"2. If at any time King County reasonably determines that
neintenance or repair work le required to be done to the

Transportation shall give the current holders of any right title
or interest in the property seven days notice that the County
intends to make such repairs.

property will assume responsibility for the cost of such

days of receipt of the invoice. Overdue payments will require
payment of interest at the current legal rate for liquidated
judgments, and any costs or fees incurred by the County, should

any existing retention /detention system poses • hazard to life and
limb, or endangers property, or adversely affects the saiety and
operations of a public way and that the situation is so adverse
as to preclude written notice, the director of the Department of
Public Works & Transportation may take the measures necessary to
eliminate the hazardous situation (provided the director has first
made a reasonable effort to locate those interest holders before
acting).

ROAD RIGHT -OF -WAY DEDICATION
This Road Right -of -Way Dedication is made and given this
day of , 1993, by DOUGLAS S. MURRAY and
KIMBERLY R. MURRAY, husband and wife (GRANTOR), to and for
the benefit of the CITY OF TUKWILA, a Washington municipal
corporation (the "City ") .
In recognition of the benefits we receive as users of the improved
facility, the sufficiency of which is hereby acknowledged, Grantor hereby
conveys and quitclaims to the City, right -of -way for the purpose of
construction and perpetual maintenance of roadway improvements and
perpetual use by the public of public sidewalks over that property referred
to as Dedication Parcel No. 26, and more particularly described in
Exhibit A attached hereto and incorporated herein by reference (the
"Right -of -Way Dedication ") as shown on Exhibit B attached hereto and
incorporated herein by reference.
Together with the right of entry upon the abutting land for the
purpose of reconstructing existing driveway approaches, minor
construction and .regrading as required for constructing sidewalks, curb
and gutters, sloping banks, retaining walls, adjusting existing fences, and
other property restorations that are required to match the proposed
improvements. Upon completion of the improvements, the abutting
property will be restored to its original condition as near as may be done.
The terms and conditions of this right -of -way dedication shall be
binding upon and inure to the benefit of the City, Grantor, and their
respective successors and assigns.

MEMORANDUM OF UNDERSTANDING

The purpose of this Memorandum of Understanding is to summarize the agreement under which
the Murray's will dedicate an easement to the City of Tukwila.
In consideration of the grant of an easement as described on the attached Exhibit A, and as shown
on the attached Exhibit B, the City of Tukwila will provide an exhibit for a boundary line
adjustment (BLA) for said lot and the adjacent lot to the West, both of which are under common
ownership by Douglas S. and Kimberly R. Murray.
The exhibit will be prepared by the City of Tukwila, and will follow the guidance of Douglas S.
and Kimberly R. Murray. The Public Works department will prepare and submit the application,
including fees if applicable, for normal processing by the City.
The City of Tukwila does not warrant or guarantee that any change in land use zoning or function
will result from the BLA.
The City will direct the BLA work to begin within five working days of receipt of the signed
easement dedication.

9. List any government approvals or permits that will be needed for your
proposal.
Planning Commission Recommendation and City Council Ordinance
amending the Zoning Code.
10. Give brief, complete description of your proposal, including the
proposed uses and the size of the project and site. There are several
questions later in this checklist that ask you to describe certain aspects
of your proposal. You do not need to repeat those answers on this page.
Amend the Zoning Code to make the following changes:
Create a "Demonstration Program" Chapter (18.58 TMC) that provides a purpose, scope and
authority for projects to be reviewed under the "Demonstration Program," and to specify the
authority for and-criteria to be followed on waivers from Code standards.
Include in the Program the following elements:
• Location within the Tukwila International BL. urban renewal area;
• Minimum site size of three quarters of an acre;
• A maximum of three completed projects and then preparation and evaluation of results
from the program;
• Allow all zoning code chapters listed above to be included in the "Demonstration
Program; " and
• Use of criteria for approval, denying or conditioning a project in the Demonstration
Program.
• Criteria
Provides innovative design solutions
Compatible with the on -site or adjacent residential areas
Serves as a model for the redevelopment of low scale auto oriented
commercial areas into pedestrian oriented multi -use higher intensity areas
Expands the consumer market through jobs or housing that supports the retail
and commercial goods and services of the Tukwila International Boulevard
corridor.
Creates high quality sites and structures
Amend Permit Application Types and Procedures Chapter (18.104 TMC) to add
"Demonstration Program" to the Type 4 Table for projects with no requested height waivers
& Type 5 Table for projects with requests for height waivers.
11. Location of the proposal. Give sufficient information for a person to
understand the precise location of your proposed project, including a
