SEPA Determination: The City SEPA Responsible Official has previously determined that this application
does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The Community Development Director has determined that the application
for a single cargo container complies with applicable City and state code requirements and has approved that
application subject to any conditions which are set forth in the Decision based on the findings and
conclusions contained in the staff report. The following conditions must be maintained:
• The container may not be moved from its current location on the site.
• The existing screening must be maintained.
• The container is painted to match the exterior color of the building.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.

A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Planning Commission decision.

In order to appeal the Community Development Director's decision on the Permit Application, a written ;t- z

V. APPEAL HEARINGS PROCESS "I O

Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Planning Commission based on the testimony and documentary evidence presented at the open record
hearing. The Planning Commission decision on the appeal is the City's final decision.
Any party wishing to challenge the Planning Commission decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The
project planner is Kathryn Devlin, who may be contacted at 206 -433 -7166 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

IV. PROCEDURES AND TIME FOR APPEALING

Decision Criteria
There is only one cargo container at this location. The applicant has agreed to paint the container
to match the exterior color of the building. While the container is not screened from adjacent
properties it does conform to the surrounding area landuse. The container does not occupy off -
street parking and meets the setback requirements for the C/LI zone.
CONCLUSIONS
The cargo container has been at this location for a number of years. The overall appearance of the
site and container is free from clutter and debris. The lack of adequate screening should not be
objectionable provided the applicant paints the container to match the building's color. The cargo
container is located at the rear of the building and meets the setback requirements for the LDR
DECISION
The request, as presented in the Attachments to this report, is hereby approved.

STAFF REPORT TO THE PLANNING SUPERVISOR
General Builders Supply is located in the Commercial/Light Industrial Zone in Fostoria Industrial
Park. The existing cargo container is backed up to the northwest side of the building next to the
business' loading doors. The surrounding property is paved and the area is clear from clutter and
debris. A landscape area with trees borders the property, providing minimal screening from S.
133 St.
Background Information
The 40 -foot cargo container was purchased in May 1998 and is being used for storage of
overflow merchandise.

Regarding: Cargo Containers as Accessory Structures
Dear Ms. Grierloff:
General Builders Supply, located in Fostoria Industrial Park, placed a cargo container
along side it's building in May 1998. The container is used for overflow of kitchen
cabinets. General Builders Supply wishes to apply for a permit from the city for the cargo
container.
Due to the distance that the cargo container is located from the street and neighboring
properties, General Builders Supply proposes to paint the container to match it's building,
but not install screening.
