On August 9, 1983 at the Regular Board of Adjustment meeting the Board
approved the 3M building remodel parking variance from the code require-
ment for a drive between parking areas with the site boundaries, subject
to the following condition:
When a major revision is made to the site plan, the parking area
will be modified so all parking spaces will be internally accessible
to another per TMC 18.56.040(4C).

3M is requesting approval of a vari-
ance from TMC 18.56.040 (4c) to omit
driveway connecting the parking
areas on site.
Findings
1. Subject property is located at
100 Andover Park West in the CM-
Industrial Park district.
2. TMC 18.56.040 (4c) requires "all
parking spaces to be internally
accessable to one another without
reentering adjoining streets."
Criteria for Granting a Variance
3. After construction was under way,
in accordance with Ordinance 1233,
the applicant revised his plans
to provide a sidewalk at Andover
Park West. This revision involved
adjustment of existing driveways
and curbs, existing planting and
irrigation documents. One of the results was elimination of the drive-
way connecting the new south parking lot and west parking lot. The
drawing A -104 was submitted to the City and approved.

Applicant Response: Property use is not'changed. Parking traffic
as requested is similar to other parking traffic in the vicinity.

properties in Tukwila.

Applicant Response: See discussion in attached letter dated July
14, 1983. The South parking lot driveway is more than 100 feet
south of the entrance to the west parking lot and should not cause
traffic flow interruptions or delays.

Applicant Response: There will be no change in property use of
street traffic from parking areas if variance is granted.
Staff Response: It appears that approval of this variance will
encourage the goals and policies of the Comprehensive Plan in
terms of business expansion and provision of sidewalks. The Compre-
hensive Land Use Policy Plan encourages expansion of existing
businesses, similar to the addition project 3M Office is completing:
Allow for the location of new commercial and industrial areas
and the expansion of existing ones when this expansion is com-
patible with surrounding land use and not detrimental to the
public welfare.(Commerce /Industry Obj. 1, Policy 2)
The Comprehensive Land Use Policy Plan encourages the provision of
functional, safe and convenient sidewalks for pedestrians:
Construct sidewalks and pathways within and between com-
mercial areas and promote their use. (Transportation /
Utility Obj. 6, Policy 6)
In recent years, the number of pedestrains has increased significantly
in commercial areas of town. In order to accomodate this traffic, the
city has passed Ordinance 1233 for installation of sidewalks.

Applicant Response: Connection of parking areas will be an expense
to the owner and omission of landscape plantings enjoyed by others.
Staff's opinion is that the applicant has made sincere effort to meet
the provisions of City Ordinances. A variance will not be materially
detrimental to the public welfare or injurious to the property or improve-
ments in the vicinity and in the zone in which the subject property is
situated nor will it adversely affect the Comprehensive Land Use Plan
Policies.
It is the City Attorney's opinion that the variance be approved subject
to the condition that if a revision is made to the site plan, the park-
ing area will be modified so all parking spaces will be internally
accessible to one another per TMC 18.56.040 (4c).

We understand the occupancy permit for this project is held up
pending resolution of a requirement for connecting parking lots
within the site boundaries. On behalf of the owner, we wish to
apply for a variance from this requirement for the following
reasons:
1. After construction was under way, a change was made to
'provide a sidewalk at Andover Park West, in keeping with
Tukwila city requirements. This change involved an adjust-
ment of existing driveways and curbs, and changes to
existing planting and irrigation documents. One of the
results was elimination of the driveway connecting the new
staff parking lot south of the building and visitor's parking
west of the building. This Drawing A -104 (attached) was
submitted to the city of Tukwila and approved. As a matter
of fact, there was considerable conversation with Tukwila
officials on this matter since it involved access to existing
utilities at the sidewalk location.
a. Parking north of the building along the truck loading
area. This is used for warehouse staff and certain
office 'staff located in the north part•of the office wing,
using the north door to the offices.
b. Visitors parking located west of the building near the
front door.
c. Staff parking located south of the building. This serves
the rest'of the office staff, some outside sales people,
and service people who will use the south door to the
office wing.

3. One rationale for internal connections between parking areas
would be to minimize the number of driveways. Two of the
driveways existed prior to this work, and the third serves
the new south parking area. Addition of an internal drive
would not reduce the number of driveways and would, in fact,
complicate the driving pattern between the street and the
parking entrances.
For these reasons, we request a variance from the requirement for
this connecting drive between parking areas.

Minutes of the meeting of 2 June 1983.
The meeting was called to order at 8:06 p.m. by Chairman Richard Goe.
All members of the Board were present, and Associate Planner Mark
Caughey represented the Planning Department.
APPROVAL OF MINUTES
MOVED BY MRS. ALTMAYER, WITH MRS. REGEL'S SECOND, TO APPROVE THE MINUTES
OF THE MEETING OF 5 MAY 1983 AS PUBLISHED. MOTION CARRIED.
PUBLIC HEARING
1) Application 83 -7 -V, Pacific Northwest Bell Telephone requesting
a Variance from Tukwila Municipal Code Section 13.08 to install
temporary overhead telephone cables on Macadam Road South between
Southcenter Boulevard and So. 144th St.
In response to the Chariman's request, the verbatim reading of the staff
report. was omitted. Mr. Caughey outlined the most significant points there -
in, including the suggested conditions to accompany a favorable decision.
Questions and clarifications from the Board to staff followed.
The Public Hearing was declared open at 8:22 p.m. Byron Sneva, public
works director, spoke regarding the status of proposed design improve-
ments to Macadam Road. Construction of these improvements appears to be
approximately two years ahead. Mr. Sneva emphasized that the proposed
overhead cable is especially vulnerable to damage from traffic accidents
due to heavy use of these travelways.
Dennis Bedier, representing Pacific Northwest Bell, explained that the con-
duit which will be cleared.and replaced by fibreop,tics is aligned with 57th
Ave. So., not Macadam Road.
He explained that their construction schedule calls for completion of the
conversion process by this time next year. Mr. Bedier then explained in
greater detail the alignment of the 57th Ave. cable conduit.

Alternative temporary cable alignments were discussed, and relative visual
impacts were reviewed. Temporary undergrounding does not appear to be.
cost - feasible due to underlying geology.
In summary, Mr. Bedier urged approval of the proposed variance in the interest
of expediting expansion of community telephone service. Further questions
regarding construction techniques and timing followed.
In response to Mr. Goe's question, Mr. Bedier explained that the intent of
the proposed cable conversion is to accomodate future new service demands
as well as to enhance the quality of existing services.
Considerable discussion followed regarding evolution of the project's time-
line. It was the concensus of the Board that the timeframe for the tempor-
ary variance should accomodate the needed for delivery and testing of the
exotic hardware to be installed.
Ed Bauch, 16603 53rd Ave. South, stated his belief that the requested variance
is reasonable, and expained the history of the City's utility underground
program.
He does not object to the temporary use of overhead lines on Macadam Road,
but does question their visual impact on Southcenter Boulevard. He suggested
that the variance not override the prerogatives of the Public Works Depart-
ment regarding alignment and technical implementation of the project.
In response to the Chair, Mr. Caughey emphasized that the primary issue before
the Board is a "judgment call" which depends on the outworking of community
values; therefore, the staff recommendation is indeterminant. It is up to
the Board to determine first that a variance is appropriate vis -a -vis the
criteria, and then to define possible alternatives to the proposal.
The Public Hearing was closed at 9 :47 p.m. 'In response to Mr. Goe's invita-
tion to summarize the Public Works Department's position, Mr. Sneva suggested
that the variance be made to run effective from the start of construction.
Discussion among board members followed regarding the applicability of the
variance criteria to this case. Mr. Caughey quoted TMC 13.08.100 which
requires the Board to find that the criteria contained in the Title 18 have
been satisfied. the possibility ofdeferring announcement of the Board's
decision to a date beyond the Public Hearing was discussed.
A recess was called at 10:05 p.m. The Board reconvened at 10:15 p.m.
MOVED BY MRS. ALTMAYER TO APPROVE THE VARIANCE REQUESTED UNDER APPLICATION
83 -7 -V. IN SUPPORT OF THE APPROVAL DECISION, THE BOARD SHOULD FIND AS
FOLLOWS:
A) CRITERIA 1, 2 AND 5 AS CONTAINED IN TMC 18.72.20 ARE NOT APPLI-
CABLE TO THE PRESENT CASE.
B) REGARDING CRITERION 3, THE PUBLIC INJURY IS ACKNOWLEDGED BUT
IS OUTWEIGHED BY THE BENEFITS TO BE GAINED BY THE APPLICANT'S

NOT HAVE DEMONSTRABLE IMPACT ON THE COMPREHENSIVE PLAN.
Prior to completing her motion, Mrs. Altmayer requested guidance on the
appropriate definition of a time - frame. After discussion, the motion was
completed as follows:
THE APPROVAL ACTION IS CONDITIONED ON THE IMPOSITION OF THE FOLLOWING
TIME - PERIOD:
1) COMPLETION OF THE PROJECT SHALL OCCUR ON OR BEFORE 2 APRIL 1984.
THE MOTION WAS SECONDED BY MR. WELCH.
MOVED BY MRS. REGEL TO AMEND THE MOTION TO PROVIDE THAT THE VARIANCE SHALL.
REMAIN 'IN EFFECT FOR A NINE (9) MONTH PERIOD COMMENCING FROM THE TIME THE
WORK IS BEGUN. THE AMENDING MOTION WAS SECONDED BY MR. WELCH.
After discussion of the proposed amendment, Mrs. Regel and Mr. Welch agreed
to restate the amendment as follows:
THE VARIANCE SHALL REMAIN IN EFFECT FOR A NINE (9) MONTH PERIOD COMMENCING
FROM THE TIME WORK IS BEGUN OR TERMINATING ON 1 JUNE 1984, WHICHEVER OCCURS
FIRST.
THE RESTATED AMENDMENT WAS APPROVED UNANIMOUSLY.
Discussion of a proposed condition preserving the design guidance prerogatives
of the Public Works Department followed; the condition was deemed unnecessary.
Mr. Caughey explained the intent of the staff conditions, and that those
intents will be met whether or not the conditions are included in the motion.
THE ORIGINAL MOTION AS AMENDED WAS PASSED UNANIMOUSLY.
OTHER BUSINESS
In response to Mrs. Regel's inquiry based on last month's Board meeting,
Mr. Caughey explained that the multiple signing apparent at the Chuck E.
Cheese Restaurant was properly approved by the Planning Commission based on
Ordinance 1175 which was in effect at the time of application, but has now
been precluded by the amended sign ordinance. Thus, their sign program is
legally non - conforming under the present code.
Having concluded its business, the Board adjourned at 10:25 p.m.

the Southerly edge of the site, as noted

ordinance minimums.

The southern -most curb -cut will be relocated farther south to serve the
expanded parking area. We note, however, that the site plan does not
provide a 6' wide sidewalk on the Andover Park frontage of the site as
required by Section 2 of Ordinance 1158.
Exhibit C is the proposed site landscape upgrade; it is the designer's intent
to match the existing plant materials found on the site and to supplement new
areas with plantings complementary to the scale and texture of existing.
RECOMMENDATION
Staff recommends that the Board of Architectural Review approve the 3 -M
building remodel plan, according to Exhibits A -D of the application, with the
following stipulation:
1) Sidewalks shall be installed along the entire frontage of Andover Park

We understand the occupancy permit for this project is held up
pending resolution of a requirement for connecting parking lots
within the site boundaries. On behalf of the owner, we wish to
apply for a variance from this requirement for the following
reasons:
1. After construction was under way, a change was made to
provide a sidewalk at Andover Park West, in keeping with
Tukwila city requirements. This change involved an adjust-
ment of existing driveways and curbs, and changes to
existing planting and irrigation documents. One of the
results was elimination of the driveway connecting the new
staff parking lot south of the building and visitor's parking
west of the building. This Drawing A -104 (attached) was
submitted to the city of Tukwila and approved. As a matter
of fact, there was considerable conversation with Tukwila
officials on this matter since it involved access to existing
utilities at the sidewalk location.
2. There are three parking areas serving this building.
(See attached site plan.)
a. Parking north of the building along the truck loading
area. This is used for warehouse staff and certain
office staff located in the north part of the office wing,
using the north door to the offices.
b. Visitors parking located west of the building near the
front door.
c. Staff parking located south of the building. This serves
the rest of the office staff, some outside sales people,
and service people who will use the south door to the
office wing.

3. One rationale for internal connections between parking areas
would be to minimize the number of driveways. Two of the
driveways existed prior to this work, and the third serves
the new south parking area. Addition of an internal drive
would not reduce the number of driveways and would, in fact,
complicate the driving pattern between the street and the
parking entrances.
For these reasons, we request a variance from the requirement for
this connecting drive between parking areas.

Per Public Works November 15th, 1982 letter you:have provided a re- submittal
of your proposed sidewalk plan (file sheet #A- 104 /Project No. 81- 6265). Public
Works has reviewed this plan and approved it per the following comments:
1. Twenty -four hours prior to commencing construction, your contractor
shall apply for and obtain a sidewalk permit from the City.
2. All driveway accesses shall be provided with a continuous depressed
concrete curb and gutter and driveway apron per the City standard plans'
(attached). The driveway aprons shall be afforded a 10 -foot radii per
standard plan R -3 and R -5 which are attached. The curbs and gutters
shall be pured seperately from the concrete aprons.
3. In detail #3 (and elevation)' a one -foot transition shall be shown
as made with concrete.
4. The contractor, prior to beginning his work, shall meet with City
Inspectors Mark Reeves, (433 -1854) and Dave Grage of-the Water Department
. (433 -1863 to . review the construction phase.
5. City sidewalks shall be per the City standard plan (attached).
6. Prior to beginning work, all utilities shall be called for locations
within the construction area by the contractor including underground street
light wiring, and a determination as to conflict with the proposed con
struction and other utilities be made.
7. The stand pipe to the existing fire service line shall be relocated
outside of the City right -of -way and utility easements and in private
right -of -way.

1) Lundsgard proposed the sidewalk be directly adjacent to west
curb of their parking drive, with 8' grass and landscape
space between sidewalk and street. Sneva agreed.
2) Lundsgard expressed concern about 3M being exposed to liability
. and expense due to sidewalk use and repairs due to utility
maintenance and repair. Sneva will contact City Attorney and
see if these concerns can be settled. If so, the sidewalk
will be located as described. In any case, 3M will direct.

Per past correspondence (Public Works Department letter of 6/10/82 requiring
sidewalk.':fronting 3M property), the sidewalk requirement per City Ordinances
1158, 1217 and 1233 have been applied to your redevelopment. .Your p lan
revision dated 6/16/82 reflects the City's•requirements, including providing
for a raised 6 -inch curb per the City's standard sidewalk plan.
Per recent decisions in other parts of the City, we would like to have the' •
sidewalk relocated in such a manner as to provide for a 4•to 6 foot planting
strip between the curb and gutter and the sidewalk (see attached plan):
Providing the relocated sidewalk as suggested can allow for the•least amount
of utility relocations.
Requested at this time is a resubmittal of your sidewalk plan per the
suggested relocation prior to the construction of this sidewalk. If you
have any questions regarding this matter please do not hesitate to call
me at 433 -1856.

AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
RELATING TO'THE INSTALLATION, MAINTENANCE AND
REPAIR OF SIDEWALKS AND ADDING TO TUKWILA MUNICIPAL
CODE TITLE 11 AND REPEALING ORDINANCE NO. 1025.
WHEREAS, it is hereby deemed necessary in the interest of the
public safety, welfare, and convenience to establish requirements for the
construction of sidewalks for industrial, commercial and residential properties.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Sidewalks for new construction.
A. Whenever a building permit application is made for the
construction of new multi - residential, commercial, or industrial structures
within the City, the person, partnership, or corporation seeking such permit
shall submit a sidewalk construction plan for approval by the Director of the
Department of Public Works. The sidewalk construction plans shall include
all plans and specifications necessary for the construction of sidewalks
adjacent to all edges of the property adjoining any street or other public
right -of -way. A building permit shall not be issued until after a sidewalk
construction plan is approved by the Director of the Department of Public Works.
B. Building permit applications for construction of improvements
on properties zoned for single family residential use shall be excluded from
this requirement except when such sidewalk is built as a part of an overall
development, plat, or subdivision.
Section 2. Existing streets or arterials.
It is recognized that there exists in the City, arterials and
streets which do not have sidewalks. In furtherance of the intent of this
ordinance and subject to the limitations and exceptions provided in other
sections herein, it shall be a condition of the issuance of a building permit
for the following construction activities that sidewalks conforming to stand-
ards and guidelines prepared by the Department of Public Works shall be installed
along the entire street frontage of the property:
A. Substantial remodeling to buildings or structures adjacent
to a business or arterial street and neither zoned nor actually used as a
single family residence. For purposes of this chapter, "Substantial Re-
modeling" means construction which increases the floor area of an existing
building or structure by at least 20% or any alteration or repairs including
interior, plumbing, electrical and structural made within a 12 month period,
which together exceeds 25% of the value of the previously existing building
or structure.
Section 3. Standards of Construction.
A. All sidewalks required to be constructed under the provisions
of this section shall be of portland cement concrete and sidewalks shall
otherwise conform to standard specifications and plans for municipal public
works construction, commonly known as APWA Standards. All sidewalks required
to be constructed pursuant to the provisions of this section shall be 6 feet
in width for arterial streets; provided, however, that in C -i and C -2 zones,
sidewalks shall be 8 feet in width. All other sidewalks shall be a minimum
of 5 feet.
B. No fire hydrants shall be installed within the borders of
any sidewalk. Fire hydrants may be located between the curb and sidewalk.
Section 4. Delays, Waivers or Exceptions.

If any section, subsection, provision or clause of this ordinance
or its application to any person or circumstance is held invalid by a court
of competent jurisdiction, the remainder of this ordinance or the applications
of the provisions to other persons and circumstances shall not be affected.
Section 6. Repealer.
Ordinance #1025 is hereby repealed.

do ordain as follows:

1980, is hereby amended to read as follows:
"Whenever a building permit application is made for
the construction of new multi - residential, commercial
or industrial structures within the City, the person,
partnership or corporation seeking such permit shall
submit a sidewalk construction plan for approval by
the directors of the departments of Public Works
and Planning. The sidewalk construction plan shall
include all plans and specifications necessary for
the construction of sidewalks adjacent to all edges
of the property adjoining any street or public
right -of -way. A building permit shall not be issued
until after a sidewalk construction plan is approved
by the Director of the BepartMent- ef- Pubiie -Werk
Department of Planning with the consent of the Director
of the Department of Public Works.
"No final certificate of occupancy shall be issued
for the subject project until the sidewalks have
been constructed in accordance with the approved plan
or the applicant has made satisfactory alternate
arrangements with the Director of the Planning Department.

2. Section 4 of Ordinance No. 1155 passed on

considerations, City Public Works Development Plans
or would render a hardship on the applicant. In the

for delay, waiver or exception, such request must
be considered by the City Council at least thirty (30)
days before the requested building permit is issued.
"In the event a building permit is sought
for a development adjoining any street or
other public right -of -way which does not
have an established finished grade with
associated storm drain and utility systems,
including establishment of the width of
said street or right -of -way, the Director
of Public Works is authorized to enter into
an agreement with said permit applicant
to provide for the construction of said
sidewalk improvements by means of a proposed
local improvement district or developer's
agreement."
