances, there may be substituted a use classifica-
tion of the outer margin of this district consistent
with or not objectionable to the use classification
of the peripheral area.
6. Outdoor storage facilities shall be obscured
by an approved architectural screen or buildings
specified on the plat plan and approved by the
Planning Commission.
7: A plot and building plan showing compliance
with the provisions herein stated and consistent
with the amenities of the land use shall be filed
with the Planning Department and the building per -.
mit application shall comply with this approved
plot plan.
8. Structures shall not exceed thirty -five feet
in height and /or three stories except that when
/the site exceeds five acres, the height may be
raised one additional story for each additional
two and one -half acres within the site area bound-
aries when specifically approved by the Council
upon recommendation of the Planning Commission.
9. Outdoor storage shall not exceed twenty feet
in height, shall be screened from abutting
public streets and from adjacent properties. Such
screens shall be a minimum of eight feet high, and
not less than sixty percent of the height of the
material stored.
10. The minimum setback from all publicly used
�,_ rights -of -way shall be adequate to provide a

this setback to be measured from the minimum build-
ing setback line, where no front yard is otherwise
required.
