At their December 11, 1996, the Planning Commission approved the applicant's request for a Personal Communications System (PCS) Base Station, to be located on the rooftop of the Nicewonger Building, 10825 E. Marginal Way S. with the approved configuration attached to this Notice of Decision. In their decision, the Planning Commission adopted the staff report, including the two conditions indicated in the recommendations. The staff report on this project is attached. PROJECT BACKGROUND a. The proposal includes the installation of four (4) cabinets housing operating equipment for processing signals. The cabinets, to be located in a fenced area outside the building, will be linked to the rooftop antennae through electric cabling. Twelve (12) antenna, including a Global Positioning System (GPS) antennae, will be mounted on a triangular frame. The frame will be mounted onto a • thirty -two (32) foot mast attached to the rooftop, giving the system the appearance of a monopole. Attachment A are computer enhanced photographs of the site and proposed antennae. Attachment B shows all pertinent ground equipment and cabling for the base station. The antennae array and mast will be mounted on the rooftop of the building, supported by four (4) guy wires. The total height of the antennae and the mast is forty -four (44)'. feet, six (6) inches. As the building supporting the structure is twenty -seven (27) feet tall, the top of the antennae will be 62 feet high. Attachment C shows elevations of the building, antennae and mast. Existing Development The site is currently occupied by the Nicewonger Building, a one -story office complex. Surrounding Land Uses The entire surrounding area is zoned ■C /H, dominated by Boeing worksites, Associated Grocers and other manufacturing, industrial and distribution uses. Directly north is a Chevron Convenience Store. To the south is a one -story warehouse and a one -story office, oit separate parcels. To the east is a one -story multi- tenant commercial structure. To the west is another series of one -story multi-tenant office, warehousing and distribution uses.. Access Access to the equipment room will be made through a locked gate. Rooftop antennae will not be accessible to the general public. CONDITIONAL USE CRITERIA The proposed project must conform with criteria detailed in Zoning Code section 18.64.050, (1 -5), concerning Conditional Use Permits: 2 Staff Report to the L96 -0062 Planning Commission Sprint Spectrum /Nicewonger Building (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. Applicant has proposed placing all operating equipment in a locked and gated area on the outside of the building, away from public view or access. Further, the applicant has proposed painting the rooftop antennae and supporting mast a color to help the system blend in with its surroundings. The rooftop antennae will not be accessible to the general public, as access will only be available through a roof access hatch. The rooftop antennae will include structural support to ensure safety to the equipment, the building and surrounding land uses. As the proposed base station is telecommunications equipment that falls within the safety parameters set by the American National Standards Institute (ANSI), there would appear to be no known health impacts with this proposal. Finally, the Federal Aeronautics Administration (FAA) has approved this proposal and will not require any special lighting or markings, nor has the FAA determined that it would be a hazard to navigation. The aeronautical study required for construction near Airports is included as Attachment E. (2) The proposed use shall meet or exceed the performance standards that are required in the . district it will occupy. Performance standards for uses in the MIC /H zone include setbacks from front, side and rear yards, a maximum of height of 125 feet, five (5) foot landscaping along front yards and one (1) parking space per 1,000 gross square feet. Currently, the landscaping along Pacific Hwy S. does not comply with code requirements. Tukwila Municipal Code section 18.70.090 requires that when a change in use or structures at a premises occurs, nonconforming landscaping must be altered to conform with code requirements. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed project will be located in the MIC /H zone. Cellular telephone'equiliment is complementary to other uses predominate in this zone. The PCS system will generate traffic of approximately 24 trips per.day during the construction period and, following the completion of construction, 1 trip per month for maintenance. The proposed location of the antennae and the rooftop equipment ensures no impact on pedestrian or vehicular mobility. There does not appear to be any conflict with the antennae and its location in relation to King County Airport, in terms of height or radio frequency. Please refer to Attachment E for the determination made by the FAA concerning this . antennae. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. The project will use existing electrical services provided to the building. The applicant z will extend utilities from the existing electrical room to the new equipment room. CONCLUSIONS The Planning Commission, pursuant to Tukwila Municipal Code (TMC) Section 18.108.040, hereby makes the following findings and conclusions under the city's Conditional Use Permit criteria (TMC 18.64.050) (1) The proposed use will not be materially detrimental to the public welfare... Potentially hazardous operating equipment is inaccessible to the public. The associated technology is within federal safety guidelines. The antennae and mast will be painted to blend with its surroundings. The rooftop antennae have been given appropriate structural support. Approvals for the project have been given by the FAA. The applicant must submit a landscaping plan with their Building Permit application, with all landscaping to be completed prior to the issuance of a permit. 2. The applicant must also notify the city by March 17, 1998, 2 months prior to May 17, 1998, the expiration date of the FAA determination, if they will be seeking a reauthorization from the FAA for the antennae. Performance standards for uses in the MIC /H zone include setbacks from front, side and rear yards, a maximum of height of 125 feet, five (5) foot landscaping along front yards and one (1) parking space per 1,000 gross square feet. Currently, the landscaping along Pacific Hwy S. does not comply with code requirements. Tukwila Municipal Code section 18.70.090 requires that when a change in use or structures at a premises occurs, nonconforming landscaping must be altered to conform with code requirements. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed project will be located in the MIC /H zone. Cellular telephone equipment is complementary to other uses predominate in this zone. The PCS system will generate traffic of approximately 24 trips per day during the construction period and, following the completion of construction, 1 trip per month for maintenance. The proposed location of the antennae and the rooftop equipment ensures no impact on pedestrian or vehicular mobility. There does not appear to be any conflict with the antennae and its location in relation to King County Airport, in terms of height or radio frequency. Please refer to Attachment E for the determination made by the FAA concerning this antennae. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan 3 Staff Report to the L96 -0062 Planning Commission Sprint Spectrum /Nicewonger Building The following are applicable Comprehensive Plan policies for this use: 12.134. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. The project will use existing electrical services provided to the building. The applicant will extend utilities from the existing electrical room to the new equipment room. The applicant will secure service from Seattle City Light. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure, use of existing structures and installation of telephone switching facilities in buildings compatible with the surrounding area. The applicant is using an existing building to provide necessary height in lieu of establishing a separate monopole. The applicant is not proposing a facility that will be shared with any other PCS providers, however the project allows for future expansion within this proposed array. Attachment C indicates that future expansion will allow up to 6 more antennae within the proposed framework. To minimize visual impacts associated with this project, the applicant will paint the rooftop mounted mast and antennae to blend with its surroundings. All ground equipment will be located near the existing building, behind fencing and out of view from the general public. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. • The applicant has proposed placing all antennae on the rooftop, away from public access. The antennae array on the roof will be painted a color that will help them blend in with their surrounding. Applicant has also placed all operating equipment near the building, surrounded by a locked fence and out of public view. CONCLUSIONS The Planning Commission, pursuant to Tukwila Municipal Code (TMC) Section 18.108.040, hereby makes the following findings and conclusions under the city's Conditional Use Permit criteria (TMC 18.64.050) (1) The proposed use will not be materially detrimental to the public welfare... Potentially hazardous operating equipment is inaccessible to the public. The associated technology is within federal safety guidelines. The antennae and mast will be painted to blend with its surroundings. The rooftop antennae have been given appropriate structural support. Approvals for the project have been given by the FAA. Sprint Spectrum is requesting permits to allow it to construct and operate a wireless Personal Communication Services (PCS) base station facility in the City of Tukwila. The purpose of this letter is to explain Sprint Spectrum's request and proposed use in support of its application. This letter briefly describes Sprint Spectrum and PCS, what Sprint Spectrum proposes, and outlines facts that support its application for a Conditional Use Permit. Sprint Spectrum: Sprint Spectrum is a partnership of Sprint Corporation, Telecommunications Inc. (TCI), Cox Communications, and Comcast Corporation. The partnership was formed in 1994 to develop and provide nationwide Personal Communication Services (PCS) over a wireless network. In March of 1995, Sprint Spectrum obtained licenses from the Federal Communications Commission for the Seattle Major Trading Area and 28 other markets throughout the United States. The Seattle Major Trading Area includes the western two- thirds of the State of Washington. Personal Communication Services (PCS): "Personal Communication Services" is an innovation in wireless telecommunications technology. PCS offers a unique combination of telecommunications services designed for the general public, which include small compact wireless phones, pagers, caller ID, notepad size computers with wireless modems, fax machines, and other customized mobile equipment and features. Base stations consist of radio equipment cabinets and antenna arrays that transmit and receive radio signals in the 1850 to 1970 Megahertz frequency bands. Standard commercial power and telephone lines serve the system. As the Sprint Spectrum mobile telecommunications customer moves throughout the system, the customer's call is passed from one base station to another. Although similar to cellular in passing calls, PCS services differ from existing cellular services in a number of significant . Q ways. z PCS utilizes new 100% digital technology rather than the older analog /digital hybrid systems 6 -J C.) currently being used by cellular companies. This new technology uses a higher frequency and U O. cn less power than cellular. The phones and other equipment are smaller and lighter than current vi w cellular phones. F=; LL,'. w O By using this new digital technology, Sprint Spectrum's PCS system will produce a superior voice quality, provide better security protecting customer privacy, and have fewer dropped g � a. calls than cellular. In addition, Sprint Spectrum's PCS system will have lower subscriber rates, which will make wireless communications accessible to almost everyone. = d, w F = Proposal Description and Basis for a Conditional Use Permit and Variance: z 0: ui Proposal Description: O • cn: o Sprint Spectrum proposes to construct a PCS facility on Nicewonger building, which is located 'uuj !— at 10825 East Marginal Way South, Tukwila, Washington. This facility will service the City of • v' Tukwila as well as surrounding areas. � p LLi z; The proposed facility consists of a 32 foot mast, similar to a small monopole, which supports a U N' H triangular antenna mounting platform. Please refer to the attached drawings. Each side of the O platform supports four antennas that measure approximately 64 inches in height, are 6. inches Z wide, and 2 inches deep. The antenna sectors face north, southeast, and southwest. In addition, a Global Positioning System ( "GPS ") Antenna, (2 inches tall and 4 inches in diameter), used for timing purposes, is mounted to top of the pole. The antennas are serviced by four self - contained equipment cabinets, which measure approximately 60 inches tall by 30 inches square. Electric power cables run underground, from the equipment cabinets, up the pole, to the antennas. The cabinets are placed on a 6 foot by 10 foot concrete pad near the northwest corner of the building. Basis for a Conditional Use Permit: The Nicewonger property is located in a Manufacturing /Industrial Center -Heavy (MIC /H) zone. The City of Tukwila Municipal Code (TMC) defines this district as "intend[ed] to provide a major employment area containing heavy or bulk manufacturing and industrial uses, distributive and light manufacturing and industrial uses, and other uses that support those industries. This district's uses and standards are intended to enhance the redevelopment of the Duwamish Corridor." TMC 18.38.010. TMC 18.38.040 sets out the Conditional uses permitted and conditional uses in a MIC /H zone. TMC 18.38.040(6) specifically notes that "... cellular or observation stations and towers;" are permitted conditional uses in this zone. The criteria are set forth below and are followed by facts that will support Sprint Spectrum's request for a Conditional Use Permit. The standards and criteria governing the issuance of conditional use permits are as follows: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The antennas are designed to have minimum visual impact. During the two (2) week construction period, when Sprint Spectrum limits hours of construction to lam to 5pm Monday through Friday, there will be approximately 24 vehicle trips per day. During operation, the facility is not staffed and inaccessible to the public. The facility does not emit harmful rays, noxious odors, heat, excessive noise or pollutants. The radio signals emitted from the PCS antennas do not contain any known health risk to the public. 2. The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The proposed conditional use meets the performance standards in the Manufacturing/ Industrial Center - Heavy (MIC /H) District. 3. The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; During normal operation, the proposed facility is not staffed and requires only one maintenance visit per month. There is no disruption or change in pedestrian circulation. Where possible, Sprint Spectrum attempts to locate its facilities in commercial /industrial areas to minimize its impact on the community it will serve. In the present case, the proposed site is located in a MIC /H zone which is designated for general industrial /manufacturing uses. Since PCS is a commercial /industrial use, adjoining or abutting property will not be injured or suffer detriment. The existing Nicewonger building remains unchanged. The site is designed to minimize the visual impact by placing the facility on the roof. Taking into account these factors and the fact that the site lies within a predominately industrial zone, the proposed development will be compatible with the surrounding land uses. z aZ • iw 6 D • • JU U O: • Nom. The proposed utility use is subject to the following parts of the Comprehensive Land Use Plan: Policies for Non -City -owned Utilities General Policies 12.1.34 Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. Sprint Spectrum follows The City of Tukwila's Development Regulations. Please see the site plans and elevations. 12.1.36 Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Sprint Spectrum seeks to consolidate its facilities with other wireless telecommunications providers when project scheduling, radio frequency design, and construction feasibility is possible. In the case of this proposed site, none of the other wireless telecommunications providers have expressed an interest in such a consolidation effort at this location. Sprint Spectrum does minimize visual impacts of facilities at all opportunities. In this proposal, the equipment cabinets are placed close to the existing building, behind fencing, out of site of the public. In addition, the rooftop - mounted mast and antennas are placed on the roof top on the existing building and will be painted an acceptable color to blend with the surrounding environment. This thereby minimizes the visual impact. 5. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. Sprint Spectrum will place the proposed use on the roof of the existing building. The equipment cabinets are close to the building, behind fencing, making them less visible to the public.. The site is not staffed. During the installation of the proposed use, there will up to 24 vehicle trips per day for the two week construction period. Therefore, there are minimal circulation impacts. The proposed conditional use meets all requirements for the health and safety of the community. PCS facilities operate at a high frequency with very low power. The American National Standards Institute (ANSI) has established a standard for safe levels of radio frequency energy. These standards are designed for 24 -hour- per -day, lifetime exposure from conception through adulthood. The development of safety standards examines the entire body of scientific literature. Currently, there are over 10,000 such reports. Over 100 experts work on the committees continuing to evaluate the biological effects of radio frequency energy and electromagnetic fields. "Under the most conservative assumptions of any scientifically recognized standard, the electromagnetic fields associated with PCS base station antennas are many many times below the levels associated with adverse effect, and many many times below the safety standards that have been recommended by the experts in the various published standards. The proposed conditional use is secured by a locked chain link fence. The proposed conditional use generates one maintenance visits per month. The proposed conditional use is not staffed. Therefore pedestrian and vehicular traffic associated with the proposed conditional use will not be hazardous or conflict with existing and anticipated traffic in the neighborhood. The proposed conditional use requires power and telephone service. The equipment cabinets are secure and have alarms if disturbed. The equipment cabinets are surrounded by a fence. There are no additional public facilities or services required for the proposed conditional use. A common question asked is whether PCS signals will cause interference with other frequency uses in the area, such as TV, cable, or radios. The FCC regulates frequency use by granting licenses. It has designated certain frequencies for specific uses. The following sets forth some examples: AM Radio: 540 -1600 kHz FM Radio: 88 -108 MHz Television: 54 -806 MHz Cellular and ESMR 800 -900 MHz Cable TV: 50 -500 MHz PCS: 1850 -1970 MHz Transmitting and receiving equipment of all kinds is manufactured according to the assigned FCC frequencies. As a result, Sprint Spectrum is not allowed to transmit a signal that could be received by a radio or television set, or other electronic equipment. z ww ug D J U: 0 C w= • •u 0. gQ — d �._. •?E-: 1- O. • Z I- AU La 0 • ;O — 0 w W` Z'. .0 - O z PCS base stations operate at very low power levels (200 watts or less). In contrast, other broadcast stations such as AM /FM radio or TV operate at up to five million watts. Most electronic equipment is designed with electronic shielding to prevent undesirable radio signals from being picked up by other electronic circuitry. There should be any problem of interference from properly shielded, maintained, and operated to avoid interference. In sum, Sprint Spectrum's proposed PCS facility does not endanger the public health or safety and will not tend to generate a public nuisance for the following reasons: • The proposed PCS facility uses a low level of electricity and is inaccessible to the public. • The proposed PCS facility uses less power and operates at a lower frequency than a typical microwave relay station, which has been deemed a use that is in the public's health and safety. • The proposed PCS facility emits radio signals at 0.0015% of the maximum safety exposure level established by the ANSI. • The Telecommunications Act of 1996 prohibits decisions regarding locating PCS facilities on the basis of environmental effects of radio frequency emissions. • That the use meets all required conditions and specifications set forth in the zone where it proposes to locate. TMC 18.38. Summary: Wireless communication services provide many benefits to the general public. In addition to the everyday convenience of a mobile phone, wireless communication capability allows communication in emergency situations, such as reporting auto accidents, drunk drivers, crimes in progress, or calling for help because a vehicle has run out of gas. Wireless services allow the user access to communications virtually anytime, and from anywhere. By approving the proposed permits, and allowing for the construction of the proposal, Sprint Spectrum will have the opportunity to add to the vitality of the area which is in keeping with the focus and goals of the City Zoning. Ordinance and the Comprehensive Plan. The granting of this proposal is within the scope and range of other uses in the 'area, and promotes orderly future development, and allows the expansion of current uses.
