To date, we have not received a copy of the recorded documents. Upon receiving approval from the City, the applicant will be responsible for picking up the documents from DCD and recording them with King County Office of Records. A copy of the recorded documents must be returned to DCD to finalize the approval process. The adjustment shall not be deemed complete until the City receives these documents. The boundary line adjustment application will expire if it has not been recorded within one year from the date of approval. Upon written request from the applicant prior to the expiration date, the Short Subdivision Committee is authorized to grant one extension, not to exceed six months. DECISION The Short Subdivision Committee has completed their review of your boundary line adjustment -lot consolidation (L01 -063) and has determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on your latest project submittal dated April 7, 2002, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the preliminary approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and was approved without conditions. 2. Final Approval The next step is to submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements. The surveyor's original signature and the notarized signatures of all property owners must be on the face of the plat. After the submitted documents have been found to be in order, and the all of the requirements of the boundary line adjustment -lot consolidation have been met, the Chair of the Short Subdivision Committee will sign your boundary line adjustment - lot consolidation which will constitute a grant of final approval. Expiration The final approved boundary line adjustment -lot consolidation must be filed with the King County Department of Records by April 12, 2003, one year from the date of this preliminary approval or the application will expire. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your boundary line adjustment -lot consolidation application is ready for recording. It is your responsibility to record the City approved boundary line adjustment -lot consolidation documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original boundary line adjustment -lot consolidation to King County (see the Recording Procedures handout, attached). The boundary line adjustment -lot consolidation is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your boundary line adjustment -lot consolidation is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded boundary line adjustment -lot consolidation to the project planner. In many circumstances, building permits on the affected property may not be issued until a copy of the recorded boundary line adjustment -lot consolidation (or original) is returned to the Department of Community Development. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. PROCEDURES AND TIME FOR APPEALING In order to appeal the Short Plat Committee's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by April 26, 2002. The name of the appealing party. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Short Plat Committee, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Short Plat Committee before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the-Decision on this permit will be final. By this letter, we agree to the consolidation of lots 9 and 10, contingent upon receipt of payment of $2000.00, which was the initial amount offered by Bond & Sons (see copy of letter attached). We recognize that Bond & Sons has not been able to clear this issue, and that is likely the reason that they are reluctant to issue the payment to Primera Iglesia Bautista. The term "mortgage," when used herein, shall include deed of trust, trust deed, or other security instrument. 2.
