This office concurs with your opinion of normal maintenance
on existing roadways being exempt from the permit requirements
of the Shorelines Management Substantial Development Act of 1971.
Those . projects referenced above are hereby exempted from .S orelines
Management permit requirements.

Dear Sir:
The above noted project is scheduled for completion in the very
near future. It involves removal of existing lane markers at
various locations and the installation of new lane markers on
the roadways shown on the attached map.
The proximity of this project to several major streams and lakes
places it under the jurisdiction of the 1971: Shorelines .Manage*
ment Act. However, since the project entails only work of a main -
tenance nature on existing roadways, it appears exempt from the
permit requirements of the Act.
Please furnish this office a letter exempting this project from
the permit requirements of the 1971 Shorelines Management Act.

Shoreline Management Act
— Exemptions from Permits
Dear Sir:
In conjunction with the subject of our March 27, 1972 letter to
your office there are several other proposed District 7 highway
projects located partially within the City of Tukwila which are
under the jurisdiction of the 1971 Shorelines Management Act.
The Department of Ecology has been contacted to determine if some
of these projects require a Shorelines Permit. As indicated in
the attached copy of their letter to this office they concur with
our opinion regarding projects of this nature.
The projects listed below involve only work of a maintenance na-
ture where the highway was constructed and opened to traffic prior
to June 1, 1971. They do not involve the expansion of the exist-
ing highway facility.
SR 5 So. 178th to Dearborn - Fire Protection
SR 405 Tukwila to Factoria - Fire Protection
SR 181 SR 405 to SR 5 - Resurfacing
Please review these projects and furnish this office a letter indi-
cating whether a Shoreline Management Permit is required for any of
them.

The above referenced highway project is located partially
within the City of Tukwila. Construction on this project
will consist of grooving the existing pavement, application
of an anti -skid pavement treatment, and related work.
The proximity of this project to the Duwamish River places
it under the jurisdiction of the 1971 Shorelines Management
Act; however, the proposed construction entails work of only
a maintenance nature.
This type of construction is listed as one of the exemptions
from the permit system of the 1971 Act and the Department of
Ecology has been contacted to determine if this project re-
quires a Shorelines Permit. They have concurred with our
opinion that this project by the nature of the work involved
is exempt from a permit requirement. However they have left
the final legal decision up to the local governments. involved.

Please notify this office in the immediate future as to whether
this project will require a Shorelines Permit. It is presently
scheduled for advertisement on March 27, 1972.

Your letter of November 4, 1971, to Mr. Robert Stockman asking for
his concurrence with your department's interpretation of the exclu-
sionary cluases contained in the Shoreline Management Act, has peen

referred to me for comment.
In your letter you site two examples of exemption which, in your
opinion, would apply to several of your projects. They are substan-
tial development undertaken prior to June 1, 1971, and maintenance
of existing structure.
From the information received, it would appear that you are correct
in your interpretation of the Act and that the projects you have
mentioned would he exempt.
However, inasmuch as local government has the primary responsibility
for initiating and administering the regulatory program of the Act,
the decision as to whether or not a Shoreline Management Permit will
be needed, rests with them.
I hope the above has been of some assistance to you. If, however,
you need additional clarification or assistance please contact me
at your convenience.
