and S97 -050).
As we discussed in our meeting, there are a few things that concern me about the Hall
Truck Center/Dome Leasing sign permits.
a) The business license for Hall Truck Center lists a different address then that found on
the sign permit.
b) The sign permit granted for Dome Leasing (S97 -050) is based on a wall area for a
tenant space that does not exist. If it does exist, then that same wall area can not be
counted in the wall area used to calculate the special permission sign for Hall Truck
Center (S97- 0049). The removal of the Dome Leasing wall area would make the
approved sign area for Hall Truck Center impossible to achieve.
c) Dome Leasing does not exist at the address that is listed on the sign permit (S97 -050).
There is no tenant space from which to make a sign area calculation. With no wall
area, there can be no sign.
d) Assuming the existence of Dome Leasing and given the wall area listed on the sign
application, the sign approved is 10 sq. ft. larger than the 6% maximum allowed
under a special permission sign. The business has not applied for a special
permission sign.
I am open to discussion as to what you think the appropriate action should be in these
cases. If you have any questions about my findings or would like to discus the issue
further, please come see me.

FINDINGS
Vicinity /Site Information
The applicant requests approval of a Special Permission Sign to increase the allowed sign area
for a wall sign. Attachment A shows the proposed sign for Hall Truck Center. The applicant is
requesting an increase of allowed sign area from 150 sq. ft. to 180 sq. ft., or a 20% increase.
Attachment B is the site plan showing the proposed location of this sign. The basis for the
applicant's request is two -fold. Applicants are requesting an increase of their allowed sign due to
the lack of a freestanding sign for this site and under provisions in TMC 19.32.140 (A)(2). The
applicant previously applied for a freestanding sign under sign permit application S97 -051. The
request was denied, as the sign did not meet height or message area requirements. The denied
freestanding sign and the sign being reviewed under this request are currently used by this
applicant at their Seattle store, which the applicant wanted to move to this site.
Decision Criteria
Special Permission Signs must comply with TMC 19.32.140(A)(2), which allows the permitted
sign area to be "increased by 50% for each doubling of the required minimum setback...but in no
case shall sign area exceed that permitted in TMC 19.32.150 ". TMC 19.32.150 allows a
maximum sign area of 6% of a building facade where a sign or signs will be located. The
building is setback approximately 70 feet from E. Marginal Way S, or 3.5 times greater than the
minimum 20 foot setback requirement for the MIC/H zone. The building facade has a total of
6,600 sq. ft. The allowed sign area using the doubling formula under TMC 19.32.140 (A)(2) is
421.87 square feet. The maximum allowed sign area for all signs, using the 6% formula, would
be 396 square feet.
CONCLUSIONS
1. The sign area allowed for the building must use the 6% formula set forth in TMC 19.32.150
2. The proposed sign area of 180 sq. ft. for the proposed sign is within the 6% sign area
maximum

h. Administrative appeals for the various permit Types are discussed below.
The period for administrative appeals is 14 days, starting from the issuance of this
Notice of Decision. The administrative body hearing each appeal is shown below. All
appeal materials shall be submitted to the Department of Community Development.
Appeal materials shall contain:
1. The name of the appealing party,
2. The address and phone number of the appealing party, and if the appealing
party is a corporation, association or other group, the address and phone
number of a contact person authorized to received notices on the appealing
party's behalf, and
3. A statement identifying the decision being appealed and the alleged errors in that
decision. The Notice of Appeal shall state specific errors of fact or errors in
application of the law in the decision being appealed, the harm suffered or
anticipated by the appellant, and the relief sought. The scope of an appeal shall
be limited to matters or issues raised in the Notice of Appeal.
