BOUNDARY LINE ADJUSTMENTS
AND LOT CONSOLIDATIONS

Purpose.
Scope.

17.08.010 Purpose.
It is the intent to provide an efficient and timely
process that allows consistent review; to ensure such
actions do not create non - conformities with zoning and
other city regulations; to provide a permanent record of
boundary line adjustments and lot consolidations; and
to ensure appropriate provisions are made for access
and utility easements; in a manner consistent with
RCW 58.17.040(6).

17.08.020 Scope.
This chapter applies to all boundary line adjust-
ments and lot consolidations which are otherwise
exempt from RCW 58.17.040(6), Subdivision Regula-
tions.

17.08.030 Preliminary approval.
A. In order to receive preliminary approval, the
applicant must submit to DCD a complete application,
in quantities specified by DCD, and meet the criteria for
approval.
B. A complete application consists of the
following:
1. A completed application on a form provided
by the Department of Community Development and
fee as identified in TMC Chapter 18.88.
2. A neat and readable plan drawn to a
standard decimal (engineer) scale. A survey may be
required if it is determined that level of information is
needed to ensure the adjustment meets the approval
criteria. The plan shall show the following
information:
a. Property lines, with those that remain
in their existing location shown as a solid line, those
that are being moved or removed shown as a dashed
line, and those that have been relocated shown as a
solid line and clearly identified as a relocated line.
b. Dimensions of all property lines and
area of the lots, before and after the adjustment.
c. Location and floor area of all structures
on the site, and their setbacks from existing and new
property lines.
d. Location and purpose of all easements
on the site.
e. Location, purpose and legal description
of any new or extended easements proposed.
f. Location of adjacent public roads and
points of access from the public road(s) if a lot does not
front on a public road, show how and where access is
provided.

required yards of the Uniform Building Code are met.
3. Before and after legal description of the
affected lots.
C. In order to approve a boundary line adjustment
or lot consolidation, the Short Subdivision Committee
shall determine the project complies with the
following criteria:
1. No additional lots, sites, parcels, tracts or
divisions are created.
2. The adjustment will not create non-
conforming lots with respect to zoning dimension and
area standards, zoning setbacks and lot area . coverage
standards.
3. The degree of non - conformance on
existing non - conforming lots with respect. to zoning
dimension and area standards, zoning setbacks and
floor area ratio are not increased.
4. All lots have legal access to a public road.
Existing required private access road improvements
and easements are not diminished below subdivision
ordinance standards for lots that are served . by a private
access road.
5. Existing easements for utilities are
appropriate for their intended function, or they are
extended, moved or otherwise altered to an
appropriate location.
6. The adjustment does not create any non -
conformities with respect to the Uniform Building
Code or any other locally administered regulation.

17.08.040 Recording.
A. After preliminary approval has been granted, an
application for final approval shall be submitted to DCD
for final review.
B. A complete final application shall consist of the
documents required for recording including:
1. Drawing or survey of the boundary line
adjustment.
2. Before and after legal descriptions of the
affected lots.
3. Affidavit of ownership.
4. Application on a form provided by the
Department of Community Development.
5. Other documentation necessary to
demonstrate the conditions of the approval have been
met.

VICINITY/SITE INFORMATION
1. Project De cription: The applicant has requested one wall sign 50.24 s.f. in

The applicant requests a sign area increase pursuant to TMC 19.32.140(A)
to allow the second sign as proposed.
2. Site and Surrounding Land Uses: The site is currently a McDonald's fast
food restaurant with 3,532 s.f., which is expanding by 1,408 square feet.
The proposed sign is requested as part of the new construction.
Surrounding uses along Pacific Hwy. South include a range of auto - oriented
commercial businesses.
Existing Signage: The site currently has a legally non - conforming
freestanding sign which would remain. It also has five "McDonald's" flags
flying atop the building and one " McDonald's" flag flying from the front flag
pole. The level of conformity with the Tukwila Sign Code is presented
below.

4. Surrounding Signage: There are numerous examples of legally non -
conforming signs in the vicinity which were installed when the area was
unincorporated King County. However, there are a similar number of signs
which conform to the Tukwila Sign Code, especially all new construction.
DECISION CRITERIA
Sign Area Increase Criteria and Calculations
TMC 19.32.140(A) authorizes the Planning Commission to grant a maximum
increase of 50% for each doubling of the required minimum setback distance for
the wall on which a particular sign is to be placed. However, in no case may the
sign exceed 6% of the wall area or 500 s.f., whichever is less.
The 840 s.f. tenant wall within the building is located about 55 feet back from the
front property line. This compares with the required 20 foot building setback.
One 50% sign area increase, based on one doubling of the setback area, would
result in a 57.9 s.f. sign. However, total sign area is also limited to a maximum of
6% of the wall on which the sign will be mounted. The maximum wall sign size is
(840 s.f. x 6% =) 50.4 square feet.
The proposed 50.24 s.f. sign is less than the maximum 50.4 s.f. sign allowed.
The proposed sign is visually in scale with the building and consistent with the
overall project design.
Legally Non - Conforming Sign Analysis
The applicant's business currently enjoys a higher level of signage than other
businesses installing new signs under the Tukwila Sign Code. The request for a
discretionary increase in sign area, over that permitted outright, would increase
this advantage, to the detriment of other new competitors.
This is the first known instance when the Commission will have to address a
situation where a business, with legally non - conforming oversize sign area, is
requesting approval of a further sign area increase which it would normally qualify
for.
CONCLUSIONS
The Planning Division concludes the following:
1. The proposed sign area increase is a discretionary permit which is issued by the
Planning Commission.

2. The sign area increase granted is "no more than 50 percent for each doubling of
the required minimum setback..." (TMC 19.32.140(a)). The Commission is
authorized to grant less or no increase.
3. A balance should be struck in weighing the applicant's demonstrated ability to
satisfy the requirements for a sign area increase, and the fairness of allowing
further discretionary sign area increases to a business which already has more
signage than would be allowed to other businesses developing under this Code.
4. The Division concludes that the legally non- conforming sign area should be
recognized, the business should be allowed the basic additional sign area normally
permitted outright, but that an additional sign area increase due to a discretionary
permit should not be granted until the site is in conformance with the existing Sign
Code.
RECOMMENDATIONS
The Planning Division recommends approval of the proposed sign area increase on the
condition that the freestanding sign be brought into conformance with the Sign Code and
the McDonald's flag signs are removed.
This conditional approval would allow the applicant time to consider his options and take
immediate advantage of the sign area increase should he bring his signs into
conformance.
