November 7, 1997 FINDINGS Shoreline Substantial Development Permit (18.44.80) Any substantial development within 200 feet of any shoreline must receive a shoreline substantial development permit prior to issuance of any local permits by the City. The proposed PCS base station will be located along the north facade of the existing building. The parcel for the proposed development fronts the Duwamish River for approximately 580 feet. The 500 square foot development area for the PCS station's operating equipment will be located approximately 80 feet north of the Ordinary High Water Mark (OHWM) at this stretch of the Duwamish River. The project must comply with Tukwila Shoreline Regulations and is not within the King County Shoreline Master program. Site plans and elevations showing proximity to the OHWM are attached. Criteria to meet both general and specific shoreline regulations follow. General Shoreline Regulations (18.44.110) 1. The use is in conformance with the regulations of the underlying district At 45 feet, the antennae configuration meets the 45 foot height limit for uses in the Commercial/Light Industrial (C/LI) zoning district. No other development regulations pertain to this proposal. However, approval of a Conditional Use Permit (TMC 18.64) is also required. The following are Tukwila Comprehensive Plan Shoreline Design Policies applicable to this project: 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations: All aspects of the proposed development are located approximately 80 feet away from the-riverbank. The existing building is located between the proposed development and the OHWM. The proposed development will overlay existing impervious surfaces. No vegetation will be removed or destroyed by this proposal. No new impervious surface area will be added and no waste discharged. Existing storm runoff infrastructure will be used to control storm water. Views of the antennae are intermittently visible from the river and adjacent residential uses. The proposed development will be predominately screened by the existing building. The ground equipment will be screened from the river by the existing building. To mitigate adverse impacts of the proposal, due to its proximity to the shoreline, a SEPA checklist and determination is required along with compliance with Tukwila's Design Guidelines (TMC 18.60). 2 L97 -0065 - Shoreline Permit GTE Wireless - 13400 Interurban Ave S. November 7, 1997 The project and associated technology pose no known threat to public health, safety, welfare, or capacity of the river to provide long -term community benefits. The applicant has argued that the PCS station will provide improved telephone service, thereby improving the public health and safety. of the community at large. 3. No structures or accessory facilities shall be located over the river unless such structures protects or promotes the public interest. N/A 4. There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as part of an approved shoreline substantial development permit. No disruption of existing vegetation will occur due to proposal. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. No discharge of effluent will occur due to proposal. 6. All States and federal water quality regulations shall be strictly complied with N/A 7. All necessary permits shall be obtained from federal, State, County or municipal agencies. The applicant shall obtain approval of SEPA checklist, Design Review and Conditional Use Permits from the City of Tukwila. A FCC permits has also been obtained. 10. Dredging for purposes other than for navigational improvements or flood control is prohibited. N/A 11. Mining is prohibited along the river shoreline N/A 12. November 7, 1997 Specific Shoreline Regulations - low impact environment (18.44.1401 This project will be located approximately 80' from the OHWM, falling in the Low Impact Environment zone. The following are development regulations for this zone, with appropriate responses: 1. The low impact environment shall contain no uses other than those allowed in the river environment and the following: a. Structures not to exceed 35 feet in height, excluding utility towers; b. Parking/loading and storage facilities adequately screened or landscaped; c. Railroad lead and spur trackage or public or private roads; d. Utilities, including towers; e. Signs not to exceed regulations of the underlying zoning district sign code. The proposed use is not a new structure, rather an attachment to an existing structure. thus the 45 height limit as it pertains to structures in the low impact environment does not apply here. Ground equipment will be located on a pad approximately 80 feet from the OHWM. The height of the equipment will be within the 35 foot height limit. 2. Low impact environment uses shall conform to the following standards: a. Structures shall be sited and appropriately landscaped in accordance with underlying zoning regulations; b. Access roads shall be located no closer than ten feet to buildings, spur tracks or parking/loading and storage facilities, and the effective setback area shall be suitably landscaped. This shall not prohibit ingress and egress points between an access road and the described facilities; Parking, loading, and storage facilities shall be appropriately screened from the river with: (1) A solid evergreen screen of a minimum six-foot height, or (2) Decorative fence six feet high, (Note: Chain link fence shall be slatted and planted with ivy or other trailing vine except where a safety hazard may exist.), or (3) Large hardy shade or fruit trees such as maple, alder, poplar, cottonwood, sycamore, willow, oak, beech, walnut, ash, birch or other species approved by the Director at a maximum of 30 feet on center, or (4) Earth berms at a minimum of four feet high, suitably planted with live groundcover or natural grass; 5 ~w: it ° JU U O' CO z. Railroad lead trackage shall be no closer than 15 feet to parking/loading and storage facilities, and shall be suitably landscaped. Ground equipment will be located adjacent to the north side of the existing building, which will provide screening from the river on three sides. The open side of the development area for operating equipment will be gated and screened for security and privacy. No landscaping is proposed for the area of development as it is adequately screened by existing development. Due to its proximity to the shoreline, aesthetic consideration of the proposal will be reviewed under TMC 18.60, Design Guidelines. RECOMMENDATION The city should issue a shoreline permit for this development. Project Description: This SEPA review is for a proposal to locate a Personal Communication System (PCS) base station at Furniture World, 13400 Interurban Avenue S. The proposed development will include a 20' pole affixed with twelve (12) antennae mounted to the north facade of an existing two -story building. The antennae configuration is accompanied by ground cabinets located on a 270 sq. ft. concrete pad, surrounded by a fenced area measuring approximately 500 square feet. The antennae will be used to transmit wireless-telecommunication signals. Shoreline Development Policies The proposed project may be found consistent with the goals and policies of the Tukwila Shoreline Policy by virtue of the virtually negligible impact on the surrounding land. The proposed project consists of a total of twelve (12) antennas attached to an existing building on a developed lot. The proposed radio equipment for the antennas will lie on the southwest side of the existing building and the Duwamish River lies on the northeast side of the building. No sensitive vegetation will be removed as part of this project. The proposed project will not exceed the height criteria, nor does it create any traffic, soil, erosion, police, fire or school impacts. The antennas will be a grey color which will blend in with the typical Washington skyline, and are screened from neighboring properties to the east by existing trees along the river. No recreational uses of the river will be impacted by the proposed project. The proposed project will provide enhanced telecommunications services to the businesses, roads and residences in the immediate area. Minimal power and telephone services are required, and will not create a significant drain on existing resources.
